RAKHMANINE 685 BUNGALOW LANE, MATTITUCK,NEW YORK SCTM # 1000-123.-3-9 REASONS FOR APPEAL: The Applicants, Mikhail and Jennifer V. Rakhmanine' are appealing the Building Inspector's Notice of Disapproval, dated April 11, 2023, for a building permit to partially demolish and reconstruct an existing single-family dwelling on the footprint of the existing residence. The proposed footprint would maintain the pre-existing non-conforming setback of 4.6 feet from the western side yard and establish a conforming setback of 20.2 feet from the eastern side yard for a combined side yard setback of 24.8 feet, where a 15-foot side yard setback and 35-foot combined side yard setback are required under Town Code Section 280-124 on lots measuring up to 39,999 square feet in total size. The subject parcel is a non-conforming 31,122 SF lot in the R-40 zoning district located on Bungalow Lane in Mattituck. The lot is also non-conforming in width, making it difficult to utilize the space while conforming to side yard setbacks. In addition to rebuilding the residence, the Applicants intend to relocate the sanitary system to the landward yard of the house and abandon two dated cesspools in favor of a modern low-nitrogen system. For the following reasons, the Applicants submit that variances from Section 280-124 are warranted. 1.An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The surrounding neighborhood is characterized by one-story and two-story waterfront dwellings of varying sizes, many of which are constructed on narrow and substandard lots and have undergone renovations or been reconstructed. Due to the substandard widths typical in this neighborhood, the majority of residences here are non-conforming to side yard setbacks. There will not be any undesirable change in the neighborhood, as the existing residence is already non- conforming to the side yard setback from which relief is being sought, and this non-conformity pre-dates the current dimensional regulations. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The Applicants are seeking to renovate the residence in its current location while retaining as much of the original house as possible, including the entire footprint, foundation, and framing. Because the proposed construction is deemed a demolition, variance relief is triggered for the pre-existing nonconforming side yard setbacks. 3. The amount of relief requested is not substantial because: While variances for the side yard setback may be mathematically substantial at 69% relief from the required setback, there is no increase in the non-conformity compared to what already exists and there will be no new ground level disturbance in the side yard. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the currently existing setbacks are pre-existing nonconforming to the current requirements, and the degree of non-conformity is not being increased. Granting of variance relief will not have an adverse impact on the physical conditions in the neighborhood and, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. In addition, the Applicants will be upgrading to an I/A low-nitrogen sanitary system on the landward side of the house and abandoning two cesspools near the water, resulting in a net environmental benefit from this project.
