NEIL WILLIAM CURRIE AND KATIE LYNN WATSON #7757 - Request for Variances from Article III, Section 280-15; Article XXIII, Section 280-124; and the Building Inspector's December 6, 2022 Notice of Disapproval based on an application for a permit to demolish an existing dwelling, construct a single family dwelling, and to legalize an existing shed (under 100 sq. ft.); at 1) dwelling located less than the code required minimum side yard setback of 20 feet; 2) dwelling less than the code required minimum rear yard setback of 60 feet; 3) "as built" shed located less than the code required minimum rear yard setback of 15 feet; located at: 1175 Champlin Place, Greenport,NY. The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposal is recommended as INCONSISTENT with the below LWRP policies. 6.1. Protect and restore ecological quality throughout the Town of Southold. Although this is a demolishing of an existing structure and rebuilding of a single-family residence on the same parcel,the proposed action would add more influence to the wetland water quality through the location of the dry wells and sanitary system. Setbacks to wetland systems preserve the functions and values those systems provide. This wetland provides valuable wildlife habitat. 6.3. Protect and restore tidal and freshwater wetlands. The as-built structures are recommended as inconsistent with the above policy. In the event the action is approved, it is recommended that the Board: 1. Clarify the note "non-turf on entire property" claim. 2. Trees on site should be preserved. 3. Vegetated buffers should be maximized. 4. Outdoor lighting should be minimized. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted,because: The proposed house is positioned at a greater distance from Champlin Place than the existing structure. The square footage of the proposed house, and design is consistent with the neighborhood. From the street,the variance requested would not be visible. The wetlands on the property reduce the buildable area on the parcel.The applicant has maximized the setback distance to the tidal wetlands,in accordance with a request from the Town Trustees. This includes the creation of a 15 feet non- disturbance buffer to the perimeter of the wetland boundary. This has resulted in the position of the proposed house being placed in the only practical location on the parcel, with the side yard setback being reduced to 10 feet. The Private Road/right of way that runs between the abutting properties on Bailey Avenue adds to the distance between the proposed house and the rear yards of the adjoining properties and is not used,in essence creating a buffer area. To the rear of the property is vacant woodland,now or formerly owned by Suffolk County. The requested reduced setback from the proposed home would therefore not have a direct impact on a neighboring residential home.I further understand that the woodland may not be developed,therefore reducing the likelihood of any detriment to the land resulting from the construction of the proposed home—the design of which is intended to focus on the front yard outlook. The variance requested for the existing shed is made with the understanding that no changes will be made to the existing structure, as covered by Building Permit#7255, issued by the Town of Southold Building Department on May 14a' 1974 (attached to this application for reference).The building permit was notated"10x10 no longer requires a BP or CO". 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: A 20 feet side yard setback would result in the proposed house being 10 feet closer to the wetlands on the East side of the parcel. The Trustees require that a 15 feet non-disturbance buffer be instated between the new house and the West perimeter of the wetlands(see survey for details). The available buildable parcel,with consideration to the wetlands,would therefore not allow the applicant to build a house without the granting of a variance to the setback requirements at the side and rear of the property. The proposed house is modest in size, and has been designed to minimize the variances sought. 3. The amount of relief requested is not substantial because: A 10-foot side yard setback is a conforming setback to a lot which is less than 20,000 square feet.While the subject lot is large in size,the majority of the parcel is wetlands. The upland area adjacent to the wetlands is 16,972 square feet—and therefore the reduced side yard variance does not appear substantial. For context,the total lot is 42,645 square feet,with wetlands covering 25,673 square feet. Furthermore, the existing house is setback only 13' from the side yard, and therefore the request is only for an additional 3' from the existing property line. Additionally,the Private Road area between the abutting houses on Bailey Avenue provides an additional buffer to the side yard. The rear yard setback of 18 feet is not substantial due to the shape of the upland area, specifically requiring the proposed home to be pushed as far to the rear of the property to create maximum setback from the wetland perimeter. The positioning of the house was moved towards the rear in discussion with the Trustees. The land adjoining to the rear is vacant woodland,and therefore a variance to the rear yard setback would not have a detrimental impact to a residential neighbor. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The setback to the wetlands has been maximized by the request of the rear and side yard variances. The proposed house is 10.9%of the adjacent area lot coverage, and proper drainage has been proposed. The existing house utilizes well water and a cesspool for waste water. The location of the existing sanitary system is approximately 30 feet from the wetlands. The proposed house will relocate the sanitary system,increasing the distance from the wetlands. The proposed sanitary system will be an advanced IA type(proposed model is CEN-5,manufactured by Fujiclean USA). The existing well water system, located in the accessory building, will be replaced with public water. 5.Has the alleged difficulty been self-created? { }Yes, or{X}No Why: The parcel is large; however,the wetlands have encroached on the property. As a consequence,the buildable area is limited by the wetlands. Are there any Covenants or Restrictions concerning this land?
