This application must be filled in by typewriter OR ~nk and submitted to the building
inspector with the following: for new building or new use:
i. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used io system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code C,~pliance from archiuect or engineer
responsible for the building.
6. Submi~ Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, i957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consen~ to inspect signed by the applicant.
If a Certificate o~ Occupancy is denied, the Uuilding Inspector shall state the
reasons therefor in writing to the applicant.

Dear Mr. Lessard:
Further to my letter of February 8, 1991 (copy enclosed for easy
reference), I just wish to remind you that the grading problem and the damaged
fence problems on the above property are still with us.
You will recall that during our discussions relative to the decision by
you and the town attorney to permit the Grassi house to be placed five feet off
my property line, I brought to your attention the possibility that during
rainstorms, my property would be inundated with water from their gutters and
leaders. You assured me that you would require the Grassi's to install dry wells
to absorb all the water from the gutters and leaders. I would remind you that
the Grassi's have built a huge house with a lot of roof space, which means a lot
of water coming down gutters and leaders. The house is nearing completion, and
I have yet to see any progress in installing dry wells, or correction of the grading,
or repair of the fence. ]2 would be appreciated if you will confirm to me that the
above matters are beLng addressed. In addition, I would appreciate your
confirming that these issues must be resolved before the temporary or permanent
certificate of occupancy is issued.
You may consider this letter notice that I will hold the Town of
Southold responsible, if these issues are not satisfactorily resolved.

Dear Mr. Lessard:
Enclosed for your information is a copy of my letter to
Mr. Thomas Chieffo, along with a copy of the recorded agreement.
I thought you would want a copy of the recorded agreement for your
file.
relative to the grading of the Grassi property and the damage done
to my fence by the contractor. The present grading, which does not
include topsoil and driveway, is substantially higher than the grade
of my property (4450 Peconic Bay Blvd.) I am, therefore, requesting
that before issuing a Certificate of Occupancy, that you require the
fence to be repaired and the grading problem corrected. In
addition, I would suggest that you obtain a copy of the agreement
recorded by the Grassi's, so that you can be assured both parties
have fulfilled the terms of the agreement.

Dear Mr. Lessard:
I am the attorney to Raymond and Norma Goodwin who are
the owners of property on Peconic Bay Boulevard which is to the
west of the parcel owned by Armando Grassi upon which the builder,
Tom Chieffo, is currently constructing a one-family dwelling.
It is my understanding that Mr. Goodwin spoke with you
on June 25th, 1990 at which time it was noted that the approved
plans required a 10 and 15 foot maintenance of side yard. I assume
when the surveys are received concerning the foundation location,
the specifics as to how close the foundation is to boundary line
of my clients will be determined.
The location of the foundation and the house is of ex-
treme importance to my clients and we would appreciate if we could
be kept informed as the building department makes its decisions
therein.
It is unfortunate that the property owner has not kept
my clients informed as things proceeded.
Your cooperation in this matter is greatly appreciated
and upon receipt of the foundation survey, I would appreciate your
contacting the undersigned before any additional construction is
authorized by the building department.

Dear Tom:
You will recall that the Grassi's stated that our
agreement titled, "Declaration of Covenants and Restrictions,.. would
run with the land, and both of us should file the agreement with
Suffolk County. I had a little difficulty filing the agreement,
because it did not include the description of the property as
outlined in the deed. I, therefore, had to attach a copy of the
description as outlined in the deed to the agreement. In addition,
I had to reduce the size of Exhibits A & B. After making these
adjustments, the Suffolk County Clerk accepted the agreement for
recording.
Enclosed you will find a Copy of the recorded agreement,
on which the Suffolk County Clerk has stamped the number and
