Project Description: Erect a temporary snow fence separating private property
from a Town Beach, to be 20 ft. from apparent MHW.
Findings: The Board of Trustees DENIES the application as submitted. The
project does not meet the requirements for issuance of an Administrative Permit
set forth in Chapter 275 of the Southold Town Code. Southold Town Code
Chapter 275-11A. (4)(b) Temporary or seasonal snow fences, at the Trustee's
discretion, may be permitted upon a showing of need for erosion control.
No need for erosion control has been demonstrated. To the contrary, an
accretion of sand was observed by the Board in the subject area. Applicant
already enjoys a split-rail fence. Southold Town Code Chapter 275-12. A.
Adversely affect the wetlands of the Town. D. Adversely affect fish, shellfish or
other beneficial marine organisms, aquatic wildlife and vegetation or the natural
habitat there of, and J. Adversely affect the aesthetic value of the wetland and
adjacent areas.
Any other activity within 100' of the wetland boundary requires a permit from this
office.
This is not a determination from any other agency.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is
my recommendation that the action is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
