That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. WICKHAM, ERIC J. BRESSLER & GAIL WICKHAM BRESSLER, TRUSTEE U/W D.B. McNULTY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 31, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed action be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposal to construct approximately 83 linear feet of low-profile vinyl groin in-place of existing 87 linear foot timber groin, be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program Policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: structure is being shortened both vertically as well as its overall length; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 18, 2023, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board'of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of the ABIGAIL A. It was so nice speaking with you on Friday. To recap for the Trustees, I am the homeowner of 179 Old Harbor Road,who owns the adjacent property on the down- drift side of the replacement bulkhead and jetty. I had a chance to study the plans for the rebuild of my neighbor's bulkhead and jetty, and wanted to ask the following questions of the Trustees: 1. Will the jetty be a low-profile jetty consistent with Town code? a. What I found in the town code is: "The definition of a 'low-profile'jetty is site specific, but it typically is a structure no higher than 18 inches above existing soil or sediment grade on the down-drift side and shall not extend seaward of apparent low water." b. My beach is on the down-drift side, and currently the top of the jetty is 5' higher than the sand on my beach. On my neighbor's side,the jetty is currently 3' higher. c. Since it doesn't appear to show the height of the jetty on the plans, I wanted to ask whether it would be consistent with the 18 inches in the Town code, or whether a site-specific exception will be made? 2. The plans do not show details about the Return Bulkhead: a. Will the return bulkhead stop at my bulkhead or go in shore? b. If it goes in shore,there might be some excavation, and I want to make sure I'm not developing a hole behind my bulkhead. c. There is a lot of weight on my bulkhead from the soil and trees above it, so it's going to be sensitive to disturbance. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): For the purpose of maintaining the property's historical method of protection against erosion and flooding and maintaining the stabilized shoreline,the project proposes the in-place replacement of an existing timber groin and bulkheading that pre-date 1977 and the Trustees'jurisdiction over erosion control structures along the Town's bayfront.As the upland property has been stabilized by the bulkhead for close to 50 years,there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location;and without maintenance of the bulkhead,the subject and adjacent properties would be exposed to potentially severe flood and erosion damage.And together with the surrounding groins and inlet jetties to the north and south,the subject groin has historically contributed to the stabilization and retention of the beach along this developed shoreline. Consistent with the permit standards for groins set forth in Section 275-11(C)(1),the replacement groin will be constructed in the same location but 4 feet shorter in length,so as not to extend farther seaward than mean low water(MLW);and with a low-profile design(i.e.,its landward end will be set 12 inches lower than the existing groin;and its seaward end will be elevated no higher than 18 inches above the elevation of MLW).Additionally,the groin and bulkhead will be constructed with vinyl sheathing in place of existing treated timber sheathing,which provides a potential water quality benefit through reduction of treated timber located in and adjacent to surface waters;any disturbed portions of the naurally vegetated bluff slope will be replanted with native vegetation;and a 10'wide non-turf buffer will be established along the top of the bluff. McNULTY 189 OLD HARBOR ROAD NEW SUFFOLK, NY SCTM#1000-1147-3-3.1 Policy 4 For the purpose of maintaining the property's historical method of protection against erosion and flooding and maintaining the stabilized shoreline, the project proposes the in-place replacement of an existing timber groin and bulkheading that pre-date 1977 and the Trustees'jurisdiction over erosion control structures along the Town's bayfront. As the upland property has been stabilized by the bulkhead for close to 50 years, there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location; and without maintenance of the bulkhead,the subject and adjacent properties would be exposed to potentially severe flood and erosion damage. And together with the surrounding groins and inlet jetties to the north and south, the subject groin has historically contributed to the stabilization and retention of the beach along this developed shoreline. Consistent with the permit standards for groins set forth in Section 275-11(C)(1), the replacement groin will be constructed in the same location but 4 feet shorter in length, so as not to extend farther seaward than mean low water (MLW); and with a low-profile design (i.e., its landward end will be set 12 inches lower than the existing groin; and its seaward end will be elevated no higher than 18 inches above the elevation of MLW).
