The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposal is recommended as INCONSISTENT with the LWRP. The project was properly inspected by Southold Town Building Inspectors at required intervals. Prior to the application for the CO the Covid lockdown took place.. Mrs. Burke is a nurse and her duties during that time were extraordinary so during that time her family, like many others, gathered in one place to support her and take care of each other. As the existing house has only two bedrooms the accessory building was used temporarily as overflow space for the family although it was designed to be a storage building. Many of the houses on Wood's Lane were built prior to 1960 and most could be described then and now as seasonal family residences. Further research shows that almost all of them have expanded the family living space by some means whether by addition or conversion of existing structures to habitable space. Mrs. Burke does not intend to use her property in any way that will be significantly different than the neighboring properties meaning that the accessory structure will not be rented and will be for the occasional and seasonal use by her immediate family. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated March 9, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards.The LWRP Coordinator issued a recommendation dated June 16,2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with the LWRP policy standards and is therefore IINCONSISTENT with Policy 1. The as-built conversion of the existing accessory garage to two(2)recreation rooms is inconsistent with this policy as is the installation of a sanitary system and bathroom facilities. Building structures without property reviews erodes community character and circumvents the codes and regulations in place that protect, health,safety,and the environment. PROPERTY FACTS/DESCRIPTION: The subject property is a 22,995 square foot nonconforming parcel located in the Residential R40 Zoning District. The northerly property tine measures 135.69 feet and is adjacent to Richmond Creek, the easterly property line measures 3I2.94 feet, the southerly property line measures 76.86 feet and is adjacent to a 20 foot Right of Way and the westerly property line measures 293.81 feet. The parcel is improved with a one-story frame dwelling with wood deck and stairs attached to the rear of the dwelling. There is a stone path walkway that leads to a wood deck on the westerly side of the residence with a long composite ramp that leads to a wood floating dock. There is a 23.2 ft. by 14.3 ft. frame building south of the dwelling and north of the gravel driveway. The accessory structure is located south of the driveway and is 22.4 ft.by 34.2 ft,with three(3)doors,one large glass door to the north,a regular entry door on the west side and another entry door on the east side ofthe structure. There is an outdoor shower on a small deck on the easterly side of the accessory structure. The property has deer fencing on both the east and west sides up to the frame building south of the dwelling and along the front and up to the frame building on both sides. RELIEF REQUESTED: The applicant requests variances to legalize an as-built conversion of an existing garage to (2) recreations rooms at 625 Wood Lane, Peconic, NY. SCTM#1000.86-6-7. The as-built construction, on this nonconforming 22,995 square foot lot in the residential R740 Zoning District is not permitted pursuant to Article III, Section-13C. Recreation spaces in accessory building is not a permitted accessory use. ADDITIONAL INFORMATION/BACKGROUND: The applicant was issued a Building Permit#43202 on November 17, 2018 to construct a non-habitable accessory garage. The plans received by the Building Department for the accessory garage were prepared by James DeLuca, Architect, dated August 16, 2018 and show rooms identified as "garage space, storage space, and a closet". A Certificate of Occupancy was requested in August 2021, but was denied by the Building Inspector because the improvements exceeded the building permit that was issued for non-habitable garage and storage space. At the public hearing the applicant's agent informed the Board that the plans approved by the Building Department for the accessory structure's building permit included notations that the interior would be finished with radiant heat,tiled floors, board and batten wood finishes, a cathedral ceiling finished with cedar and rooms labeled recreation space. Additional plumbing for a powder room was added during construction. The Zoning Board inspected the property before the July 7, 2022 public hearing and found no garage or recreation room/space, but were able to see from the outside two furnished rooms that were being used for sleeping. Air conditioning and pull-down stairs leading to the upper area have been installed in the structure. A neighbor testified that she had witnessed people wearing bathrobes leaving the accessory structure in the morning and walking to the residence. The Accessory Garage Plans received by the Office of the Board of Appeals (two original copies signed and sealed by James DeLuca, Architect,(Sheets AI & A2) last revised February 16,2022 show recreation space, a powder room, and storage space. There is also a proposed storage space in the attic. The Members of the Board of Appeals did not receive the same set of plans in their individual packets but rather plans stamped "Disapproval" "Received September 20,2021, Building Department, Town of Southold."These pians were prepared by James De Luca, Architect, labeled last revised "As Built Conditions" dated 12-24-19 include sheets C 1 Plot Plan with a list of Notations, A I Elevations and Building Section, and A2 floor plans. On the plot plan there is a marginal notation pointing to a"proposed one story rec space&garage structure."On sheet A 1 the elevations are labeled Garage(although no overhead garage door is proposed),and the building section labeled Storage Space and there is a small type notation under this label "tile floor finish over elect radiant heating(htg)material(mat.)" Finally on the floor plan labeled Garage Plan on Sheet A2,the two labels printed as storage space and garage space have been crossed out and replaced with handwritten labels noted as "recreation room"and"recreation space."A handwritten note says pre-finished wood flooring. There are also small printed notations saying"board and batten interior finish"and a split heating and air conditioning unit is shown. Based upon these revised plans,the Building Department issued a Notice of Disapproval originally dated September 24, 2021 and RENEWED January 4,2022 to"legalize-an as built conversion of an existing accessory garage to two recreation rooms"which was disapproved pursuant to Article [[1,Section 280-13 (C) which states that"Recreation spaces in an accessory building is not a permitted accessory use." Based upon these revised and inconsistent architectural plans,and personal inspection by the Members of the Board,the Board concludes that the Notice of Disapproval dated renewed January 4,2022 was correctly issued FINDFNGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7,2022 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: l.Town Law 267-b(3)(b)(1). Grant of the requested variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Town Code does not allow for recreation spaces in an accessory building; i.e.,not a permitted accessory use,and the granting of this proposed use variance would set a precedent that would undermine town code.The Town Code has allowed the Board of Appeals to approve the conversion of existing accessory garages to accessory apartments and pool houses for applicants that qualify according to Special Exception Standards through proper application to the Zoning Board of Appeals. 2. Town Law X267-11f3)(b)(2). The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicant can include recreational space in their existing dwelling or they can make an addition to their dwelling for this perm itted use in a principal dwelling. 3. Town Law §267-b(3)(11)(3). The variance requested herein is mathematically substantial, representing 100% relief from the code.Additionally,the applicant converted the as built accessory garage into habitable sleeping/living space with a half bathroom without a proper building permit. 4. Town Law &267-11(3)(6)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Habitable space in accessory structures require eligible applicants (homeowners whose dwelling is their principal residence) to request and obtain a Special Exception permit from the Board of Appeals for an accessory apartment in an accessory structure to be rented to a relative or individual on or eligible for the Town's Affordable Housing Registry. The Town Code does not permit home offices, sleeping space or recreation space in accessory structures.A half bath is permitted in an accessory garage. 5. Town Law $267-b(3)(11)(5). The difficulty has/ been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.
