Box 1179 Southold, New York 11971 RE: 802 Main Road, Laurel Suffolk County Tax Map 1000-127-2-6.1 Dear Mr. Fish: Enclosed please find an energy study of the exterior walls of the above. After my discussions with you concerning the insulation requirements, I called the New York State energy office in Albany, to discuss this matter with their representative Mr. Lee Smith. To be brief, he referred me to a section out of the energy code (ed. April 1, 1978) which was in effect when we obtained the building permit. Referring to section 7810.6, -3-2 and -3-3 which states: A) That the thermo-resistance rating of the exterior walls does not have to exceed R-11. B) That the thermo-resistance value of the windows should be a minimum of U= 0.58. If you will notice in my energy audit of the exterior walls, values provided are well within compliance of the code. Also, Mr. Smith brought to my attention that existing buildings do not have to comply with any thermo-resistance values for floor or ceiling, if they were built prior to the energy code. I'm sure you will agree that the building in question was built long before the energy code was instituted. Tax Map #1000-127-2-6.1 Dear Mr. Rufrano: In regards to your request for a Certificate of Occupancy for a year round residence located at 802 Main Road, Laurel, N.Y., Suffolk County Tax Map #129-2-6.1, I am unable to issue you the CO due to the fact that the renovation addition does not comply with the New Yark State Energy Code. Please keep in mind that the original building permit that you applied for was for a non-heated seasonal dwelling. That is what the original permit was issued for and also the renewal of the same permit. Mr. DeLuea has been in contact with the Building Department a number of times regarding the fact that electric heat was installed. He was told that he must comply with the N.Y. State Energy Code. He has submitted an energy report and in an accompanying letter he states that a Mr. Smith from the N.Y. State Energy Office informed him that he did not have to comply with any thermo-resistance values for floor or ceiling in an existing building. That part of the Energy Code applies to year round buildings that had heat at the time of renovations. In your case the State considers your residence "New Construction" as it never had a heating system. Being that it is considered "New Construction" it must meet all requirements of the Energy Code. If you so desire you can request an interpretation of the Energy Code. Enclosed is a copy of that part of the code that outlines the requirements of the request. (b) Whenever plans or specifications are submitted in connection with applications for building permits, such plans or specifications shall show all data and features of the building, the equipment, and the systems in sufficient detail to permit an evaluation of such plans or specifications by the code enforcement official. (c) Documents relating to the proposed construction, which contain in- formation necessary to verify compliance with this Code, such as cal- culations, worksheets, compliance forms, vendor literature, or other documents, shall be made available when requested by the code en- forcement olficiai to permit an evaluation of such documents. 7810.12 Information Concerning Code Requirements Upon written request, the Commissioner of the State Energy Office may provide information concerning any requirement or standard of this Code. Any information so provided shall not be considered an interpretation of Code requirements as provided for in section 7810.13. 7810.13 Interpretation of Code Requirements in Cases of Specific Construction (a) Upon written request by a building permit applicant and/or a code enforcement official, the Commissioner of the State Energy Office may issue an interpretation of the application of any specific require- ment of this Code to the proposed construction for which an applica- tion for a building permit and required plans and specifications have been filed, and concerning which there is a disagreement between the building permit applicant and the code enforcement official as to the application of such specific requirement to the proposed con- - struction. (b) A request for an interpretation shall be signed by the building permit applicant and the code enforcement official, or by one or the other individually, and shall include the toilowing information in order to be considered complete: (1) Name, address, and telephone number of the building permit applicant and the code enforcement official; =~(2) A detailed description of the proposed construction, includ- ing acopy of the building permit application and plans and specifications which have been filed by the building permit f 6~ Part 1 7810.13 (cont.) applicant with the code enforcement official and any other floor plans, elevations, cross-sections, details, specifica- tions, or construction documents necessary to adequately describe the proposed construction; (3) Identification of each requirement of this Code for which an interpretation is requested; (4) A concise summary of the disagreement concerning the ap- plication of each such requirement for which an interpretation is requested; and (5) A copy of the building permit application denial if one was issued by the code enforcement official. (c) If the request is incomplete or does not otherwise contain sufficient information on which to issue an interpretation, the Commissioner may request clarification of the information provided or additional in- formation necessary to issue the requested interpretation. (d) Upon receipt of a complete request for an interpretation signed by only the building permit applicant or the code enforcement official, the Commissioner shall provide written notification to the party who has not signed the request for an interpretation that such request for an interpretation has been filed with the State Energy Office. The party receiving such notification shall have 20 days from the date of such notification in which to provide, in writing, any comments or ad- ditional information pertaining to the request for an interpretation; provided, however, that the Commissioner may waive this deadline when warranted by extenuating circumstances. (e) The Commissioner shall either issue the interpretation or provide notification of the intent not to issue an interpretation to the building permit applicant and the code enforcement official within 45 days of any of the following: (1) Receipt of a complete request for an interpretation signed by both the building permit applicant and the code enforcement official; (2) Receipt of comments when the request for an interpretation is signed by only one party; or (3) The expiration of the 20-day comment period when the re- quest for an interpretation is signed by only one party. The amount of alteration done to the principal building does not appear to be included in the application in regard to heat, plumbing, electrical and interior work. Building permit applications have not been received for the accessory buildings, the barn and shed, that are located on the propety. There is also a question regarding the Suffolk County Tax Map numbers used on the application. In order to avoid legal action you must resolve the above matters immediately.
