2. A properly completed ~ppllcatlon, a consent to inspect signed by the applicant
and a certified abstract of title issued by a title company which shall
show single and separate ownership of the entire lot prior to April 9, 1957.

Dear Mr. Bredemeyer:
I have applied to the Southold Town Building Department
for a permit to construct a deck on the bay side of my home
on Peconic Bay Boulevard.
Mr. Lessard has advised that, due to the wording on the
survey, (copy attached), it requires a letter of
non-jurisdiction from the Board of Trustees.
The survey shows "wood bulkhead" at a point 76'
landward of the mean high water line. It acts more as a
retaining wall, approximately three feet high, that
delineates the end of the landscaping and the beginning of
the sand. It is not a structure dividing land and water.
We then have an additional distance of 45'± from the
"bulkhead" to the house, giving us a total distance from
the bay, (running @ right angles to the~ water), of
approximately 121'
Enclosed is a sketch of the desk. It is 8' seaward of
the house, running 43' across, then back 19' to join the
screened porch. It is appropximately 113' to the mean high
water mark of Peconic Bay from the deck.
If you will supply me with this waiver of jurisdiction,
the Building Department will be able to issue the permit,
and I can proceed.

On December 14, 1989 I submitted the attached
Application for a permit to build a simple cedar deck
across the front of an existing structure.
On December 20, 1989 I received the attached Notice of
Disapproval. Since the "wood bulkhead" on the survey
submitted was not a bulkhead at all (and mislabeled on the
survey), I was advised to submit the attached letter of
April 2, 1990 to the Southold Board of Trustees.
I have now received the attached letter of April 19,
1990 from John M. Bredemeyer III, President, Board of
Trustees, in which he states that under the circumstnces
"...it was determined that this project is out of Trustees
jurisdiction" and waived jurisdiction.
In view of this development, I respectfully would like
to resubmit my Application with the attached check payable
to the Town of Scuthold for your consideration.
If you need any additional information, or if I can be
of any further assistance, please call me at my office
number. I stand ready to do what is required to secure
this important permit.
