Box 852 Bohemia, NY 11716 RE: THOMAS & ELAINE GINDELE 590 TARPON DRIVE, SOUTHOLD SCTM# 1000-57-1-6 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 18, 2022 regarding the above matter: WHEREAS, Jeffrey Patanjo, on behalf of THOMAS & ELAINE GINDELE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated August 22, 2023; and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, "Non-disturbance buffers are to remain in their natural state as established and colonized by vegetation that is non hazardous", and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 18, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-12. Standards for Issuance of Permit. A. Adversely affect the wetlands of the Town; B. Cause damage from erosion, turbidity or siltation; D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof; J. Adversely affect the aesthetic value of the wetland and adjacent areas; and WHEREAS, the Non-disturbance buffer already permitted should be preserved; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town; and BE IT FURTHER RESOLVED that the Board of Trustees DENIES based on no action the application of THOMAS & ELAINE GINDELE to remove existing overgrown and dead plant materials from existing 50' wide Non-Disturbance Buffer area landward of existing bulkhead and replace with native plantings that are drought tolerant, non-fertilizer dependent, and attract wildlife; and as depicted on the site plan prepared by Jeffrey Patanjo, dated July 14, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the LWRP. Non-disturbance buffers are to remain in their natural state as established and colonized by vegetation that is nonhazardous. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
