Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280,Zoning"

BE IT ENACTED by the Town Board of the Town of Southold as follows:' `
I. PURPOSE
The Purpose of the amendment is to update'the Southold Town Code in regard to R.ental.Permits.
H. AMENDMENT
The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
§ 280-4 Definitions.
A. Word usage. Words used in the present tense include the future: the singular number
includes the plural, and the plural the singular;the word "person" includes a corporation as
well as an individual; the word "lot" includes the word "plot'"; the term "occupied" or
"used," as applied to any building, shall be construed as though followed by the words or
intended, arranged or d6signed to be occupied or used."
B. Definitions and usages. Unless otherwise expressly stated,the following terms shall, for the
purpose of this chapter,have the meanings as herein defined. Any word or term not noted
below shall be used with a meaning as defined in Webster's Third New International
Dictionary of the English Language, unabridged (or latest edition).

III. SEVERABILITY
If any clause, sentence,paragraph, section,or part of.this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

The Purpose of the amendment is to update the Southold Town Code in regard to Rental Permits.
II. AMENDMENT
The Southold Town Code is hereby amended by removing the struck through words and adding the underlined
words as follows:
§ 280=4 Definitions.

and the plural the singular; the word "person" includes a corporation as well as an individual; the word
"lot" includes the word "plot"; the term "occupied" or "used," as applied to any building, shall be construed

Permits: Transient Rental Amenities
Thank you for providing us with an opportunity to comment on this proposed code amendment.
Our understanding is that this definition and prohibition are being added to the code to better
protect the community character of Southold Town.
Consistency with the Comprehensive Plan:
This amendment is consistent with the Southold Town Comprehensive Plan. Renting-amenities .
for profit in residential neighborhoods changes the essential character of those neighborhoods.
They become quasi-commercial properties with the inherent impacts that come with commercial
activity, including noise, traffic, and a general disturbance of the quality of life that neighbors
expect in a residential area. Renting amenities in commercial districts can likewise have a
negative impact on traffic and create safety concerns where renting of the amenity is not part of
the regular business plan or approved site plan for the commercial property.
The Planning Board supports the change to the code because the prohibition of these transient,
rental amenities will mitigate these concerns.

I. Purpose
The Purpose of the amendment is to update the Southold Town Code in regard to Rental Permits

The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:
§ 280-4 Definitions.
A. Word usage. Words used in the present tense include the future: the singular number

well as an individual; the word "lot" includes the word "plot"; the term "occupied" or
"used," as applied to any building, shall be construed as though followed by the words "or
intended, arranged or designed to be occupied or used."
B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the
purpose of this chapter, have the meanings as herein defined. Any word or term not noted
below shall be used with a meaning as defined in Webster's Third New International
Dictionary of the English Language, unabridged (or latest edition).
TRANSIENT RENTAL AMENITY
The rental of any parcel amenity, accessory use or yard area, including pools, barns (except
for storage only purposes), sports courts or waterway access, not in conjunction with a
valid dwelling or dwelling unit rental occupancy permit.
TRANSIENT RENTAL PROPERTY
(3) The foregoing presumption may be rebutted by evidence presented to the Code
Enforcement Officer for the Town of Southold or Town Justice that the dwelling unit is not
a transient rental property.
§ 280-111 Prohibited uses in all districts.
J. Transient rental properties and transient rental amenities.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
