An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: The house was constructed prior to 1957 and does not comply with Flood Elevations or NYS Building Codes. A certificate of occupancy for the garage was issued but there is no pre-CO because the family has owned the property since 1946. The parcel is a lot on the amended map of Peconic Bay Estates filed in the office of the county clerk in 1933 as filed map #1124. The owners tried to keep the existing house, any improvements to the house would require compliance with FEMA and the energy code. The extent of renovations needed to the existing house would cause more than 50% of the existing structure to be replaced. The Estate is still open and when the estate is closed out Richard C Jensen Jr. and his wife, Kasia Jensen will undertake the construction. The proposed house has been carefully designed to meet all the applicable regulations and request minimal variances. The lot is only 50' in width and the side yard setback on one side (North) is 6.2 and combined setback 16.10. The original house was constructed with preexisting setbacks (min. 5 and min. 10). The proposed setbacks are 6.2 and combined setback of 16.10. The proposed house is more conforming than the existing house. The owners have been able to maintain a conforming lot coverage of 20%. The proposed pool is only 6' x 18' (splash pool). The front and rear yard setbacks conform to zoning. Trustees and DEC applications will be required for the new dwelling. The homes on Bay Shore Road have been substantially renovated or demolished and reconstructed. The existing house is one of the original homes on the block which has not been updated. This new home will be a benefit to the neighborhood and conform to the character of the block. The proposed house is maintaining the character and design of the houses constructed on Bay Shore Road. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The house is a reasonable size with setbacks that are more confirming than the existing house. The majority of the front yard is taken up by the requirements of the new sanitary system. The utilities must be raised due to the flood zone and are located on the proposed first floor. The second floor is designed with the proposed three bedrooms. The proposed house is a modest home for the family. There have been numerous Variances issued on Bay Shore Road: 1000-53-6- 24 Swing two variances. First Variance #6159 house additions and alterations proposed. However, house had to be raised and considered a "demolition". Appeal #6320 The same plan/construction was approved as a demolition. The existing setbacks granted were 5.7 and 5.8 (Lot coverage 26%). The proposed setbacks were an improvement from the preexisting setbacks. Bulkhead setback was granted, however, the code no longer requires bulkhead setbacks. Homes where additions constructed: 1000=53-6-20 Guido House raised and 6' x 10' addition and 10'x 14' deck constructed 1995 (predates Walz decision) 1000-53-6-22 DeMartino house raised and 2nd floor added with existing setbacks 2.5' and 9' 1000-53-6-23 Meyerholz house raised expanded to 25.3% lot coverage setbacks 8'2" and 5' 3.The amount of relief requested is not substantial because: numerically it is substantial. Without the variances for side yard setback, the applicant could not construct a reasonably sized home for his family. The setbacks of the existing house are closer to the property line and the proposed construction will improve the existing conditions. In addition, the new home will be FEMA compliant and have a new and conforming sanitary system. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house will be raised to meet FEMA standards and the sanitary system will be located in the front yard, 100' from mean high water. The DEC and Trustees will require a no disturbance area adjacent to the water with Covenants. The construction of the new house will improve the existing conditions of the property, maintain the character of the neighborhood, and improve the public health and welfare of the community. s.Has the alleged difficulty been self-created? { } Yes, or {X } No Why: The lot is only 6,771 sq.ft., the sanitary system and wetlands push the house into a very restricted building envelope and as far from the wetlands as is practical.
