Date: Signature RETURN ONE COMPLETED COPY TO SUFFOLK COUNTY DEPARTMENT OF CIVIL SERVICE Laurel Lake Project Proposal to Enhance the Floral Diversity Prepared by Group for the East End August, 2023 To diversify the mowed, grassy area adjacent to the pavilion at Laurel Lake, a suite of native tree species has been chosen. A mix of these species could be added to this site. All are young trees and will need to be protected from herbivory, mainly, deer browsing. Trees should be fenced or wrapped until above browse height, approximately 6-8 feet. American hornbeam (Carpinus caroliniana) 20-35 ft. height and width Lifespan: 50-150 years American chestnut (Castanea dentata) Up to 100 ft. Lifespan: 2-3 centuries Tulip poplar (Lirodendron tulipifera) 8-120 ft. Lifespan: Up to 500 years in optimal conditions All species have value to wildlife, will provide shade as they mature and create a beautiful space for community members and other visitors to the park. New York State has recently approved a new Firefighters Exemption. This will replace the current law which will need to be repealed. We currently have 403 firefighters' exemption throughout the Town. The new law will require all of the firefighters that are currently receiving the exemption to fill out a new application. As the law stands now the Town has approved the following: 1. 5 years as an enrolled member 2. A 10% deduction off the assessment 3. 20 Year life time exemption 4. Un-remarried spouse of a firefighter who had at least five years of service and is already receiving the exemption and is killed in the line of duty can continue to receive the exemption. 5. Un-remarried spouse of a firefighter who has 20 years of service can continue to receive the exemption. The new law: 1. Reduces the number of years from anywhere from 2 — 5 years as an enrolled member. 2. Up to a 10% deduction off the assessment. 3. Same as above 4. Same as above 5. Same as above Town of Southold,NY § 245-11 § 245-11 ARTICLE V Exemption for Volunteer Fire Fighters and Ambulance Workers [Adopted 2-25-2003 by L.L.No. 4-2003; amended in its entirety 11-30-2004 by L.L.No. 24-20041 § 245-11. Exemption granted; amount; qualifications. A. Qualifying residential real property, under § 466-c of the New York State Real Property Tax Law, owned by an enrolled member of an incorporated volunteer fire company, fire department or incorporated voluntary ambulance service, or such enrolled member and spouse residing in Suffolk County, shall be exempt from taxation to the extent of 10% of the assessed value of such property for city, village, Town, part Town, special district, county or school district purposes, exclusive of special assessments. B. Such exemption shall not be granted to an enrolled member of an incorporated volunteer fire company, fire department or incorporated voluntary ambulance service residing in such county unless: (1) The applicant resides in the city, Town or village which is served by such incorporated fire company or fire department or incorporated voluntary ambulance service; (2) The property is the primary residence of the applicant; (3) The property is used exclusively for residential purposes; provided, however, that in the event any portion of such property is not used exclusively for the applicant's residence but is used for other purposes, such portion shall be subject to taxation and the remaining portion only shall be entitled to the exemption provided by this section; (4) The applicant has been certified by the authority having jurisdiction for the incorporated volunteer fire company or fire department for at least five years or the applicant has been certified by the authority having jurisdiction for the incorporated voluntary ambulance service as an enrolled member of such incorporated voluntary ambulance service for at least five years. It shall be the duty and responsibility of the municipality to determine the procedure for certification. C. Any enrolled member of an incorporated volunteer fire company, fire department or incorporated voluntary ambulance service who accrues more than 20 years of active service and is so certified by the authority having jurisdiction for the incorporated voluntary fire company or fire department or incorporated voluntary ambulance service, shall be granted the ten-percent-exemption as authorized by this section for the remainder of his or her life, as long as his or her primary residence is located with the Town of Southold. D. Application for such exemption shall be filed with the Assessor or other agency,department or office designated by the municipality offering such exemption on or before the taxable status date on a form as prescribed by the State Board. E. Incorporated volunteer fire companies, fire departments and incorporated volunteer ambulance services shall file lists of their enrolled members eligible for the exemption provided by this section with the Assessor or other agency, department or office designated by the municipality offering such exemption on or before the taxable status date on a form as prescribed by the State Board. F. No applicant who is a volunteer fire fighter or volunteer ambulance worker who, by reason of such status, is receiving any benefit under the provisions of this article on the effective date of the section :1 Downloaded from https://ecode360.com/SO0452 on 2023-08-04 Town of Southold,NY § 245-11 § 245-14 shall suffer any diminution of such benefit because of the provisions of this section. § 245-12. Effective date. This article shall take effect immediately upon filing in the Office of the Secretary of State and shall apply to assessment rolls prepared on the basis of taxable status dates occurring on or after January 1, 2005. § 245-13. Unremarried spouses of deceased volunteer fire fighters or ambulance workers. [Added 6-20-2006 by L.L. No. 9-2006; amended 3-13-2007 by L.L. No. 7-2007; 10-11-2011 by L.L. No. 12-2011] Any exemption granted under§ 245-11 to an enrolled member of an incorporated volunteer fire company, fire department, or incorporated volunteer ambulance service shall be extended to such deceased enrolled member's unremarried spouse; provided,however, that: A. For members of an incorporated volunteer fire company, fire department, or incorporated volunteer ambulance service killed in the line of duty: (1) Such unremarried spouse is certified by the authority having jurisdiction for the incorporated volunteer fire company, fire department or incorporated volunteer ambulance service as an unremarried spouse of a deceased enrolled member of such incorporated volunteer fire company, fire department or incorporated voluntary ambulance service who was killed in the line of duty; and (2) Such deceased volunteer died in the line of duty and had been an enrolled member for at least five years; and (3) Such deceased volunteer had been receiving the exemption prior to his or her death. B. For deceased members of an incorporated volunteer fire company, fire department, or incorporated volunteer ambulance service: (1) Such unremarried spouse is certified by the authority having jurisdiction for the incorporated volunteer fire company, fire department or incorporated volunteer ambulance service; and (2) Such deceased member had been enrolled for at least 20 years; and (3) Such deceased member and unremarried spouse had been receiving the exemption prior to his or her death; and (4) The governing body of a school district adopts a resolution after a public hearing providing for the exemption regarding school district purposes. § 245-14. Applicability. [Added 6-20-2006 by L.L.No. 9-20061 Section 245-13 shall apply to assessment rolls prepared on the basis of taxable status dates occurring on or after January 1, 2006. .2 Downloaded from https://ecode360.com/SO0452 on 2023-08-04 New York State recently amended RPTL 467 in reference to how the Senior Citizen income is calculated to qualify an applicant. There are a few options. There is also language that needs to be updated in our local law. We currently have 426 Senior Citizen Exemptions that will need to be renewed. We also have 60 Senior Citizen Affidavit applications. The options as the law stands now: 1. Full Social Security benefits (not just taxable) 2. Earnings-Cap Gains-Interest from Individual Retirement and Individual Retirement Annuities 3. Deduction for non-reimbursed medical expenses The options are as follows for the newly amended law: 1. Use only the taxable Social Security 2. Add in the Individual Retirement and Individual Retirement Annuity distributions.. 3. Same as above If you choose to opt into any of the above 3 options you would need to have a public hearing to adopt/amend the local law. Town of Southold,NY § 245-1 ARTICLE I § 245-2 Senior Citizen Exemption [Adopted 4-20-19711 § 245-1. Partial exemption for senior citizens. [Amended 3-12-1985 by L.L.No.3-1985; 2-2-1993 by L.L. No. 2-1993; 12-27-1994 by L.L. No. 31-1994; 5-28-1996 by L.L. No. 9-1996; 2-4-1997 by L.L. No. 3-1997; 2-29-1998 by L.L.No. 1-19981 A. Amount of exemption. (1) Real property owned by one or more persons, each of whom is 65 years of age or over, or real property owned by husband and wife, one of whom is 65 years of age or over, shall be exempt from Town taxes to the extent provided, subject to the following income limitations: [Amended 9-29-1998 by L.L. B. The real property tax exemption on real property owned by husband and wife, one of whom is 65 years of age or over, once granted, shall not be rescinded solely because of the death of the older spouse, so long as the surviving spouse is at least 62 years of age. C. The above income shall be calculated as described in Real Property Tax Law§ 467 and shall include social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year, net rental income, salary or earnings, and net income from self-employment, but shall not include a return of capital, gifts, inheritances, payments made to individuals because of their status as victims of Nazi persecution as defined in P.L. 103-286 or moneys earned through employment in the federal foster grandparent program, and any such income shall be offset by all medical and prescription drug expenses actually paid which were not reimbursed or paid by insurance. ;1 Downloaded from https:Hecode360.com/SO0452 on 2023-08-04 Town of Southold,NY 245-2 § 245-3 245-2. Conditions. [Amended 3-12-1985 by L.L.No. 3-19851 No exemption shall be granted: A. If the income of the owner or the combined income of the owners of the property for the income tax year immediately preceding the date of making application for exemption exceeds the sum of $58,400 as provided by local law pursuant to this section. Where the taxable status date is on or before April 14, "income tax year" shall mean the twelve-month period for which the owner or owners filed a federal personal income tax return for the year before the income tax year immediately preceding the date of application. Where the taxable status date is on or after April 15, "income tax year" shall mean the twelve-month period for which the owner or owners filed a federal personal income tax return for the income year immediately preceding the date of the application. Where title is vested in either the husband or the wife, their combined income may not exceed such sum. Such income shall include social security and retirement benefits; interest; dividends; total gain from the sale or exchange of a capital asset, which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year; net rental income; salary or earnings; and the net income from self-employment, but shall not include a return of capital, gifts or inheritances. The provisions of this subsection notwithstanding, such income shall not include veterans' disability compensation, as defined in Title 38 of the United States Code. In computing net rental income and net income from self-employment, no depreciation deduction shall be allowed for the exhaustion, wear and tear of real or personal property held for the production of income. Unless the title of the property shall have been vested in the owner or one of the owners of the property for at least 24 consecutive months prior to the date of making application for exemption; provided, however, that in the event of the death of either a husband or wife in whose name title of the property shall have been vested at the time of death, and then becomes vested solely in the survivor by virtue of devise by or descent from the deceased husband or wife, the time of ownership of the property by the deceased husband or wife shall be deemed also a time of ownership by the survivor, and such ownership shall be deemed continuous for the purposes of computing such period of 24 consecutive months, and provided further that in the event of a transfer by either a husband or wife to the other spouse of all or part of the title to the property,the time of ownership of the property by the transfer or spouse shall be deemed also a time of ownership by the transferee spouse, and such ownership shall be deemed continuous for the purposes of computing such period of 24 consecutive months, and provided further that where property of the owner or owners has been acquired to replace property formerly owned by such owner or owners and taken by eminent domain or other involuntary proceedings, except a tax sale, the period of ownership of the former property shall be combined with the period of ownership of the property for which application is made for exemption and such periods of ownership shall be deemed to be consecutive for purposes of this article. Where a residence is sold and replaced with another within the state, the period of ownership of both properties shall be deemed consecutive for the purposes of this article. C. Unless the property is used exclusively for residential purposes. D. Unless the real property is the legal residence of and is occupied in whole or in part by the owner or by all of the owners of the property. § 245-3. Applications. [Amended 4-12-2011 by L.L. No.3-20111 :2 Downloaded from littps://ecode360.com/SO0452 on 2023-05-04 Town of Southold,NY 245-6 A245Applications for such exemption must be made by the owner or all of the owners of the property, on forms prescribed by the State Board,to be furnished by the appropriate assessing authority, and shall furnish the information and be executed in the manner required or prescribed in such forms and shall be filed in such Assessor's office on or before the appropriate taxable status date. B. Any person who has been granted an exemption pursuant to this article on five consecutive completed assessment rolls shall not be subject to the requirements set forth in Subsection A of this section; however, said persons shall be mailed an application form by the Assessor and a notice informing him of his rights. Such exemption shall be automatically granted on each subsequent assessment roll;provided,however,that when tax payment is made by such person, a sworn affidavit must be included with the tax payment, which shall state that such person continues to be eligible for said exemption. Such affidavit shall be on a form prescribed by the State Board as provided by the Assessor. If such affidavit is not included with the tax payment, the Receiver of Taxes shall proceed pursuant to § 551-a of the Real Property Tax Law. § 245-4. Reapplications. [Amended 3-12-1985 by L.L. No. 3-19851 A. At least 60 days prior to the appropriate taxable status date,the assessing authority shall mail to each person who was granted exemption pursuant to this article on the latest completed assessment roll an application form and a notice that such application must be filed on or before taxable status date and be approved in order for the exemption to be granted. The assessing authority shall,within three days of the completion and filing of the tentative assessment roll, notify by mail any applicant who has included with his application at least one self-addressed, prepaid envelope of the approval or denial of the application; provided, however, that the assessing authority shall, upon the receipt and filing of the application, send by mail notification of receipt to any applicant who has included two of such envelopes with the application. Where an applicant is entitled to a notice of denial pursuant to this subsection, such notice shall be on form prescribed by the State Board and shall state the reasons for such denial and shall further state that the applicant may have such determination reviewed in the manner provided by law. Failure to mail such application form and notice or the failure of such person to receive the same shall not prevent the levy, collection and enforcement of the payment of the taxes on property owned by such person. B. Notwithstanding any other provisions of this article, in the event that the owner, or all of the owners, of property which has received an exemption pursuant to this article of the preceding assessment roll shall fail to file an application for such exemption on or before the taxable status date, such owner or owners may file, and the assessing authority shall accept the application, executed as if such application has been filed on or before the taxable status date, if such application is filed with the assessing authority on or before the date for the hearing of complaints. § 245-5. Penalties for offenses. [Amended 1-16-2007 by L.L. No. 3-20071 Any person that knowingly makes a false statement in an application under this chapter, or who knowingly allows a person to make a false statement in an application under this chapter, and which application is filed with the appropriate assessing authority, shall be guilty of a violation punishable by a fine of not to exceed $1,000 or a period of incarceration not to exceed 15 days, or both such fine and imprisonment. Upon conviction under this chapter, the person shall be disqualified from applying for an exemption under this chapter for a period of five years from the date of conviction. § 245-6. Notice. [Added 3-12-1985 by L.L. OF 20239 TO ESTABLISH A NEW CHAPTER OF THE CODE OF THE TOWN OF SOUTHOLD ("SOUTHOLD CODE") TO BE ENTITLED "FOOD TRUCKS." Be it enacted by the Town Board of the Town of Southold, as follows: Section 1. Recitals and Legislative Intent Notwithstanding the provisions contained in Chapter 197, entitled Peddlers, Solicitors, and Transient Retail Merchants, of the Code of the Town of Southold ("Southold"), regulating soliciting, vending, hawking and peddling within Southold, it is hereby found and determined that permits for mobile food vendors, i.e., "food trucks," should be allowed to provide the residents and visitors to Southold additional options for dining and the purchase of edible commodities, irrespective of the regulations of Chapter 197. It is further found and determined that, in an effort to protect the health, safety and welfare of the residents and the consuming public, with the food truck permits being granted on a periodic basis, the operation of which should be further regulated to ensure adequate location, accommodation and safe operation. Section 2. Adoption of new Chapter XXX entitled "Food Trucks." A new Chapter XXX is hereby inserted into the Code of the Town of Southold ("Southold Code") to read as follows: Chapter XXX. Food Trucks. XXX-1. Purpose. The purpose of this Chapter is to regulate food trucks within the Town of Southold ("Southold") in a manner that protects the public health, safety and welfare, and this Chapter describes the permitting procedures for food trucks, and is intended to operate in conjunction with the regulations of Chapter 280, entitled "Zoning," of the Code of the Town of Southold ("Southold Code"); however, if there should be a conflict or inconsistency between the provisions of this Chapter and Chapter 280, the provisions of this Chapter shall control and govern. XXX-2. Definitions. The following terms shall, for the purposes of this Chapter, have the meanings described in this Section: FOOD TRUCK A self-contained mobile food and/or beverage service operation located in an easily movable motor vehicle, cart, stand or trailer ("vehicle"), within, and from which, ready-to-eat food and/or beverages for human consumption are prepared, cooked, wrapped, packaged, processed or portioned, and sold, purveyed, dispensed or distributed, in individual portions to the general public, for consumption on or off of the premises at which the vehicle is located, which vehicle may be self- propelled, or towed or pushed by another vehicle or person. FOOD TRUCK OPERATOR Any one of the following is a food truck operator, which may be a natural person, a business entity, a company, an association and/or an organization ("person or entity"): (i) the owner(s) of the food truck; (ii) the owner(s) of the business, or food/beverage service establishment, operating out of the food truck; and/or (iii) any person or entity exercising dominion and control over the food truck. A food truck operator may also be referred to in this Chapter as, and includes, a person or entity that operates a food truck. XXX-3. Permit required. A. It shall be unlawful for any person or entity to operate a food truck within Southold without having obtained a Food Truck Permit for such purpose in accordance with the provisions of this Chapter. B. Any person or entity desiring to operate a food truck shall submit a written application for a Food Truck Permit, at least 10 business days prior to event, which shall be signed and notarized with an attestation of truth and accuracy, to the Southold Office of THE TOWN BOARD; which application shall be made on. fonns provided by THE TOWNBOARD, and shall include the information and documentation required by this Chapter, and any additional information or documentation that the TOWN BOARD and/or an Southold Fire Inspector may reasonably require in her/his discretion within the purpose, intent and spirit of this Chapter, in addition to the following items: al Full legal name, preferred contact phone number and email address, home street address, and the business's street address and mailing address (if different), of the food truck operator(s), as defined in this Chapter. A description and photograph of the food truck, including, if the food truck is a motor vehicle, the license plate and registration number, VIN number, and the year, make and model, of the motor vehicle, and its dimensions (length and width). al A valid copy of the County of Suffolk ("County") Health Department mobile food service establishment and/or food cart permit, if such a permit is required by the County ("County permit"). The street address of the private property at which the food truck will be located; and the private property owner's full legal name, whether a person or entity, preferred contact phone number and email address, and street address and mailing address (if different); and, if the private property owner is an entity rather than a natural person, then the full legal name, preferred contact phone number and email address, and street address and mailing address (if different), of the principal of the entity is also required. A signed and notarized owner consent form from the private property owner authorizing, consenting and allowing the location of the food truck on the property. A sketch site plan, which shall include details sufficient to demonstrate compliance with this Chapter. Ej The application fee in accordance with the fee schedule established by the Town Board of the Town of Southold ("Town Board"). C THE T W1" BOARD shall approve and issue a food truck permit if: The applicant demonstrates compliance with the requirements of this Chapter; the required food truck permit fee has been paid; no municipal or governmental code violations, or notices of violation, are pending on the property at which the food truck will be located; the property at which the food truck will be located lies entirely within a Zoning District that allows commercial or non-residential uses as per Southold Code Chapter 280 (Zoning); (5) the food truck is in full compliance with all applicable codes, rules and regulations of the Uniform Fire Prevention and Building Code of New York State, and the National Fire Protection Association (NFPA); and ( ) a valid County permit submitted with the application. D. Food truck permits shall only be issued for the following lengths of operation, provided that, in no event, shall a permit be issued to expire later than the County permit (if a permit is required by the County): Seasonal permit: six months. Daily permit: four consecutive days. F. A permit is effective upon approval by Tl TO . BOARD and a Southold. Fire Inspector. F. A food truck permit is not transferable. G. In addition to the provisions of ?XXX-10 below, THE�. TOWNBOARD shall administer and enforce this Chapter, as contemplated in Southold Code Chapter 280-151 (Administrative and enforcing officer), including, but not limited to, the authority to issue summonses and/or appearance tickets in the Southold Justice Court for any violations of this Chapter. XXX-4. Siting. A. A food truck permitted under this Chapter shall only be located on private property; and nothing in this Chapter shall be deemed to authorize the sale or distribution of food from a food truck on public property or in the public right-of- way. B. A food truck shall only be permitted on private property that lies entirely within a Zoning District that allows commercial or nor-residential uses as per Southold. Code Chapter 280 (Zoning C. A food truck shall only be sited on the property at the location designated on the food truck permit. D. A food truck shall meet the minimum side, rear and front yard setbacks, and maximum building height, regulations applicable to an accessory structure for the Zoning District in which the property is located upon which the food truck is sited. E. A food truck shall be located a minimum of. (1). five feet away from the edge of any driveway or walkway; (2). five feet away from a utility box or appurtenances; (3). fifteen feet away from an ADA handicap/wheelchair ramp; (4). twenty-five feet away from a building entrance, exit or emergency access/exit way; (5). ten feet away from an emergency call box; (6). twenty-five feet away from the main entrance to any restaurant; (7). twenty-five feet away from any outdoor dining area associated with any restaurant; (8). fifty feet away from any other food truck on another property, as measured from the designated location on the other property accommodating the other food truck; (9). one hundred feet away from any watercourse, stream, creek, river or body of water; (10). ten feet from another food truck on same property; and (11). twenty-five feet away from a fire hydrant. F. A food truck shall be sited in a location that does not: (1). obstruct, hinder or interfere with the free flow of pedestrian, bicycle or motor vehicular traffic; (2). restrict visibility at any driveway or intersection; (3). unreasonably interfere with the activities of other businesses, or otherwise interfere with other lawful activities, or violate any statutes, ordinances, or other laws; and (4). does not restrict fire apparatus access roads. XXX-5. Number and size of food trucks. A. Food trucks shall only be located on a single tax lot of at least 5,000 square feet in size. B. A maximum of three food trucks shall be permitted per single tax lot at any one time, with separate permits required for each food truck C. The maximum number of food truck permits that may be issued per single tax lot, per year, shall be one seasonal permit and three daily permits D. The maximum size of a food truck shall be 256 square feet, measured from the exterior faces of the food truck. E. A minimum of four off-street parking spaces, designated to exclusively serve the food truck while the food truck is operating, shall always be available (while the food truck is operating) on the same tax lot as the food truck, which parking spaces shall not otherwise be reserved, encumbered, or assigned to satisfy the off-street parking requirements of another business or activity that is operating on the lot at the same time as the food truck. XXX-6. Operations. A. Food truck operators shall maintain a valid County permit (if required by the County); and shall also operate the food truck in conformance with any and all applicable governmental health regulations, standards, laws and statutes and all applicable codes, rules and regulations of the Uniform Fire Prevention and Building Code of New York State. B. The following shall be conspicuously posted in public view on the food truck at all times: the County permit (if required by the County); the Southold food truck permit; and a notice, printed with at least two-inch height lettering, that states: "TO REPORT A VIOLATION, CALL A SOUTHOLD CODE ENFORCEMENT' MENT' OFFICER AT PHONE # (631) 765-1939." C. Food trucks shall have adequate ingress and egress from its sited location so as to prevent traffic congestion and safety hazards. Existing and/or proposed curb cuts, intended to serve the food truck, shall meet the minimum sight distance requirements of the Southold Highway Department. D. All food trucks shall be allowed a single freestanding sign not greater than ten square feet in size as measured on one side of a two-sided sign or placard, in addition to the following: (11. there shall be no limit on the size, or number of signs, painted or permanently affixed on the truck; and Q signs that are painted or permanently affixed to food trucks shall not be mounted perpendicular to the food truck, and shall not protrude beyond the exterior body of the food truck. O E. The operation of food trucks shall be limited to the hours between 6:00 AM and 9:00 PM; and, subject to §XXX-6(N), shall not operate a power generator: (1) in any Zoning District, other than a residential Zoning District, prior to 7:00 AM or after 8:00 PM; (2) in any residential Zoning District prior to 7:00 AM or after 8:00 PM, Monday through Friday; prior to 8:00 AM or after 7:00 PM on Saturday; and prior to 9:00 AM or after 5:00 PM on a Sunday or legal holiday. F. The food truck operator, or his/her authorized designee, must be present at all times during the operation of the food truck, except in cases of emergency. G. Food truck operators shall provide trash and recycling receptacles within ten feet of their food truck, and are responsible for the proper and lawful disposal of waste and trash associated with the operation of the food truck, and shall properly and lawfully remove and dispose of all waste and trash associated with their operation at the end of each day, or more frequently as necessary to maintain the health and safety of the public. The food truck operator shall keep all areas, and any associated seating areas, clean of grease, trash, napkins, paper, cups, plates, utensils, packaging, bottles and cans associated with the operation. All liquid waste, oil and grease shall be properly and lawfully disposed of, and shall not be spilled or discharged in, near or on streams, wetlands, storm drains, lawns, sidewalks, streets or other public spaces, or in sanitary sewers or septic tanks that are not equipped with a grease trap. H. Outdoor seating shall be permitted, so long as it is sited consistent with the provisions of XXX-4 herein; and shall not exceed 16 total seats. I. With the exception of allowable outdoor seating areas and trash receptacles, all equipment required for the operation of a food truck shall be contained within, attached to, or located within five feet of the food truck. J. No food shall be prepared, sold or displayed at the food truck site outside of the food truck. K. Lighting is prohibited, except for lighting that is used within the inside of the food truck for the sole purpose of the preparation, cooking, wrapping, packaging, processing, apportioning, dispensing, or transacting the sales, of the food or beverages, which lighting shall be completely shut off when the food truck is not in operation. L. Tents and canopies are prohibited. Awnings shall only be permitted if they are attached to the food truck; and umbrellas shall only be permitted if they are attached to a picnic table. M. Amplified sound, loudspeakers and public address (PA) systems, including, but not limited to, the playing, airing, broadcasting or performing of live, pre-recorded, or internet or satellite streaming, music is prohibited; and the food truck operation shall comply with the noise regulations of Chapter 180 of the Southold Code. N. Power generators are prohibited; unless the power generator (i) does not exceed C 80 decibles at the point ofalleged disturbance, (ii) does not exceed [2 (two) j hours of consecutive operation in a 4 hour period, and (iii) complies with all other applicable Southold Code provisions, including, but not necessarily limited to, Chapter 180 (Noise). O. Food trucks and associated outdoor seating, if any, shall be completely removed from all permitted locations upon expiration of the food truck permit. XXX-7. Exceptions. A. A Southold resident may apply for a special event private use food truck permit requesting that a food truck cater a special event on the resident's own private property at their place of residence, which may be within any Zoning District. A resident's request for a special event private use food truck permit shall be made to THE TOWN BOARD for a period not exceeding one day, which permit shall be subject to the requirements of this Chapter, except for §XXX-4(A) and (B); and food truck sales or dispending shall be limited to the private event attendees only (not to the general public), and no greater than two such permits per year shall be issued per household. B. The Town Board may, by Resolution and in its legislative discretion, authorize, empower and allow THE TOWN BOARD to issue a food truck permit to be located on Southold owned property, which food truck permit shall not be subject to the requirements of this Chapter, except those requirements that the Town Board, in its said Resolution, may wish to impose as conditions of THE TOWN BOARD's issuance of the food truck permit. C. The Town Board may, by Resolution and in its legislative discretion, authorize, empower and allow THE TOWNBOARD to issue a food truck permit, for a maximum period of four consecutive days, to a not-for-profit entity or organization, a religious or educational institution, or a municipal or governmental entity (including a Library or Fire District), to be located in any Zoning District and on any site approved by the Town Board, for the purpose of events, fairs, festivals or parades that are open to the general public; which food truck permit shall not be subject to the requirements of this Chapter, except those requirements that the Town Board, in its said Resolution, may wish to impose as conditions of THE TOWN BOA 's issuance of the food truck permit XXX-8. Violations. Any of the following shall constitute a violation of this Chapter: 1. Failure to properly obtain a valid food truck permit, which shall be a violation of the food truck operator. 2. Failure to properly display a valid food truck permit, which shall be a violation of the food truck operator and the owner of the property at which the food truck is located. 3. Fraud or misrepresentation contained in the food truck permit application, which shall be a violation of the food truck operator. 4. Fraud or misrepresentation made in the course of operating the food truck, which shall be a violation of the food truck operator and the owner of the property at which the food truck is located. 5. Conduct that is, or creates, a public nuisance, hazard, peril, menace or danger, or otherwise constitutes a threat to the public health, safety or welfare, which shall be a violation of the food truck operator and the owner of the property at which the food truck is located. 6. Failure to comply with any of the regulations of§XXX-4, §XXX-5 or §XXX- 6, which shall be a violation of the food truck operator and the owner of the property at which the food truck is located. XXX-9. Suspension or revocation of a food truck permit. THE TOWN BOARD may issue, to the food truck operator, for any violation, a notice of intent to suspend or revoke a food truck permit ("notice"), which notice shall describe the violation and require that the permit holder immediately correct the violation or cause the violation to be corrected; which notice shall be sent to the permit holder (1) by personal delivery, courier (e.g., FedEx, UPS), or USPS First Class Mail, to the address submitted with the food truck permit application, or by (2) posting at the place of business of the food truck. 1. If the holder of the food truck permit fails to immediately correct the violation or cause the violation to be corrected, then THE TOWN N BOARI may suspend or revoke the permit. 2. A food truck permit holder shall be entitled to request a hearing to appeal THE TOWN BOARD'ssuspension or revocation of a food truck permit, which hearing shall be held before the Town Board, upon application made by the permit holder to the Town Clerk demonstrating that the permit holder was not in violation of the pen-nit. THE TOW BDA 's suspension or revocation of fond truck. permit remains enforceable and in effect, unless reversed or modified by the Town Board as a result of said hearing, which hearing shall be held within 45 days of said application by the permit holder, or as soon thereafter as the Town Board is able to schedule the hearing. XXX-10. Enforcement and administration. 1. The provisions of this Chapter shall be administered by THE. TOWN BD D, and shall be enforced by THE TOWN BOARD and/or any other Southold agency that has jurisdiction over an aspect of the food truck operation, including, but not necessarily limited to, the (1) Police Department, (2) Highway Department, (3) Department of Parks, Recreation and Buildings, (4) Department of Environmental Management and Engineering, and (5) Bureau of Fire Prevention. 2. Pursuant to §10(4)(a) of NYS Municipal Home Rule Law and §15 0.10 of NYS Criminal Procedure Law, Police Officers and THETOWN BOARD are authorized and empowered to issue and serve summonses and/or appearance tickets returnable in the Southold Justice Court, and to prosecute the violation in said Court, when he or she has reasonable cause to believe that a person or entity has violated this Chapter. XXX-11. Penalties for offenses. 1. A violation of this Chapter shall be deemed a violation, and not a crime or offense. Any person or entity who shall violate any provision of this Chapter shall, upon conviction, be subject to the penalties set forth in Chapter XXX. of the Southold Code; except for imprisonment, incarceration or jail, which shall not be a penalty. Each day's continued violation shall constitute a separate violation. 2. Conviction of a violation of this Chapter shall constitute and effect an immediate forfeiture of any food truck permit issued to the person or entity so convicted. 3. Without limiting any other remedy, the Town Board may also maintain a civil action or proceeding, in the name of the Town of Southold, in a court of competent jurisdiction, to compel compliance with, or to restrain by injunction the violation of, this Chapter. Section 3. Authority This proposed Local Law is enacted and adopted pursuant to NYS Municipal Home Rule Law §10, and in accordance with the procedures prescribed in NYS Municipal Home Rule §20. Section 4. Severability If any section, subdivision, paragraph, clause or phrase of this Local Law shall be adjudged invalid, or held to be unconstitutional, by any court of competent jurisdiction, any judgment or order made thereby shall not affect the validity of this Local Law as a whole, or any part thereof, other than the part or provision so adjudged to be invalid or unconstitutional. Section 5. Effective Date This Local Law shall take effect upon publishing and posting a copy in the manner prescribed by applicable laws, and upon filing a copy with the NYS Secretary of State. The proposed action involves the request for the transfer of 1.61 sanitary flow credits for the purpose of authorizing an as-built professional office, fitness studio and three accessory apartments in the Hamlet Business Zoning District. Chapter 117. Sanitary Flow Credits, Transfer of§ 117-3. Definitions. Permits such a transfer for an eligible project. An ELIGIBLE PROJECT is defined as: "Projects located in a receiving district that are permitted uses in the zoning district where the subject property is located. " A receiving district is defined as: "RECEIVING DISTRICT-An area of the Town that is desirable to be developed more intensively than areas outside the district. " The proposed action meets the definitions. The parcel is located within the Hamlet Business (HB) Zoning District, and the uses are permitted. It is also located within the Southold Hamlet Center, an area with supporting amenities, public transportation, and infrastructure to support more intense builds of commercial and residential uses. 1 � I � r, m 1. Built Environment and Existing Conditions The site is improved with a structure that was built in 1787 (SPLIA). In 1986 the building was renovated. Land uses surrounding the parcel include a mixture of residential and commercial. The parcel is located in the Southold Hamlet Center, and the mix use residential and commercial uses is appropriate in this location. The location of the parcel provides adequate access to amenities. The parcel is located within the Southold Union Free School District. Available public schools to residents of units would include Southold Elementary School and Southold High School. There are no soil or topographical limitations on site. The parcel is not located within a FEMA-mapped flood zone. 2. Transportation and Infrastructure Parcel Access The parcel is south of State Route 25 (an arterial road). Parking is on-street and in the rear of the building, accessed by a driveway on the east side. Town code requires 2 parking areas per apartment, and the area in the rear of the building appears large enough to accommodate the 6 vehicles required for the 3 apartments. Infrastructure Public sidewalks are located in front of the structure and are adequate for the apartment tenants and the businesses' customers. Distance to Public Transportation Train and bus transportation is available to tenants and customers within .25 miles of the site. Pedestrian and Bicyclist Modes A sharrow (travel lane bike path) is in front of the structure in State Route 25. 3. Access to Public Water and Sewers Public water is available to the parcel via an SCWA. The parcel is located within SCDHS Groundwater Management Zone IV, A public sewer connection is unavailable. Potential Environmental Impacts No moderate to large adverse impacts on transportation, water supply, quality, community character, and community services are expected as a result of the action. Site & Project Description The above property is a mixed-use building with the Following existing uses: 1. Century 21 Real Estate Office 2, Bodysmart personal fitness studio (Gym) 3. 3 residential apartments on the south side of the building. Reason for Sanitary Credits: The commercial tenants on the first floor cause the existing sanitary flow to exceed the grandfathered flow. The original house was constructed 1787 and according to the Town SPLIA records "the original building was described as a 2 1/2 story single family dwelling, 3-bay, gable roof, white shingles with dentils on cornice, located in the center of the Southold hamlet". The building was later owned by the owners of the Frohnhoefer Electric Company. In 1986 the final renovation to the building was made by Frohnhoefer Electric for their large lamp lighting fixture showroom. Frohnhoefer Electric Company closed and new tenants took over the space. In the 1970's, on the South side of the building, three apartments were constructed. We believe that the existing single family dwelling (from 1787) was converted to apartments. The apartments remain and are occupied. The tenants work and live in the Town of Southold. There are no records in the Town Building Department for this conversion of the space to apartments. Existing Commercial Tenants: In 1993 Century 21-Real Estate office began occupying the east side of the first floor of the building. They continue to occupy this space. The west side of the building has had different tenants, currently the west side of the building is occupied by the fitness studio (Bodysmart). When the Town Board adopted the "Rental Law" the owner applied for a rental permit for the existing apartments. These rental permits are pending. Because the building department does not have building records of the apartments, the building department requires that the owner submit construction drawings of the existing apartments. To get the building permitsSuffolk Coun Health Department is required. The owners have an application to the Health Department for an upgraded sanitary system for the building, however, the Health Department has required the owner to obtain "sanitary credits" as a condition of the Health Department approval. The apartments are grandfathered regarding the gallons per day sanitary flow requirements; however, the existing commercial tenants trigger the need for transfer of sanitary credits.
