The inspection covered the interior plumbing roughing for the Drainage Waste and Vent System(DWV) and the Water Supply System (WS). The inspection results are: 1 —DWV— System was fully exposed and readily viewed. I observed all drainage and vent lines. System constructed as required.New installation is connected to the existing system. All construction was done in compliance with the applicable sections of the IRC, NYS and Town of Southold Building Codes. 2—WS—System was fully exposed, pressurized and readily viewed. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661), no permit is required to conduct regulated activities landward of that bulkhead. Be advised, no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or disturbance within Article 25 jurisdiction which may result from your project. Such precautions may include maintaining adequate work area between the jurisdictional boundary and your project (i.e. a 15' wide construction area) or erecting a temporary fence, barrier, or hay bale berm. This letter shall remain valid unless site conditions change. Your e-mail was regarding your review of various applications before you as follow: Tax Map 47-2-13 (1220 Silvermere Road, aka Cottages 26-27,28, and 29) Your email mentions that only one (1) application was made for this property; however, we have in fact submitted three (3) separate applications, one for each building, as per the Building Department's request. We believe some or all of your comments may be in reference to Cottage 29 based on the footprint dimensions you mentioned. Please note that this letter and the comments below serve to address your email's concerns for all structures on the property. 1. Must provide documentation or correspondence from the Suffolk County Health Dept. and Greenport Village Sewer District regarding the renovations We have previously submitted correspondence from the Village of Greenport Sewer District (Appendix A) confirming that they have inspected the pump station, sewer manholes, and sanitary sewers lines on Lots 9, 11, 12, 13, 14, and 15, and found them to be in satisfactory condition. Per the Village of Greenport, the S-9 letter is the only letter that the Village produces for these instances, and it covers any hookup to the sewer line for the entire parcel mentioned in the letter. The existing sewer system has served the motel and all the cottages for some decades. There has been no activity regarding the system that has or will require any permit from the Suffolk County Health Department. The County only responds to an application and in this case,none is needed or forthcoming. C2.)Footprint does not match what we have on file for this structure-12.3x 10.1 front portion and 10.7 x 13.2 rear portion are as-built(will require ZBA for setback issues) The footprint of the buildings with the portion you mention have existed prior to 1957 when zoning came into existence. Based on the dimensions you provided, we believe you are referring to the existing shed on the north side of Cottage 29 and the patio on the south side of the same building. However,your dimensions do not relate to the actual building itself. We do not believe your record is an accurate representation of what has been in existence,nor does the existing structure require ZBA. I am included a correct �g property survey from Young&Young that indicates the existing conditions of Cottage i ��`D � 29, as well as the other Cottages on Lot 13. 3. Records indicate this was a single-family dwelling--conversion to motel use is as- built—must apply for site plan approval with Planning& Special Exception to ZBA (along with additional variances) to legalize use (and requires Health Dept. approval) OR revert use back to a single-family,dwelling but you will be required to obtain a Town rental permit every 2 years, and must rent the house for more than 2 weeks at a time to comply with the Town Rental Law- Chapter 207 tU There are no records that indicate any of the dwellings on Lot 13 are or have ever been �. single-family residences. In fact, all available documentation indicates that the dwellings on Lot 13 have been considered"motel"use. A Certificate of Occupancy search conducted on 12/31/2020 states that there "is no Certificate on file for the original building[s] according to Building Department records" and that the "Tax Assessor's records indicate that the above mentioned premises was originally constructed as a building of undeterminable age" (Appendix B). There is a Certificate of Occupancy (#Z50) that was issued on 11/27/1957 for an addition to an existing building under Permit #Z85. The building permit application from 1957 states that the "existing use and occupancy" of Cottage 29 is "Resort Cottage" (point 2) and part of"Windward Shore Colony" (point 1) (refer also to Letter and Corresponding Exhibits for Lot 9, which was also part of the Windward Shore Colony Motel); Point 10 also indicates that the property is located in "A Residential" zone. The fact that the property was later up-zoned to Resort Residential (RR) is evidence that it was done to conform the represented use as a "Resort Cottage" and that the "Private Dwelling" classification is not applicable. An additional CO (#Z13012) issued on 11/21/1984 for a solar greenhouse added to frame cottage. Cottage #29 is the only dwelling that had a greenhouse attached to the existing structure and in 1984 the property was zoned Resort Residential (RR), which further supports the fact that it was a resort cottage for short-term rental and that all these structures were pre-existing. The Property Card (Appendix C) clearly states that the Type of Building is "Motel / ,-�' Cabins". The Property Card's plot diagram also confirms that there were four (4) structures on the property and notes that one of them suffered a"complete loss by fire" in 1967. This leaves three (3) remaining buildings on the property, all existing and designated as "Motel / Cabins". We currently refer to these remaining dwellings as building#s 26-27, 28, and 29. The Suffolk County Department of Health Services has granted a Temporary Residence (TR) permit to the Silver Sands Resort for 40 units (Appendix D). The Temporary Residence Unit regulates "temporary residences" such as hotels and motels, and cottage colonies. "Temporary Residences" are facilities maintained primarily for overnight occupancy by 10 or more people but are not intended to be occupied by the same persons in excess of 180 consecutive days. The TR permit for the Silver Sands covers all lots that comprise the "Resort", which includes but is not limited to the buildings on Lots 9 and 11-15. The motel building (Lot 11) has 21 units and the buildings on Lots 9 and 12-15 account for an additional 17 units (38 total). The Southold Town Property Tax Bill correctly designates the property type as a"Motel" (Appendix E). Finally, I am including a letter from Darline Duffy (Appendix.F), who was one of the . previous owners of the Silver Sands Motel as well as a long-standing Southold Town Tax Assessor. Ms. Duffy's direct, personal knowledge of the properties dates to 1975. She confirms that all lots currently associated with the Silver Sands have been zoned Resort Residential (RR) since before that time and that all the dwellings on Lots 9 and 11-15 have been used exclusively for short-term transient housing. To restate, the cottages on Lot 13 (Cottages 26-27, 28, and 29), as well as the other cottages across Lots 9, 12, 14, and 15, have always operated as part of a motel complex. They have never operated as "residences" and all available documentation confirms as much. As such, there is no conversion from a single-family residence for any of the buildings on Lot 13 to a motel as the buildings never functioned as residential units. There is no basis to consider legalizing its use, as the"use"has not changed. 4. Plans do not specifically show what was existing and what is proposed/as-built, must provide revisions to plans for clear interpretation Plans will be revised to specify "existing". S. Must provide a certification letter from NYS architect or engineer with stamp and seal indicating whether or not each structure on this lot meets the town code definition of demolition. A cost analysis is being provided from an engineer that indicates each cottage's renovation costs does not exceed the 50% of assessed valuation. Therefore, no zoning variance will be required. 6. Provide alteration level as specified in NYS Existing Building Code for each structure, if legalizing to commercial motel use (may possibly require sprinkler systems in structure) An engineer's letter will also be provided to confirm the alternation level per the NYS Existing Building Code for each structure. Edward's parents built the original motel in 1957 and he and I had been together since 1975.I inherited my husband's ownership in the motel and surrounding properties,which I sold to the current owners in 2022.I also served as a Southold Town Assessor from 1991-2014, through which I had intimate knowledge of real property and its taxable status within the Town of Southold, including the Silver Sands properties. I can attest that all the cottages and homes on the various properties that comprised the Silver Sands have always been rented to guests and were never used as permanent residential housing since at least 1975.To the best of my knowledge, all the properties that are currently part of the Silver Sands have been zoned Resort Residential since at least 1975 as well. Of course,the Silver Sands Motel (on SCTM 1000-047-02-11) itself was built in 1957.Furthermore,the cottage on SCTM 1000-047-02-09(aka#34)was at one point called the Windward Shore Motel before it was incorporated into the Silver Sands,and the cottages on SCTM 1000- 047-02-14(aka#s 101-108),which date back to 1930,were at one time called the Silvermere Beach Houses. All the dwellings on these properties, as well as the ones on SCTMs 1000-047-02-12, -13, and -15, were rented out to guests for many decades. During the inspection I met with the Project Manager(Alex Perros) and he provided me with the project documentation for the proposed refurbishment. The documents included: -Project Design Drawings (1 set) -Real Estate Evaluation/Certification Statement -Newmark Valuation &Advisory -Tax Records from Southold Town Files The Project Manager requested Professional Engineering Services. The scope of the services included developing a construction estimate for the Project and comparing the estimate to the data provided in the Appraisal Report prepared by Newmark Valuation and Advisory. The scope also included defiiiing the work category per the current NYS Existing Building Code and evaluating the energy use improvements per the current NYS Energy Conservation Code. Based upon my on-site inspection,my review of the project plans and professional experience I developed a Construction Cost Estimate for the Project. The estimate was developed using my professional experience,knowledge of the site and local contracting conditions,up to date pricing from suppliers and the MEANS System for Cost Estimating. Specific site information and details provided in the drawings were 1 considered in the estimating process. The estimate was developed using a format that allowed direct comparison with the Appraisal Report. My estimate is based upon the actual design plan elements, square footage costs for the construction, geographic factors for the project location and actual conditions observed and confirmed at the site. The estimate includes 2022 cost adjustments and labor availability factors. Result—Based upon inspection of this project and to the best of my knowledge, belief and professional judgment, the construction cost for the planned refurbishment of these (3) individual structures is: Total Cost— Cabins 26-27-29, House 28 =$297,112 (A copy of my summary estimate is attached). Base Line Cost for Completely New Structures= $1,055,222 (Newmark Valuation) Therefore the planned refurbishment for the Cabins and House on this Tax Lot is 28% of the replacement cost for the entire the building. NYS and Southold Town Code Definitions & Classification of Work: The 2020 Building Code of the State of New York contains the following definition: SUBSTANTIAL IMPROVEMENT - Any repair reconstruction, rehabilitation, alteration, addition or other improvement of a building or structure, the cost of which equals or exceeds 50 percent of'the market value of the structure before the improvement or repair is started. The Town of Southold Code—Chapter 280—Zoning Article 280-4 - contains the following DEMOLITION-Any removal of a structure or portion thereof, where the total cost of the reconstruction of the structure or portion thereof exceeds 50% of the market value of the existing structure before the start of removal. The Cabins are single story structures with a limited floor plan with uncomplicated interior walls and simple room design (i.e., single room and small bathroom). As a result, the use of materials and sophisticated components and finishes is limited. The House is a one and a half story structure with a storage loft. The floor plan includes three bedrooms, loving room, kitchen/dining room and two bathrooms. The structure has uncomplicated interior walls and simple room design. As a result, the use of materials and sophisticated components and finishes is limited. 2 For example, all of the existing foundation, exterior wall framing, sheathing and structural components remain in place. The only planed work for these elements is to repair any deterioration discovered during the construction. The installation of supplemental headers, and removal and fill in of window openings falls well below the 50% demolition definition. Even in the event of discovery of additional repairs due to deterioration of the existing structural components, the reasonable additional work value would add no more than an additional 10%to the total cost and remain well below the 50%threshold. The plumbing, electrical and HVAC installation and fixtures are standard class and simplistic with uniform installations. In addition, the finishes, floor coverings and tiling are also basic commercial grade and standard quality. The specific and actual numbers balanced against the reconstruction cost result in the following conclusion: The actual expenses incurred and contractual agreements to complete the reconstruction of the structures on this tax lot reveals that the total cost will be 28% of the total value of the structures. This is below the 50% demolition limit and rebuilding costs as defined by the NYS-Building Code and the Southold Town Code. Additionally, per the NYS Code, the work to be included with substantial improvement should not include: Any project for improvement of a building required correcting existing health, sanitary or safety code violations identified by the building official and that are the minimum necessary to assure Safe laving conditions. Based on this definition in the NYS Code and my inspections of the existing structure, adjustments should be made to the estimated cost of the rehabilitation/alteration work for comparison purposes. My Professional Engineering opinion is that the following work items would have to be done to assure safe living conditions as defined by the code. Although there were no actual violations issued for these conditions, my professional judgement is that the following items have to be addressed in order to safely re-open this facility: 1 — Due to mold conditions existing throughout the buildings and in particular in the wall cavities and on the ceiling, all the interior wall and ceiling finishes (sheetrock) need to be removed and replaced. Any existing insulation needs to be removed and disposed. Once cleaned, the walls and ceilings should be insulated, new sheetrock installed and finishes applied. This rehabilitation work improves the health and safety conditions necessary to assure safe living conditions. 3 2 — The existing plumbing fixtures were aged, deteriorated and not functioning as designed. All the bathrooms need to be rehabilitated with new efficient water use fixtures that meet the sanitary and safety codes. Based upon the NYS Code Definition, the work items described above should not be considered part of the Substantial Improvement value calculation. If these items are separated from the total estimated costs for the project the resulting estimate for the proposed improvements would reduce from 28% to 24% buildings value. This further reinforces the statement that the proposed renovation of these structures fall well below the 50% value threshold as related to the Demolition of Structures. Based upon the analysis presented, the real estate documentation and my professional opinion the project should not be considered a "Demolition" in regards to the Town of Southold Code. Proiect Evaluation—Alteration Level The 2020 Building Code of the State of New York defines Alteration—Level 2 as: Scope — Level 2 alterations include the reconfiguration of space, the addition or elimination of any door or window, the reconfiguration of or extension of any system, or the installation of any additional equipment. This proposed project work for these three buildings exactly aligns with this definition. Even though there is substantial interior work to improve the health, sanitary and safety conditions of the facility, the project should be classified as an Alteration—Level 2. Proiect Evaluation—Definition of Work Area Based upon my on-site inspections and my review of the project design plans I was able to evaluate the aspects of this project in comparison to the NYS Work Area definition. The code defines work area as: That portion or portions of a building consisting of all reconfigured spaces as indicated on the construction documents. Fork Area excludes other portions of the building where incidental work entailed by the intended work must be performed and portions of the building where work initially intended by the owner is specifically required by this Code. It is noted that for all the structures, the entire structural foundation system, exterior framing and sheathing, roof framing and sheathing, interior floor framing and structural covering, and some interior wall framing all remain as-is and in place. The major rough plumbing infrastructure will also remain in use. 4 The Cabins are one story open structures and the House is an existing one and a half story structure with an open loft storage area. Because these buildings are being renovated in kind to remain as the same use, evaluating this project based upon impacted Work Area is not practical from engineering prospective. Based upon my evaluation of the project conditions and scope it is my professional opinion the project does not have a Work Area that exceeds 50% of the building space. Actually the majority of the work area is in spaces where the activity is required to correcting existing health, sanitary or safety issues. Based upon the my evaluation of the proposed work scope, the work required for safety code reasons and the actual size and configuration of the cabins and house; this renovation does not have a "Work Area" that exceeds 50% of the Building Area. Summary Result - Based upon inspection of this project and to the best of my knowledge, belief and professional judgment: 1 - The statements in the Value Certification Letter dated November 10, 2022 for the construction costs of the planned refurbishment are accurate. 2 - The overall cost of the planned construction will be 28% of the property valuation (less than 50%). 3 - The adjusted cost based upon NYS-definitions of the planned construction will be 24% of the property valuation (less than 50%). 4 — According to the NYS Code this project should be classified as an Alteration — Level 2 5 — According to the NYS Code this project does not have a "Work Area" that exceeds 50% of the building area. 6 — The Construction Cost and Real Estate Value Estimates developed are accurate for the proposed project. The assessment of the volume and value of the existing building elements that remain in place is also valid. Based upon the results of these efforts, the determination that this work is not a NYS Substantial Improvement is correct. The purpose of this effort was to determine if the proposed construction complies with the 2020 NYS Building Code (Energy Conservation), in particular the 2018 IECC. The proposed work has been determined to be an "Alteration-2" as defined by the NYS Code.. The elements reviewed for energy conservation include the exterior envelope, fenestration and HVAC System. House Exterior Envelope: The exterior envelope includes the roof, ceiling walls and floor. The design building envelope meets the requirements of this Code Section as follows: - After the Alteration the building will be more compliant with the Code. - After the Alteration the building will use less energy for routine operational needs. - The Alterations do not create any hazardous conditions or overload any building systems - All exposed cavities in the roof, ceiling, walls and floors will be 100% filled with insulation. Fenestration: The fenestration includes the doors and windows throughout the Cabin and House Structures. As part of this alteration all the doors and windows are being upgraded. The doors will be Thermatrue or Anderson 400 Series. The windows will be Anderson 200 Energy Star Series. The'new replacement doors and windows in the design all have a "u" factor in the range of 0.30 to 0.32.
