Re: LWRP Coastal Consistency Review for ZBA File CONSTANCE LEVY #7801
SCTM No. 1000-94-1-2.
CONSTANCE LEVY#7801 - Request for Variances from Article 111, Section 280-15; Article XXII,
Section 280-116A(1); and the Building Inspector's April 11, 2023 Notice of Disapproval based on an
application for a permit to construct additions and alterations to an existing single-family dwelling; at 1)
addition"located less than the code required 100 feet from the top of the bluff; 2) swimming pool located
in other than the code permitted rear yard; located at: 405 Soundview Avenue, Mattituck,NY. SCTM
No. 94-1-2.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department and the records available to me, the proposal is recommended as CONSISTENT with the
LWRP. The pool does not extend further seaward than the single-family residence.
A vegetated buffer landward of the top of the bluff is recommended to further Policy 6 and minimize
turf.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed action.
