Sox 41 Mattituck, New York 11952 ~I Re: Lupton Point Road, Mattituck - 1000-115-11-21 Dear Mr. Perricone: The following action was taken by the Board of Town Trustees during their regular meeting held on December 17, 1987 regarding the above matter: WHEREAS, Stephen Perricone applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated September 24, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on December 17, 1987 at which time all interested persons were given an opportunity to be, heard, and 4VHEREA5, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NO4Y, THEREFORE, BE IT RESOLVED that Stephen Perricone BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Clear and to construct a one family dwelling, decks and sanitary system on property located on Lupton Point Road Mattitick THIS PERMIT IS APPROVED WITH THE PROVISION THAT A LOW PROFILE BERM IS CONSTRUCTED AT THE D.E.C. 50' Wetland line. z 2. .r This permit will expire on December 17, 1989 if work has not commenced by said date. We are also modifying the permit to include construction of two single family dwellings, We understand that you had separate permits for construction of the homes, both of which expired in 19$5 (DEC Permits Nos. 10-83-1571 and x0-83-1572), After review of those permits we have decided to extend and include them with DEC Permit No. 10-84-0621. We are however, pursuant to Section 6NYCRR 621.13 (d) (Uniform Proecdures), imposing the following conditions: 1. There will be no bulkheading permitted on the project site. 2. There is to be no fill on the project site. Please read your permit carefully. The above referenced section also provides that applicants may request a public hearing when a permit contains conditions which are unacceptable to them. If any of the permit conditions are unclear the permittee shall con- tact the Division of Regulatory Affairs at the address and telephone noted below. B. A copy of this permit with supplementary conditions and approved plans shall be available at the project site whenever authorized work is in progress. C. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a con- spicuous location at the work site until completion of authorized work. D. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be com- pleted and returned. E. For projects involving activities to be accomplished over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to the commencement of resumption of work each year. F. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional, Permit Administrator prior to undertaking any such modi- fications. The permittee is advised that substantial modification may require submission of a new application for permit. G.
