APPLICATION FOR CERTIFICATE OF OCCUPANCY
A. This application must be filled in by typewziter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accuxate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Soard of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 17 lead.
5. Commercial building, industrial building, multiple, residences and similar buildings
and installations, a certificate of Code Coml,liance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
3. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons Cherefor in writing to the applicant.

INSTRUCTIONS FOR FORM EA 305-R (Rev.1 tool j
Use of this form. Form EA-305R may be used to renew an application for an agricultural assessment for a parcel ~
for the current year s assessment roll rf the last long form applrcation (form EA 305) or renewal (form EA-305R)
filed for the parcel was appro ed and the conditions which determine the parcel's eligibility have not changed. The
questions in item I are design~d to determine whether the pazcel's status has changed. Please consider items 1(c), 2
and 3(d) carefully to determine whether the assessor's copy of form EA 306 (commitment) or a current lease or
affidavit (form EA 305-C) must be included with this application renewal form.
Place of filing. The application renewal form must be filed with the city, town or village assessor. If the
property is located in a villagq, an application must be filed with both the town and the village assessor. In Nassau
and Tompkins Counties, applii:ations must be filed with the county assessors.
Time of filing. The application renewal form must be filed on or before the taxable status date of the city, town
or village.
Notice of approval, denial Or modification. The assessor must notify the applicant of the approval, denial or
modification of the application only if the applicant supplies the assessor wrth a prepaid, self-addressed envelope.
ELI(~IBII.ITY REQUn2EMENTS FOR AGRICULTURAL V ALUE ASSESSMENT
1.Applicants who own an(1 operate their land or who rent their land to another person must satisfy the following
requirements:
-The land must consist' of at least ten acres that have been used as a single operation to produce crops,
livestock or livestock products for sale in the preceding two years.
- The crops, livestock of livestock products produced on such land and land rented by the applicant from
another and used in coltlunction with such land for the production for sale of crops, livestock and livestock
products must have a' average gross sales value of at least $10,000 for the two years preceding the
application. For purp~ses of determining average gross sales value, whenever a crop is processed prior to
sale, average gross sales value shall be based upon the market value of such crop in its unprocessed state.
- The land must either gibe located within an established agricultural district or subject to an eight year
commitment to continued agricultural production.
- If the above r*equiremet}ts are satisfied, support land and farm woodland may also qualify for an agricultural
assessment, I
2.Applicants who rent their land to another person where the land has produced crops, livestock or livestock
products in the preceding two years with an average gross sales value of less than $10,000 may still be
eligible if the following requirements are satisfied:
- The rented land must Fonsist of at least ten acres that were used as a single operation to produce crops,
livestock or livestock ~rroducts (exclusive of woodland products) in the preceding two years.
- The rented land mustcurrently be used to produce crops, livestock or livestock products (exclusive of
woodland products) under a wntten rental arrangement of five or more years.
- The rented land must be', used in conjunction with other land which qualifies for an agricultural assessment.
- The rented land must ether be located within an established agricultural district or subject to an eight year
wmmitment to continued agricultural production.
- If the above requirements are satisfied, support land may also qualify for an agricultural assessment.*
*Farrn woodland means)land primarily used for the production for sale of woodland products (logs, lumber,
posts, firewood, etc.) wl?ere such land is used as a single operation and contiguous with cropland, orchazds,
vineyards or land used to~asture livestock. Lands divided by state, county or town roads, energy transmission
comdors and similar facilities will be considered contiguous. Farm woodland which may be eligible for an
agricultural assessment may not exceed 50 acres on any separately described and assessed parcel.
Support land may include farm fonds, swamps used for drainage, land used for erosion control, hedgerows,
access roads, land under Farm buildings, dikes and levies used for flood protection, drainage ditches and land
used for farm waste management. Support land may also include any other minor acreage that is located amid,
between or on the perimeter of cropland, orchards, vineyards and land used to pasture livestock, so long as the
land is not farm woodland or nonagricultural land. For this purpose, nonagricultural land includes land used for
any of the following purposes: a homestead; commercial gravel quarry or other mineral, oil or natural gas
exaaction; recreational uses such as camping, atltledc and pazk facilities; retail establishments of any kind
including restaurants, lodging facilities and roadside stands used for merchandising crops, livestock or livestock
products; facilities used to process crops, livestock or livestock products including sawmills, fertilizer plants;
and land used e><Qlusivel~ for hunting and game preserves. Nonagricultwal land also includes any Sand that is
not actually being used to'I produce crops, livestock or livestock products where such land is not farm woodland
or support land.

INSTRUCTIONS
a. Tltis application must be completely filled in by typewriter or jn ink and submitted to the Building Inspector, with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
