The sub-division has its own water plant. Before the Health Department will give final approval, the three fire wells will have to meet the output required from the Planning Board as recommended by the Mattituck Fire Department. At present, this has not been met, but should be shortly. The fact that the applicant has not used the Building Permit is not of the Town's choosing. Approximately half the allowed time has expired for the "do nothing" (12 month time period), and I see no justifiable reason why the Town should return the permit fee. I was in the process of purchasing this vacantlY[ property (conditioned on a satisfactory building pe~it and bank financing) when I began making application for the permit. On a number of occasions I was told by the Southold Building Department and the To~n Planning Board that the town was not issuelng building permits because no CO was to be issued for any building until the satisfactory completion of the subdivision. ~en the building department finally accepted my application for the permit, I assumed that the subdivision ~as satisfactorily completed. As I h~ve found out later~ I was issued the permit~ but the status of the s%~division remained unchan5ed. Since I did not have a valid building pe~ait for the bank~the commitment fo~ financing expired. I could not purchase the property and I was lsft with a useless building permit. As of this letter I do not think any CO have been issued o~ the subdivision brought to completion. I feel that the Southold Building Department issued the buildinE permit prematurely thus jeopardizin~ the fees I paid.
