KATIE AND JONATHAN VIGDORCHIK 47802 - Request for Variances from Article III, Section
280-15; Article XXII, Section 280-116A(1); and the Building Inspector's February 23, 2023, Amended
March 27, 223 Notice of Disapproval based on an application for a permit to construct an accessory
swimming pool; 1) located in other than the code permitted rear yard; 2) located less than the code
required 100 feet from the top of the bluff; located at: 17975 Soundview Avenue, Southold,NY. SCTM
No: 1000-51-1-7.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department and the records available to me,the proposal is recommended as CONSISTENT with the
LWRP. The pool does not extend further seaward than the single-family residence.
A vegetated buffer landward of the top of the bluff is recommended to further policy 6.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed action.

TERMS AND CON]_ IONS
The Permittee Kevin Gallagher residing at 17975 Soundview Avenue, Southold, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained. I
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board_
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. . That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized,or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

ordered as a lien against the property upon a finding by the Board of Trustees that said lack of

WHEREAS, En-Consultants on behalf of KEVIN GALLAGHER applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the
Southold Town Code, Coastal Erosion Hazard Areas, application dated December 26,
2019, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 12, 2020, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

concerning this application, and,,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of KEVIN
GALLAGHER to construct along eroding toe of bluff approximately 127 linear feet of
stone revetment, including ±13' westerly and ±11' easterly angled returns, all consisting
of approximately 3 to 5 ton stone placed over 50 to 100 pound core stone and filter
cloth; restore bluff face by constructing terrace retaining walls and placing
approximately 500 cubic yards of sand renourishment(including approximately 240
cubic yards of on-site material excavated from toe of bluff for revetment installation and
approximately 260 cubic yards of clean sand to be trucked in from an approved upland
source) to be vegetated with native plantings; establish"and perpetually maintain a 10'
wide non-turf buffer with native plantings adjacent to bluff crest; and construct new 3'
wide by±78' long (top to bottom) elevated timber bluff stairway (including a 3'x6' entry `-
platform, 3'x6' and 3'x3' middle platforms, and 3'x4' platform leading to 5'x6' bottom
platform connected to 3'x12' steps to beach); with the condition that no bluff cut is used;
and as depicted on the site plan prepared by Jeffrey T. Butler, P.E., P.C. dated
December 20, 2019, and stamped approved on February 12, 2020.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

S.E.Q.R.A. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE:
WHEREAS, the Southold Town Board of Trustees are familiar with this project having
visited the site on February 5, 2020, and having considered the survey of property by'
Nathan Taft Corwin III Land Surveyor dated December 19, 2019, and having considered
the plans for this proposed project submitted by Jeffrey T. Butler, P.E., P.C. dated
December 20, 2019 at the Trustee's February 10, 2020 work session, and
WHEREAS, on February 12, 2020, the Southold Town Board of Trustees declared itself
Lead Agency pursuant to S.E.Q.R.A., and
WHEREAS, on February 12, 2020 the Southold Town Board of Trustees classified the
application as an unlisted action under S.E.Q.R.A., and

WHEREAS, in reviewing project plans submitted by Jeffrey T. Butler, P.E., P.C. dated
December 20, 2019 it has been determined by the Board of Trustees that all potentially
significant environmental concerns have been addressed as noted herein:
• Vegetative, non-structural measures are not capable of stabilizing the erosion of
the bluff alone.
• Protection of the toe of bluff using hardened structures including rock revetments
is necessary.
• No existing rocks or boulders are to be utilized, moved, or relocated on the
beach.
• As time progresses, continued soil loss at the toe of the bluff may lead to habitat
degradation and bluff instability.
• A site inspection by the Southold Town Board of Trustees recognized erosion on
this property and the need for a bluff stabilization/erosion control plan.
THEREFORE, according to the foregoing, the Southold Town Board of Trustees
Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to
SEQRA for the aforementioned project.

This property is located in an R-40 Residential Zone District, being
situate on the northerly side of Soundview Avenue, Southold. This
lot contains a total area of 1.452 acres, with 115 ft. road frontage,
and is more particularly shown on a survey dated May 13, 1997,
amended June 24, 1997. The subject premises is improved with the
following:- one-story brick dwelling, accessory brick garage,
accessory metal shed, and wooden platform access to stairs at top of
bank.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated.
September 24, 1997 which reads as follows: ". . .under Article XXIII,
Section 100-239.4A(1), proposed construction will be within 100 feet
from the top of bank or bluff of Long Island Sound. . . ."
AREA VARIANCE RELIEF REQUESTED - BY APPLICANT: To locate
proposed deck addition, at the northerly (rear) wall of existing
dwelling. The new deck addition is proposed at 75 feet (or 80 ft. )
at its closest point to the top of the bank of the L. I. Sound
(indicated on the survey in pencil by applicant) .
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
('l) The granting of the area variance will not produce an
undesirable change in character of neighborhood or 'a detriment to
nearby properties because the deck cannot be seen from other
properties in the area.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
due to the topography of the lot in question. This lot contains a
large. retaining wall to the east of the proposed deck.
