3 COUNCILMAN GREG DOROSKI : So the
4 first public hearing tonight is for a
5 transfer of flow credits . In my folder
6 here , I have a proof of mailing of the
7 Public Hearing to the adjacent owners
8 from the attorney Pat Moore ' s office . I
9 have affidavit of publication from the
10 Suffolk Times , along with a copy of the
11 ad itself . I have a copy of the
12 affidavit signed by our Town Clerk,
13 Denis Noncarrow, that it was posted on
14 the bulletin board in the back . I have a
15 copy of the resolution itself . I have a
16 copy of the sanitary flow credit
17 application here . I also have a memo
18 from the Planning Board, citing that
19 this is an eligible project . And that ' s
20 what I got .
21 SUPERVISOR SCOTT RUSSELL : I would
22 like to invite anybody that would like
23 to comment on this particular local law.
24 PATRICIA MOORE : Patricia Moore on
25 behalf of the Laoudis Family . The goal

1 here is my clients applied to replace
2 the sanitary system to a conforming IA
3 system, but as part of that process , the
4 building which has housed the same
5 tenants for 20 years or so, the flow as
6 you know, when you ' re dealing with
7 Zoning versus Health Department , the
8 Health Department felt that our
9 grandfathered flow was -- could not
10 justify the flow that ' s required for the
11 existing businesses . It ' s primarily the
12 businesses because the apartments
13 predate the ' 81 sanitary code , but the
14 businesses come and go . And the
15 businesses that we have there in total
16 flow required the application for
17 sanitary credits . So that is the
18 request that ' s been made . And I hope
19 you will approve it so that we can move
20 forward and do what everybody ' s asking
21 us to do, which is upgrade our sanitary
22 system. So I can answer any questions ,
23 if you have them?
24 SUPERVISOR SCOTT RUSSELL : They
25 don ' t let you double the pre-existing

1 existing sanitary flow credits?
2 PATRICIA MOORE : No . That ' s not
3 the way it works . And it ' s funny
4 because retail has a lower sanitary flow
5 than office and a gym.
6 SUPERVISOR SCOTT RUSSELL : Yes .
7 Because you say it ' s a very , very dry
8 uses there . I ' m surprised.
9 PATRICIA MOORE : Yeah , and if we
10 had been given an opportunity to show
11 them how much flow is actually produced
12 there , you -- they probably , you know,
13 would justify significantly less than
14 what the Health Department by statute
15 claims is produced .
16 COUNCILWOMAN JILL DOHERTY : We ' re
17 waiting for all the information to come
18 back in the whole process , and we don ' t
19 have it all . So that ' s why we can ' t
20 close the hearing .
21 PATRICIA MOORE : Oh, thank you .

4 LOCAL LAW CHAPTER 189 & 260
5 COUNCILMAN GREG DOROSKI : So the
6 second public hearing tonight is , we
7 have amendment to Chapter 189 , Parking
8 and Chapter 260 , Vehicles and Traffic in
9 connection with parking on Luther ' s
10 Road, also known as Breakwater Road and
11 Naugles Drive in the Hamlet of
12 Mattituck . The purpose of the amendment
13 is to improve safety for emergency
14 vehicles , pedestrian and passenger
15 vehicles , as well as , dealing with
16 impacts to public health , safety and
17 welfare . Resulting from vehicles
18 parking and standing on a portion of
19 Luther ' s Road, also known as Breakwater
20 Road and Naugles Drive in the Hamlet of
21 Mattituck . In the folder here , I have an
22 affidavit of publication in the Suffolk
23 Times , along with a copy of the ad, a
24 copy of the legal notice . A copy of the
25 affidavit that it was posted on the Town

7 to invite anybody that would like to
8 comment on this particular Local Law?
9 STEPHEN KIELY : Good evening, Town
10 Board. Stephen Kiely . I ' m here on behalf
11 of the Mattituck Park District . I ' m the
12 attorney for the Mattituck Park
13 District . And first and foremost , I want
14 to wish the esteemed Town Clerk a Happy
15 Birthday . So I want to, on behalf of
16 the Mattituck Park District
17 commissioners , we have two of them here
18 tonight , thank you for considering this
19 and putting it up for Public
20 Hearing . Breakwater Beach for the past
21 couple of years has been overwhelmed by
22 non-Southold residents . Who not merely
23 used the beaches , which they use the
24 beaches , we probably wouldn ' t have
25 gotten to this point , but have abused

1 the beaches . We ' ve had overnight
2 camping . We ' ve had overfishing . We ' ve
3 had littering . We ' ve had defecating ,
4 urinating , drinking, and destroying the
5 piping clover areas . The Mattituck Park
6 District took three steps to ameliorate
7 this . One , they recaptured all of their
8 property by moving the gate to the edge
9 of their property . To make sure only
10 residents parked on our property . They
11 hired a security guard because the gate
12 attendants were being verbally abused or
13 ignored. And we made fishing on our
14 property, fishing by permit only for
15 residents . So I thank the Board again
16 for putting this out there , because it
17 is -- it will create one more hurdle
18 towards the , again , overwhelming of all
19 beach . So thank you .

6 the DEC has been a big help . And this
7 was like the last piece of the puzzle .
8 So we ' ve had all agencies involved. We
9 had County . We had State . And again, you
10 know, Scott was gracious enough to host
11 the meeting with all the interested
12 parties . We got together . And again,

7 completes the business of the agenda ,

9 COUNCILWOMAN JILL DOHERTY : Yes .
10 SUPERVISOR SCOTT RUSSELL : I am
11 going to invite anybody that would like
12 to comment on any issues , please feel
13 free? Peter?
14 PETER HARRIS : Good evening ,
15 Supervisor, Town Board. Peter Harris ,
16 212 Knapp Place , Greenport . I was here
17 roughly two plus years ago . Requesting
18 for sidewalks to be replaced in the
19 greater Greenport area, Knapp Place ,
20 Bailey Avenue , Sterling, Champlain, and
21 on Main Street , which the Main Street
22 sidewalk area was . And I was kind of led
23 to believe that the following year more
24 work was going to be done . And two
25 years has passed. In fact , the following
SEPTEMBER 12 , 2023 REGULAR MEETING 11
1 year, I spoke to Councilwoman Doherty,
2 and said, so when are we getting on with
3 sidewalks? And they said, well , now we
4 have a new way of doing things . That
5 we ' re not putting any new sidewalks in
6 until we do drainage and what have you .
7 And I said, oh, okay . However, on all
8 the various streets that I just spoke ,
9 we have cement curbing . Drainage is in
10 place . And people are still walking in
11 the street because the sidewalks are in
12 terrible condition . Like I just said,
13 three years later, I would like to know
14 what happened? You know, what ' s --
15 what ' s going on with the sidewalk
16 program?
17 SUPERVISOR SCOTT RUSSELL : We ' ll
18 certainly find out from the Highway
19 Superintendent and the Town Engineer .
20 Happy to talk to him about it .
21 PETER HARRIS : I believe -- I
22 believe the sidewalks -- new sidewalks
23 is a -- that ' s a Town -- that ' s a Town
24 Board thing, that I guess it would go
25 through the Town Engineer . Because when

1 back when I was Highway Superintendent ,
2 it wasn ' t -- it wasn ' t through me . It
3 was replacement of long stretches of
4 sidewalk. It was a -- that was it --
5 That ' s a Town Board issue . So that ' s why
6 I am -- I am here . I would have --
7 sorry, I kind of walked in late , but my
8 wife and I were babysitting for one of
9 our grandchildren and he finally got
10 picked up in time that I was able to
11 catch the tail end and be able to speak
12 to you tonight .
13 SUPERVISOR SCOTT RUSSELL : There
14 are three people that have been leading
15 the sidewalk restoration program
16 throughout the Town . That would be the
17 Highway Superintendent , the Town
18 Engineer and the Deputy Highway
19 Superintendent . And, you know, frankly,
20 I think they ' ve done a great job . As you
21 know, sidewalks are expensive . Drainage
22 is expensive . And they ' ve been going
23 around getting -- getting that punch
24 list on one at a time . If yours is ready
25 to go without the need for all that

1 infrastructure , we ' ll certainly bring it
2 to their attention . The capital budget
3 gets funded every year . In fact , there ' s
4 $250 , 000 from last year they get carried
5 over .
6 PETER HARRIS : Well , Scott , as
7 you -- I don ' t know if you recollect ,
8 one of the things that really set me off
9 was the fact that on Depot Lane , we put
10 a considerable distance of sidewalk in
11 front of a farm field . And I ' m not
12 saying that it ' s not used, but I would
13 be willing to bet those side -- that
14 sidewalk in front of a farm field is
15 used a whole lot less than in a
16 residential area that has kids and
17 older -- older people trying to
18 navigate , tipped up broken sidewalks . So
19 again, I ' m not just trying to play
20 better homes and garden beautification
21 purposes . It ' s a safety situation .
22 SUPERVISOR SCOTT RUSSELL : I think
23 there ' s not a member on this Board that
24 would disagree with you with regard to
25 the lack of value or the lack of

1 emphasis or importance that sidewalk or
2 that stretch should have played in the
3 decision making . A farm field and a
4 cemetery, either of which produced much
5 pedestrian traffic . That was a very,
6 actually, it ' s a nice sidewalk and
7 probably not a necessary one . There ' s
8 just nobody that lives along that road
9 to justify that . I agree 100% . That was
10 done a few years ago . Previous people
11 making decisions at that time .
12 PETER HARRIS : I understand that . I
13 will --
14 COUNCILWOMAN JILL DOHERTY : If the
15 Board wishes , I ' ll speak to Michael
16 Collins on behalf of the whole Board and
17 ask him where it is on the priority list
18 and to go take another look at it and
19 hopefully move it up on the priority
20 list , and I ' ll get back to you , Mr .
21 Harris .
22 PETER HARRIS : And I will
23 definitely speak to Dan and Michael in
24 the Highway .
25 COUNCILWOMAN JILL DOHERTY : That

1 will help , too .
2 PETER HARRIS : I have a very good
3 rapport with both gentlemen . One was a
4 former employee of mine . And Dan , I
5 think, is doing a terrific job as
6 Highway Superintendent .
7 COUNCILWOMAN JILL DOHERTY : And the
8 two of them have a great relationship,
9 as well .
10 PETER HARRIS : But again , I just
11 needed to come here and put it out there
12 again . Because the fact of the matter
13 is , is that it ' s long overdue and, thank
14 you for your time .
15 SUPERVISOR SCOTT RUSSELL : Thank
16 you . Who else would like to address the
17 Town Board on any issue? Yeah , Nick?
18 NICHOLAS DEEGAN : Good evening . On
19 sidewalk issue , also --
20 DENIS NONCARROW: Name , Nick?
21 NICHOLAS DEEGAN : Nicholas
22 Deegan , Mattituck. It has to do with
23 the sidewalk issue also . On the southern
24 side of coming through Mattituck and
25 from Chase Bank, there ' s intermittent

1 pieces of sidewalk and then it stops and
2 then it starts . And so I was wondering
3 if there could be a continuation where
4 we ' d have a continuity with the sidewalk
5 on the south side of Route 25A -- Route
6 25? As you proceed from Chase Bank into
7 the -- around the curve , up to Love
8 Lane , that area . Because it stops and
9 starts , and then there ' s very narrow
10 spots where you have to walk through .
11 Just like , you know, it ' s -- it was all
12 nice and flat it ' d be nice , but it ' s
13 not . It ' s just a danger actually what
14 said. So we ' re trying to get people out
15 to walk. So it would be nice if we have
16 a continuous sidewalk . I know they had
17 the Highway Department , they did a great
18 job on . Kind of a boulevard with the
19 sidewalks and repairing, but we could
20 use that along the road to, you know,
21 make people -- give people a chance to
22 walk more . Thank you .

3 is a State roadway . So we ' ll have to
4 petition the State to have that done ,
5 but I ' m sure that we could draft a
6 letter and ask for that to be done .
7 NICHOLAS DEEGAN : It ' d be -- it ' s
8 -- there ' s some nice parts of it , but
9 other parts have no sidewalk at all .
10 COUNCILWOMAN SARAH NAPPA: Right .
11 NICHOLAS DEEGAN : So they ' ve been
12 walking in the grass and on the debris ,
13 and so on and so forth . And you know,
14 you can twist the knee there very
15 quickly .
16 SUPERVISOR SCOTT RUSSELL : Thank
17 you . Who else would like to address the
18 Town Board? Please?
19 STEPHEN KIELY : Stephen Kiely from
20 Mattituck . Just wanted to briefly talk
21 about or ask about Zone Code . It ' s my
22 understanding on September 12 , 2022 , the
23 Town entered into a contract with Zone
24 Code to rewrite or amend the Zoning Code
25 in line with the Comprehensive Plan

1 update to the tune of $183 , 500 . On
2 November 15 , 2022 , at a Town Board Work
3 Session, there was a zoning update
4 kickoff , and a diagnostic report , which ,
5 and I quote , "would be a 60-day process
6 was supposed to be issued. " Eight months
7 later, there ' s no diagnostic report . And
8 then I was at a Mattituck Civic
9 Association meeting on August 28th, and
10 Councilman Mealy was there , and he
11 mentioned that there was some pushback
12 from the consultant . So I just wanted
13 to know --
14 COUNCILMAN BRIAN MEALY : That ' s
15 incorrect . I said that we had some very
16 tough questions for them, and there was
17 a back and forth . So please don ' t
18 construe my words .
19 STEPHEN KIELY : It ' s a quote ,
20 Councilman .
21 COUNCILMAN BRIAN MEALY : I don ' t
22 remember saying that .
23 STEPHEN KIELY : So I ' m asking the
24 Town Board just what the status is on
25 that diagnostic report and where we are

1 with the consultant?
2 SUPERVISOR SCOTT RUSSELL : We ' ll
3 get you an update from the Director of
4 Planning tomorrow.
5 STEPHEN KIELY : Okay . And then
6 just two other things on the same point .
7 SUPERVISOR SCOTT RUSSELL : While
8 we ' re at it , it ' s a good time to
9 advertise to the public . We actually
10 have ads , we ' ve ran for a Zoning
11 Advisory Committee . And I would urge
12 anybody that would have an interest to
13 certainly apply . The responses weren ' t
14 as numerous as I thought there would be .
15 So we ' re urging the people to apply .
16 COUNCILWOMAN JILL DOHERTY : Get
17 involved.
18 STEPHEN KIELY : That ' s a great
19 idea, and I welcome that . But I did a
20 little research once I heard that there
21 was a little pushback . So in
22 Purcellville , Virginia, which is in
23 northern Virginia, they use the same
24 company . And I believe the Town Board
25 should really look into it because it ' s

1 a cautionary tale with this company .
2 I ' ll just read a few quotes from their
3 local paper . At the end of the day, and
4 this is coming from the Town Supervisor .
5 "At the end of the day, I ' ve asked this
6 question, who is the customer? If we
7 have multiple customers and multiple
8 interests , we ' ll have meetings like
9 this . We need to clearly define that the
10 Planning Commission is the customer . The
11 Comprehensive Plan is the statement of
12 work, and the vendor, ZoneCo, needs to
13 comply with the Comprehensive Plan . End
14 of story . " Also they prepared a map
15 that was -- they prepared their own map ,
16 even though the Comprehensive Plan had a
17 draft map . And here ' s another quote , "we
18 should not have a vendor coming up with
19 creative maps . The Comprehensive Plan
20 clearly states what the map is , don ' t
21 you agree? I ' ve seen it a thousand
22 times . If I have a vendor come in that
23 is clearly not going with my statement
24 of work, it is wasting my time . " And
25 then further , "the map is confusing . We

1 can describe it a thousand different
2 ways . I ' ll walk away being confused. "
3 And then just lastly, we ' re essentially
4 being told don ' t bother us , and it
5 didn ' t feel good. And this is again
6 about ZoneCo . I don ' t know the veracity
7 of it .
8 COUNCILWOMAN JILL DOHERTY : Just to
9 make it clear, you ' re not talking about
10 Southold Town . You ' re talking about the
11 consultant?
12 STEPHEN KIELY : The consultant ,
13 correct .
14 COUNCILWOMAN JILL DOHERTY : But not
15 in regard to Southold Town, in regard to
16 the place --
17 STEPHEN KIELY : Yeah, this is all
18 coming from the Northern Virginia Town
19 that used them in the past .
20 COUNCILWOMAN JILL DOHERTY : Thank
21 you .
22 STEPHEN KIELY : Yep . And then just
23 for one , for instance , in ZoneCo ' s draft
24 map , a proposed trail oriented district ,
25 which would add commercial office and

1 apartments to an area that would not be
2 in line with the Comprehensive Plan .
3 Multifamily housing is not allowed in
4 this district . And the development is
5 supposed to be in line with the existing
6 neighborhoods . So I just want the Board
7 to take that into account , if you choose
8 to go forward with this consultant . And
9 lastly , if you go onto their website ,
10 they talk about what they do . And they
11 say they provide a unique focus on the
12 intersection of the disciplines of law
13 and planning to craft custom tailored,
14 clear, consistent , user friendly,
15 equitable , and defensible zoning . And
16 then they say, outcomes must include a
17 focus on racial , economic , and
18 environmental equity and justice . And I
19 was just curious , I ' ve never heard that
20 in terms of zoning . So I looked into --
21 further into their website . Because at
22 that work session, they did reference
23 custom tailored, clear, consistent , user
24 friendly, defensible , but they didn ' t
25 say anything about equity . And that just

1 says that Equitable Zoning Advisory
2 Committee , which is part of the company
3 that reviews all that work, recognizes
4 and acknowledges that zoning has been
5 misused since its inception to
6 perpetuate inequitable outcomes for many
7 minority populations , as well as ,
8 socially and economically disadvantaged
9 populations . And then they have the
10 Zoning Advisory Committee that reviews
11 all zoning, proposed zoning amendments
12 that come out of that office . The
13 Equitable Zoning Advisory Committee will
14 play a key role in consulting on
15 Planning and Zoning projects for our
16 communities throughout the United
17 States . So I just would want some
18 clarification on what that
19 means . Because from my understanding ,
20 they did a lot of work in cities , and I
21 see a lot of high density . So I just
22 want that to be taken into account with
23 this consultant . Thank you .

2 just -- as I got here late , I ' m just
3 thumbing through the agenda , and I ' m
4 just taking notice at the Resolution
5 778 , the appointment of Jamie Bednoski
6 to the position of Highway Labor Crew
7 Leader . Couldn ' t have been a better
8 choice . Couldn ' t have been -- again ,
9 another guy I hired. But he will be a
10 total asset to that department and this
11 township . And lastly , I want to thank
12 Scott , you, and Jill for your presence
13 last night . I don ' t know if any of the
14 other Board members was at the 9-11
15 Memorial last night on Peconic Lane
16 here . We never should forget .
17 COUNCILWOMAN JILL DOHERTY : It was
18 disappointed that a lot more people
19 didn ' t make it . Because we need to keep
20 going to that so we visibly see and not
21 forget .
22 PETER HARRIS : Well , the fact of
23 the matter is , it ' s nice to see the
24 children .
25 COUNCILWOMAN JILL DOHERTY : Yes ,

2 PETER HARRIS : Yeah . My grand -- my
3 little granddaughter was . In fact , I
4 was there with the screwdriver making a
5 hole . And she ' s putting the flags in the
6 ground . But the fact of the matter is ,
7 the people that do show, they remember .
8 And just , it wasn ' t a holiday . A little
9 taken back amount of people wanting to
10 go over and play Pickleball . That was
11 kind of more -- I guess , to some people
12 that was more important than being
13 what ' s going on the other side of the
14 street . But I just , as a 52-year member
15 of the fire department , son that just
16 retired 20 years FDNY , his first day on
17 the job is 9-11 on the street . Just
18 thank you for being here . Thank you .

22 thing I should have mentioned, I focused
23 yesterday when I spoke on the victims on
24 9-11 . One thing I forgot to mention, I
25 regretted it later , was that we ' re still

1 -- this country still seeing victims
2 every day . People are dying, veterans
3 -- I ' m sorry people are dying every day .
4 Firefighters , first responders , EMTs .
5 And to have to go before Congress and
6 struggle to get funding, it ' s just
7 absolutely abhorrent . It ' s a very , very
8 dark commentary on Washington politics
9 right now.
