The identical claims were made in the underlying action which was decided by Supreme Court Justice Kevins in favor of the Town. The supporting documents in that action were the same as attached to the current application, including the letter of Dr. Stambler dated 5/26/2016. It is my recommendation that your office return the application and fees back to Mr Kelly with a denial of the permit.
