(631) 765-1809 SE)i 6 223 FINDINGS, DELIBERATIONS AND DETERMINATION Aoutthcold Town Clerk MEETING OF SEPTEMBER 21, 2023 ZBA FILE# 7820 NAME OF APPLICANT: Gregory And Kristina Couch PROPERTY LOCATION: 345 Reeve Ave, Mattituck,NY 11952 SCTM# 1000-114-9-6 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative,Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated June 16, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 16, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 64,825 square foot waterfront parcel located in the R-80 Zoning District. The parcel runs 88.11 feet along Marratooka Lake, runs 88.00 feet along Reeve Avenue, runs 747.32 feet on the North side and runs 730.54 feet on the South side. The parcel is improved with a two story frame house, a wood deck, and a one story frame garage and storage building. Part of the parcel is covered by wetlands. All is shown on a survey by Nathan Taft Corwin L.L.S., dated March 1, 2023. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's May 19, 2023 Notice of Disapproval based on an application for a permit to construct an accessory structure; at 1) less than the code required minimum side yard setback of 20 feet; located at: 345 Reeve Avenue, (Adj. to Marratooka Lake)Mattituck, NY. SCTM No. 1000-114-9-6. RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage located 10 feet setback from the side yard property line where code requires an accessory structure have a minimum 20 foot side yard setback. ADDITIONAL INFORMATION: In a letter dated August 15, 2023 the Board of Trustees stated that the proposed construction is not within their jurisdiction. The survey that was provided with the application shows an existing accessory structure that will be removed. Page 2,September 21,2023 #7820,Couch SCTM No. 1000-114-9-6 . FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 7,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhohood is a mixed neighborhood consisting of single family homes and a church. The lot is long and narrow and from the street it appears to be smaller than it is, given the excessive lot depth. The granting of the variance will not have any change on the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could build an accessory structure with a code conforming side yard setback. However, the lot is narrow and there is an existing house on the parcel. If the applicant builds the new garage with a code conforming side yard setback it will be partially placed behind the house which will make it difficulrt to manuver an automobile inside the garage. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 50% relief from the code. However, 20 foot side yard setback requirement is for a 64,825 square foot lot. The lot is long and narrow and partially covered by unbuildable wetlands. The proposed•non-conforming side yard setback is in scale with a 88 foot wide lot. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed accessory garage will be readily accessible from the street, and will be constructed further away from wetlands than the existing accessory structure. Furthermore, it will be used for storage, only. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage for storage, only, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes, seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the Architectural Plans by Robert 1. Brown, Architect, labeled A1,A2&A3, and dated June 20, 2023 . SUBJECT TO THE FOLLOWING CONDITIONS: 1. The subject accessory garage may be sheetrocked and heated; however, the subject accessory garage loft shall remain open rafters, unconditioned, and a non-habitable space. 2. Only.basic electric for lighting and a hose bib are permitted. No other utilities are allowed. Page 3, September 21,2023 #7820,Couch SCTM No. 1000-114-9-6 3. Prior to the issuance of the Certificate of Occupancy for the accessory garage proposed, the existing accessory structure, indicated to be removed as part of the project, shall be demolished and the Pre Certicicate of Occupancy extinguished for that structure. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals, failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVALS) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, siteplan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk, within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1) year terms.IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN.Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals Vote of the Board: Ayes:Members Planamento,Acampora, and Dantes(3-0)(Members Weisman and Lehnert Absent). is 17ament , Vice Chair ,Apping / p'2023 ISSUES/REVISIONS O Y N N O • t0 ZnF Ct s PRESBYTERMNN CHPARSONAGE N/0/F ,L v rn CHAD MELLO N/0/F ° N 88°46900" E MATTITUCK PARK DISTRICT Z MAY 17,2023 M • b O 1\ SIL TI IESE PLANS ARE AN INSTRUMENT OF SERVICE / • v• AL AND ARE THE PROPERTY OF THE ARCHITECT. ______ __ INFRINGEMENTS WILL BE PROSECUTED _ 2023 ALL RIGHTS RESERVED p.• I 1 STORY FRAME G AGE I ....
