However, the Board , in this matter, apparently feels there is a need to disallow the use of sand as a non turf buffer material when the code specifically allows it.To allow something by definition is to permit something. I know from our past conversation,. You expressed that the Board has historically taken the position that they have the authority to decide what may or may not be allowed. That is a legal question that I am not, in this circumstance raising. What I am bringing to the Board's attention is that, in this case, the sand has always been present to a larger and lesser degree over an extended period of time. Since the sand is already present, I question under what circumstances the Board feels the sand area cannot stand on its own as a non turf material and that it has to be vegetated. If the Board feels it does not have to offer a rationale for their wanting to over plant a non turf material, then I respectfully will submit a revised plan showing the entire area to be non disturbance, after the planting of American Beach grass along the slope as presently predicted. This will allow the area to naturally revegetate to the extent nature allows without any further interference.. Michael A. APPLICANT. J. GRILLO and ORS. LOCATION OF PROPERTY: 365 Mesrobian Drive, Laurel. - COUNTY TAX MAP DISTRICT 1000, SECTION 145, BLOCK 4, LOT 12.1. BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated 9/11/95. PROVISIONS APPEALED FROM: Article XXIIIL Sections 100-231. RELIEF REQUESTED, Increase in fence height from 4 ft. to 6 ft. along portions of the west side of applicant's land (along right-of-way). MOTION MADE BY: James Dinizio, Jr. SECONDED BY: Gerard P. Goehringer ACTION/RESOLUTION ADOPTED: Denied six ft. (6') height for new fencing and granted alternative relief '4e ft. (5' hi h fencing commencin ata point a roximatel eet from Peconic Ba Boulevard. Fence height from be ofra a existing at the Z(27 entrance of the subject right-of-way may not be higher than four feet and shall not obstruct existing windows of garage. An_y other fencing which does not comply with height requirements must comply with zoning restrictions (unless a new application is filed for consideration and subsequently acted upon by the ZBA). REASONS/FINDINGS: Location of fencing is along the back yard areas of existing neighboring dwellings, although the back yards are technically defined under the present zoning code as front yard areas limited to four ft. height without action by the ZBA. The amount of relief alternatively granted is not substantial being a variance of one foot. The variance is not unreasonable under the circumstances existing in this neighborhood.
