SCTM No. 1000-22-3-1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25,and the Suffolk County Department of Planning issued its reply dated June 16, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 16, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with the LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 536,957 square foot parcel located in the Residential R-80 Zoning District. The northerly property line which runs northeast measures in total (261.25 ft.+ 198.03ft.) 459.28feet and is adjacent to Long Island Sound, the easterly property line measures 1,575.77 feet, the southerly property line measures in total (184.04 ft.+ 150.06 ft.) 334.1feet and the westerly property line 1,821 feet with the driveway entrance off Stars Road then another westerly measurement of 52.36 feet. The parcel is improved with a two-story frame residence with attached-one-story frame multi-car garage.There is a large stone patio located where the proposed .pergola is to be located at the rear northeast corner of the residence. There is a fenced inground swimming pool 19.8 feet by 39.8 feet located south of the residence and garage. There are numerous concrete walls around the residence as shown on the survey map prepared by John T. Metzger, LS, and last revised May 26, 2023. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-116A(1)and the Building Inspector's April 27,2023,Notice of Disapproval based on an application for a permit to construct a pergola addition to a single-family dwelling; at 1) located less than the code required 100 feet from the top of the bluff, located at 2840 Stars Road, East Marion,NY. SCTM#1000-22-3-1. RELIEF REQUESTED: The applicant requests a variance to construct a pergola addition to an existing single-family dwelling 1. The proposed construction, is not permitted pursuant to Article XXII, Section 280-116A(1),which states Page 2,October 5,2023 97818,Berry P 2021 QPRT SCTM No. 1000-22-3-1 "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The survey shows the proposed construction of a pergola setback 80 feet from the top of the bluff. ADDITIONAL INFORMATION: The proposed pergola will be attached to the existing dwelling and place upon an existing stone patio, and therefore will not cause soil disturbance and or intrude further seaward. The location is where there is an exit from the residence to a large patio as shown on the Site Plan drawing prepared by James J. Deerkoski, PE, and dated February 6,2023. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 7,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following.facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a very large property, and the pergola will not be seen by neighbors from the road. It is not uncommon for residents to seek relief from the sun and the pergola will allow the applicant to enjoy more outside living space while avoiding harmful sun exposure. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed pergola will be located by an exit door from the dwelling where there exists a large stone patio. The pergola will not further intrude seaward toward the bluff. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 20% relief from the code. However, the pergola will attach to a dwelling that already exists. No further building will take place seaward of the dwelling. Furthermore, the pergola is an open air, unconditioned screen and not an extension of the dwellings living space. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pergola while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. r RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried, to GRANT the variance as applied for,and shown on the survey map prepared by John T.Metzger, LS,and last revised May 26, 2023 and the Engineered Plans prepared by James J. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. RELIEF REQUESTED: Applicant, who is contract vendee, is requesting a variance with respect to a proposed addition, extending 20 feet from the north side of the dwelling, leaving an 80+- ft. setback to the top of the bluff. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented and personal inspection, the Board makes the following findings: (1) The house which applicant wishes to expand, which has never been occupied, is constructed to face inward onto a courtyard. The only view of Long Island Sound is from windows in a corridor connecting two sections of the house. Short of rebuilding the house, an addition such as that proposed by the applicant appears to be the only feasible way to provide a view of the Sound from living areas. (2) The proposed 20-foot addition is a relatively modest solution to the architectural problem and leaves a setback of 80 feet from the top of the bluff. (3) Grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because the proposed addition will not change the character of�the house and because the house is well screened from neighbors.
