Name of Owner: John Cosenza ZBA File # REASONS FOR APPEAL (additional sheets may be used with preparer s si nature): AREA VARIANCE REASONS.- (1) EASONS.(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The previous variance runs with the land and applicant requested that the pool be permitted to be constructed since the setback is greater than the ZBA approved for the house. If the house was permitted at 70' then a small swimming pool should be permitted under the previous ZBA approval. The house is located at 51' front yard, this resulted in the setback of the house from the top of bluff to be at 81' rather than what the ZBA had approved (70'). (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: there are no structures which can be constructed in the rear yard without a variance. The applicant has designed a swimming pool which is minimal(Splash ool).In order to maintain the maximum setbacks to the top of the bluff. The Trustees reviewed the application and established bot non-disturbance and non-turf buffers seaward of the existing retaining wall. The Trustees did not object to accessory structures in the rear yard between the retaining wall and the house. (3) The amount of relief requested is not substantial because: The Zoning Board has previously granted variances for a house (foundation) at 70' from the top of the bluff. The proposed pool is within this approved variance setback. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed accessory structure is in the open area of the rear yard adjacent to the Top of Bluff. There is a 30' no disturbance area landward of the slopes which are the natural feature and a no disturbance area. In addition, an additional non-turf buffer was required to landscape wall. The house was constructed with proper drywells and gutters and the slopes of the property run toward the road and not the bluff. (5) Has the alleged difficulty been self-created?
