The basis for the current Trailer Permit request is medical in nature. The identical claims were made in the underlying
action which was decided by Supreme Court Justice Kevins in favor of the Town. The supporting documents in that
action were the same as attached to the current application, including the letter of Dr. Stambler dated 5/26/2016.
It is my recommendation that your office return the application and fees back to Mr Kelly with a denial of the
permit. Alternatively, please forward them to this office an I will attach a cover letter with the above explanation.

Parking our equipment for medical purposes requires town board
permission and we had several permits denied and or completely blocked
out and wasn't denied by the town board but by the town attorney's office
which is under investigation for mail fraud and contempt of court but that's
not your business but resubmitting a returned permits application for a
reasonable accommodations that was granted by Brushes Creek Marina
inc. who is an equal opportunely employer following federal laws

WH EREAS, Section 100-239.2 Of the Southold T own Code authorizes the Town
Board to issue pe;mits'for an autornobite trailer or house ter, and
'."J WHEREAS, the proliferation of these ftailem is not-encouraged, and is the policy
of the Town Board to issue such permrtts orfiy upon an adequate showing of
and hardship, subject to suchconditions relating to permit tens and

RESOLVED that the Town Board hereby determines that the following are
appropriate reasons for issuance cf a trailer permit_
1. Use of the trailer by a watchman in order to ensure the sea:rity of a

housing decreases.The applicant shall provide evidence of need, availability of
existing housing, and other relevant information.
5. Use of the trailer for residential purposes, under a previausl�r.issued

trailer is consistent with the character of the neighborhood.'
