POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to
briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be
given time at the conclusion of the regularly scheduled business agenda to address the Board on any given
topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of
the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are
available 1-2 days after the meeting. A full copy of the minutes, agenda and meeting video can be viewed by
going to the official Town of Southold website:

(1) Move pointer over "Government” on the Town website home page. You will find the title "Town
Supervisor/Town Board". Under this title you will see "Southold Town Board Meetings and Agendas". or
(2) Go to "How Do I", in the right upper corner of the Town website home page, Choose "Access", then
"Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the resolutions. (Scroll to
bottom of page for KEY to symbols). You can view the live video of the meeting by clicking on the camera
symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor's Executive Orders regarding the COVID-19 pandemic
in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and
streamed live on the Town's website. The meeting can be viewed live by going to the Town's website at
www.southoldtownny.gov <http://www.southtownny.goy> home page. Click on the "Government"tab, once
the drop down menu appears, under "Town Supervisor/Town Board", click on "Southold Town Board Minutes
and Agendas"which takes the user to the Town of Southold Meeting Portal page. Once on the Meeting Portal
page, click on the date of the meeting you wish to view and then click on "Video". A recording of the meeting
will also air on Channel 22 and will be posted on the Town's website

Clerk's office at (631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

Landfill Monitoring RFP

Coordinator to develop a request for proposals (RFP) for the monitoring of gas and groundwater at the

A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 245, Taxation"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to provide tax relief to volunteer fire department or incorporated voluntary
ambulance service members and/or spouses and Senior Citizens
II. Amendment.
The Southold Town Code is hereby amended by removing the struck through words and adding the underlined
words as follows:
Article I - Senior Citizen Exemptions
§ 245-1 Partial exemption for senior citizens.
A. Amount of exemption.
(1) Real property owned by one or more persons, each of whom is 65 years of age or
over, or real property owned by a married couple or by siblings husband an
w4-€e, one of whom is 65 years of age or over, shall be exempt from Town taxes to
the extent provided, subject to the following income limitations:

(2) Such exemption shall be computed after all other partial exemptions allowed by
law have been subtracted from the total amount assessed.
B. The real property tax exemption on real property owned by a married couple husband and wife, one of
whom is 65 years of age or over, once granted, shall not be rescinded solely because of the death of the
older spouse, so long as the surviving spouse is at least 62 years of age.

mean the"adiusted gross income" for federal income tax purposes as reported on the applicant's
federal or state income tax return for the applicable income tax year, subiect to any subsequent
amendments or revisions, plus any social security benefits not included in the such federal adiusted
gross income; provided that if no such return was filed for the applicable income tax year, the
applicant's income shall be determined based on the amounts that would have so been reported if
such a return had been filed; distributions from retirement and annuity accounts,including
Individual Retirement Accounts and Individual Retirement Annuities; and any such income shall be
offset by all medical and prescription drug expenses actually paid which were not reimbursed or
paid by insurance. Any tax-exempt interest or dividends that were excluded from the applicant's
federal adiusted gross income shall be considered income; and any losses that were applied to reduce
the applicant's federal adiusted gross income shall be subiect to the following limitations: the net
amount of loss reported on federal Schedule C,D,E, or F shall not exceed three thousand dollars per
schedule , the net amount of any other separate category of loss shall not exceed three thousand
dollars and the aggregate amount of all loses shall not exceed fifteen thousand dollars.
§ 245-2 Conditions.
No exemption shall be granted:
A. If the income of the owner or the combined income of the owners of the property for the income tax year
immediately preceding the date of making application for exemption exceeds the sum of$58,400 as
provided by local law pursuant to this section. Where the taxable status date is on or before April 14,
"income tax year" shall mean the twelve-month period for which the owner or owners filed a federal
personal income tax return for the year before the income tax year immediately preceding the date of
application. Where the taxable status date is on or after April 15, "income tax year" shall mean the twelve-
month period for which the owner or owners filed a federal personal income tax return for the income year
immediately preceding the date of the application. Where title is vested in a married person, ei

B. Unless the owner shall have held an exemption under this section for the owner's previous residence
or unless Unless the title of the property shall have been vested in the owner or one of the owners of the
property for at least twelve(12) 24 consecutive months prior to the date of making application for
exemption; provided, however, that in the event of the death of eider a married person husband of

a transfer by a married person eithef ., husband of wife to such person's spouse ise of all
or part of the title to the property, the time of ownership of the property by the transferor spouse shall be
deemed also a time of ownership by the transferee spouse, and such ownership shall be deemed continuous
for the purposes of computing such period of twelve (12) 24-consecutive months, and provided further
that where property of the owner or owners has been acquired to replace property formerly owned by such
owner or owners and taken by eminent domain or other involuntary proceedings, except a tax sale, the
period of ownership of the former property shall be combined with the period of ownership of the property
for which application is made for exemption and such periods of ownership shall be deemed to be
consecutive for purposes of this article. Where a residence is sold and replaced with another within one
year and both residences are within the state, the period of ownership of both properties shall be deemed
consecutive for the purposes of this article.
C. Unless the property is used exclusively for residential purposes.
D. Unless the real property is the legal residence of and is occupied in whole or in part by the owner or by all
of the owners of the property.
§ 245-3 Applications.
A. Applications for such exemption must be made by the owner or all of the owners of the property, on forms
prescribed by the commissioner State Beard, to be furnished by the appropriate assessing authority, and
shall furnish the information and be executed in the manner required or prescribed in such forms and shall
be filed in such Assessor's office on or before the appropriate taxable status date.
B. Any person who has been granted an exemption pursuant to this article on five consecutive completed
assessment rolls shall not be subject to the requirements set forth in Subsection A of this section; however,
said persons shall be mailed an application form by the Assessor and a notice informing him of his rights.
Such exemption shall be automatically granted on each subsequent assessment roll; provided, however,
that when tax payment is made by such person, a sworn affidavit must be included with the tax payment,
which shall state that such person continues to be eligible for said exemption. Such affidavit shall be on a
form prescribed by the commissioner State Beafd as provided by the Assessor. If such affidavit is not
included with the tax payment, the Receiver of Taxes shall proceed pursuant to § 551-a of the Real
Property Tax Law.
§ 245-4 Reapplications.
A. At least 60 days prior to the appropriate taxable status date, the assessing authority shall mail to each
person who was granted exemption pursuant to this article on the latest completed assessment roll an
application form and a notice that such application must be filed on or before taxable status date and be
approved in order for the exemption to be granted. The assessing authority shall, within three days of the
completion and filing of the tentative assessment roll, notify by mail any applicant who has included with
his application at least one self-addressed, prepaid envelope of the approval or denial of the application;
provided, however, that the assessing authority shall, upon the receipt and filing of the application, send by
mail notification of receipt to any applicant who has included two of such envelopes with the application.
Where an applicant is entitled to a notice of denial pursuant to this subsection, such notice shall be on form
prescribed by the commissioner State Beafd and shall state the reasons for such denial and shall further
state that the applicant may have such determination reviewed in the manner provided by law. Failure to
mail such application form and notice or the failure of such person to receive the same shall not prevent the
levy, collection and enforcement of the payment of the taxes on property owned by such person.
B. Notwithstanding any other provisions of this article, in the event that the owner, or all of the owners, of
property which has received an exemption pursuant to this article of the preceding assessment roll shall fail
to file an application for such exemption on or before the taxable status date, such owner or owners may
file, and the assessing authority shall accept the application, executed as if such application has been filed
on or before the taxable status date, if such application is filed with the assessing authority on or before the
date for the hearing of complaints.
§ 245-5 Penalties for offenses.
Any person that knowingly makes a false statement in an application under this chapter, or who knowingly
allows a person to make a false statement in an application under this chapter, and which application is filed
with the appropriate assessing authority, shall be guilty of a violation punishable by a fine of not to exceed
$1,000 or a period of incarceration not to exceed 15 days, or both such fine and imprisonment. Upon conviction
under this chapter, the person shall be disqualified from applying for an exemption under this chapter for a
period of five years from the date of conviction.
§ 245-6 Notice.
The assessing authority shall notify, or cause to be notified, each person owning residential real property in the
Town of the provisions of this article, such notice to be sent with each tax bill to such persons, and shall be in
such form and content as shall comply with the provisions of Subdivision 4 of§ 467 of the Real Property Tax
Law. A second copy of the notice required by this section shall be sent thirty days prior to the filing
deadline.
Article V -Exemption For Volunteer Fire Fighters And Ambulance Workers
§ 245-11 Exemption granted; amount; qualifications.
A. Qualifying residential real property, under § 466-e 466-a of the New York State Real Property Tax Law,
owned by an enrolled member of an incorporated volunteer fire company, fire department or incorporated
voluntary ambulance service, or such enrolled member and spouse residing in Suffolk County, shall be
exempt from taxation to the extent of 10% of the assessed value of such property for city, village, Ttown,
part Ttown, special district, county or school district purposes, exclusive of special assessments.
B. Such exemption shall not be granted to an enrolled member of an incorporated volunteer fire company, fire
department or incorporated voluntary ambulance service residing in such county unless:
(1) The applicant resides in the city, Ttown or village which is served by such
incorporated volunteer fire company or fire department or incorporated voluntary
ambulance service;
(2) The property is the primary residence of the applicant;
(3) The property is used exclusively for residential purposes; provided, however, that
in the event any portion of such property is not used exclusively for the
applicant's residence but is used for other purposes, such portion shall be subject
to taxation and the remaining portion only shall be entitled to the exemption
provided by this section;
(4) The applicant has been certified by the authority having jurisdiction for the
incorporated volunteer fire company, fire department or voluntary ambulance
service as an enrolled member of such incorporated volunteer fire company,
fire department or voluntary ambulance service as determined by the
2overnin2 body of a city, village, school district, fire district or county;
provided, however, that the applicant has at least two years of service. €ef at

It shall be the duty and responsibility of the governing body of each
municipality, school district and/or fire district to determine the procedure for
certification.
C. Any enrolled member of an incorporated volunteer fire company, fire department or incorporated
voluntary ambulance service who accrues more than 20 years of active service and is so certified by the
authority having jurisdiction for the incorporated voluntary fire company,-eT-fire department or
incorporated voluntary ambulance service, shall be granted the ten-percent-exemption as authorized by this
section for the remainder of his or her life, as long as his or her primary residence is located within the
Town of Southold.
D. Application for such exemption shall be filed with the Assessor or other agency, department or office
designated by the municipality offering such exemption on or before the taxable status date on a form as
prescribed by the commissioner State Beat .
E. Incorporated volunteer fire companies, fire departments and incorporated volunteer ambulance services
shall file lists of their enrolled members eligible for the exemption provided by this section with the
Assessor or other agency, department or office designated by the municipality offering such exemption on
or before the taxable status date on a form as prescribed by the commissioner State Beat.
F. No applicant who is a volunteer fire fighter or volunteer ambulance worker who, by reason of such status,
is receiving any benefit under the provisions of this article on the effective date of the section shall suffer
any diminution of such benefit because of the provisions of this section.
§ 245-12 Effective date.
This article shall take effect immediately upon filing in the Office of the Secretary of State and shall apply to
assessment rolls prepared on the basis of taxable status dates occurring on or after January 1, 2024 2005.
§ 245-13 Un-remarried Ted spouses of deceased volunteer fire fighters or ambulance workers.
Any exemption granted under § 245-11 to an enrolled member of an incorporated volunteer fire company, fire
department, or incorporated volunteer ambulance service shall be extended to such deceased enrolled member's
un-remarried mea spouse; provided, however, that:
A. For members of an incorporated volunteer fire company, fire department, or incorporated volunteer
ambulance service killed in the line of duty:
(1) Such un-remarried mea spouse is certified by the authority having
jurisdiction for the incorporated volunteer fire company, fire department or
incorporated volunteer ambulance service as an un-remarried mea spouse of a deceased
enrolled member of such incorporated volunteer fire company, fire department or incorporated
voluntary ambulance service who was killed in the line of duty; and
(2) Such deceased volunteer died in the line of duty and had been an enrolled member
for at least five years; and
(3) Such deceased volunteer had been receiving the exemption prior to his or her
death.
B. For deceased members of an incorporated volunteer fire company, fire department, or incorporated
volunteer ambulance service:
(1) Such un-remarried,,,,,-o,,,,,ffie,a spouse is certified by the authority having
jurisdiction for the incorporated volunteer fire company, fire department or
incorporated volunteer ambulance service; and
(2) Such deceased member had been enrolled for at least 20 years; and
(3) Such deceased member and un-remarried mea spouse had been
receiving the exemption prior to his or her death.
245-14 Applicability.
Section 245-13 shall apply to assessment rolls prepared on the basis of taxable status dates occurring on or after
January 1, 2024 2006.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

Laoudis LLC Sanitary Flow Credits
WHEREAS, the Town of Southold has established a Transfer of Development Rights Program whereby
Sanitary Flow Credits can be transferred into a TDR Bank from open space lands purchased by the Town of
Southold; and
WHEREAS the TDR Bank currently has credits on deposit from lands purchased by the Town of Southold that
are located within the Southold School District; and
WHEREAS an application for transfer of Sanitary Flow Credits was filed by Laoudis LLC seeking transfer of
1.61 credits to the property known as SCTM# 1000-61-4-22 located at 54280 Main Road in Southold, in the
Southold School District; and
WHEREAS the applicant seeks to utilize the credits on land designated as Hamlet Business District(HB) to
create one as built professional office, fitness studio and three (3) accessory apartments at the aforementioned
property; and
WHEREAS the applicant seeks to utilize the credits on land within a designated receiving area; and
WHEREAS the Town Board held a public hearing on the action on September 12, 2023, at which time all
persons were given the opportunity to be heard; and
WHEREAS the Town Board conducted a coordinated SEQRA review of the action, and issued a Negative
Declaration on September 26, 2023;
NOW, THEREFORE, BE IT
RESOLVED that the Town Board has evaluated the effects of the proposed transfer and finds that the district
contains adequate resources, environmental quality and public facilities, including adequate transportation,
water supply, waste disposal and fire protection, and further finds that that there will be no significant
environmentally damaging consequences and that such development is compatible with the comprehensive
planning efforts of the Town, and the Town Board incorporates the report of the Planning Board in support of
the application dated June 27, 2023; and it is further
RESOLVED that the Town Board of the Town of Southold hereby transfers one point six one (1.61) sanitary
flow credits from the Town TDR Bank to Laoudis, LLC for its development at 54280 Main Road, Southold,
SCTM# 1000-61-22; and it is further
RESOLVED that upon issuance of the Sanitary Flow Credit Certificate, the Town Clerk shall enter this
deduction of one point six one (1.61) sanitary flow credits from the Sanitary Flow Credit Log; and be it further
RESOLVED that the applicant shall receive a Sanitary Flow Credit Certificate, which shall not be signed by the
Supervisor and released by the Town Clerk to the applicant until the covenants and restrictions required by
Town Code Section 117-11 have been filed and such filing has been approved by the Town Attorney; and be it
further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the Land
Preservation Department, the Special Projects Coordinator and the Planning Department for inclusion into the
Town database and GIS system.

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County,New York,

A Local Law entitled, "A Local Law in relation to Chapter 17 - Community Preservation Fund and
Community Housing Fund"
I. PURPOSE
The purpose of this Community Housing Plan is to increase access and opportunities to fund the
creation and maintenance of a diversity of housing types in Southold Town and the Village of Greenport. In
addition, the Plan aims to foster management and outreach strategies to form public/private partnerships to
benefit all sectors of the Town's and Village's populations. The Plan provides goals and recommendations for
expanding community housing opportunities
in the Town of Southold and Village of Greenport and was prepared with input from the Town
appointed Community Housing Fund Advisory Board, Town Board, Town planners and members
of the public. The Plan builds upon the housing goals presented in the 2020 Town of Southold
Comprehensive Plan by utilizing data supplemented with a housing needs analysis based upon
available socioeconomic census data and public input received through a Housing Survey.
II. §17-52 Community Housing Fund
