SOUTHOLD TOWN BUILDING DEPT. 1 Mr. Janek Harasimowicz -2- April 4, 1991 In the past there has been some question abaut the meaning of the word "existing" as it appears in the first Section quoted above. In this case, however, the building, a residential structure, clearly exists now, it existed on the effective date of the current regulations (1/16/91), and it existed on the effective date of the previous regulations (8/20/77), all of which is confirmed by the date on the survey: 10/29/74. The project, as you described it, would be well outside the 75- foot limit imposed by the DEC regulations, and it would also be outside the jurisdiction of the Town Trustees. The Building Department should be willing to issue a Building Permit as soon as their other requirements are fulfilled. If any questions arise, I would be happy to discuss the matter with the Building Inspector assigned to the project. I am enlosing the materials that you left with me when we met on March 22nd. Section 661.5{a){1) states: "Any type of use designated in this section as a use not requiring a permit for the type of area involved is not subject to the permit requirements of this Part." Section 661.5(b)(26) states that for "Substantial restoration, reconstruction, modification or expansion of existing functional residential structures which are and will continue to be located 75 feet or more from the most landward edge of any tidal wetland" in an Adjacent Area (AA), no permit is required (NPN). Section 661.7, Uses Not Requiring a Permit, states in (a): "Any use, where otherwise legally permitted, listed in Section 661.5 of this Part as a use riot requiring a permit (NPN) for a particular tidal wetland zone or for an adjacent area may be undertaken in such tidal wetland zone or adjacent area without a permit under this Part, provided such activity does not involve a regulated activity."
