As I have stated to you the house does not belong to me. I have contacted my brother that owns the house and he has authorized me to fix any building violations that might exist. He is scheduled to return on Friday, September 30, 1994 if you would like to contact him then. We have also been contacted by our tenant's who are occupying the house and they have stated that you have harassed them regarding this issue. In conclusion, the fence contractor has assured me that as of the date of this letter the fence is in compliance with New York state's building code. In the future if you are going to schedule an inspection, Mitchell has asked me that you notify him in advance for these unauthorized inspections have caused problems with our tenants. Thank you. If the attached drawing meets your, requirements, I will personally outlay the funds necessary to pay the fence builder in order to rectify any possible problems that may exist. 'T'ho attached drawing that I have included indicates a four foot 'high turkey wire fence on three sides of the property and dropping below the bluff line along the Sound. This is an application for a Variance under Article XXIII, Section 100-239.4A for approval of an accessory inground swimmingpool with deck and fencing all as shown on the sketched photocopy (which appears to be a part of a survey) submitted under this application. The set-back at the closest point to the top of the sound bluff for the deck around the pool appears to be at 76+- feet (but not less than 75 feet). Anew dwelling was constructed under Permit No. 16851 issued March 22, 1988 (although the pool structure apparently was built by a contractor for the landowner without a building permit for the same.) The applicant indicates that the actual pool structure is situated approximately 86 feet from the sound bluff at its closest point, and was placed in a vertical position rather than horizontally. 2.
