County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply
dated April 25, 2023 stating that this application is considered a matter for local determination as there appears to be
no significant county-wide or inter-community impact.
LWRP DETERMINATION.-I"ImON. The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPI ARTY FAC I'SIDESCRIPTION.° The subject property is a 52,272 sq. ft. non-conforming parcel located in
an R-80 Zoning District. The property has a road frontage of 115.00 feet along Soundview Avenue,then turns north
for 522.6 feet to Long Island Sound, it then turns east for 115.61 feet along Long Island Sound, before returning back
south for 527.71 feet back to Soundview Avenue. The property is improved with a one-story brick residence, along
with various retaining walls throughout the property. There is also an existing accessory garage on the property, all
as shown on survey prepared by Nathan Taft Corwin, 1II, L.S., last revised March 23, 2023.
BASIS OE A Request for Variances from Article III, Section 280-15; Article XXII, Section 280-
116A(l), and the Building Inspector's February 23, 2023, Amended March 27, 223 Notice of Disapproval based on
an application for a permit to construct an accessory swimming pool; 1) located iri other than the code permitted rear
yard; 2.) located less than the code required 100 feet from the torp of the bluff; located at: 17975 Soundview Avenue,
Southold, NY. SCTM No. 1000-51-1-7.
R.L,1 ILI' RI,C lUI'STED: The applicant requests variances to place an accessory in-ground swimming pool 96 feet
from the bluff, where 100 feet minimum is required. The pool will be placed in the side yard where a rear placement
or front yard placement on waterfront properties is permitted.
ADDIT[ONAI_ INFORMATION: During the public hearing, the agent for the applicant stated that only a small
portion of the proposed pool is to be located closer than 100 feet from the bluff due to the contours of the top of the
bluff. Also, the pool cannot be placed in the front yard due to the location of the sanitary system.

The Zoning Board of Appeals held a public hearing on this application on July 6,2023 at which time written and
oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and
surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law §267- QJCb1(_1 Grant of the variances will riot produce ail undesirable change in the character of
the neighborhood or a detriment to nearby properties. Tile pool has only a small portion located within the 100 R
bluff setback. The neighboring property to the east also has a pool located in the side yard, This neighborhood has
properties on either side of the subject property with accessory swimming pools in other than the front yard.
Therefore, this proposed accessory pool will not have any adverse impact or produce ail undesirable change in the
character of the neighborhood. In addition, the proposed pool will be set back Frorn the public street more than 250
feet and will be screened by an existing hedge row.
2. Town Law §26L-b3ILb 2 The benefit Sought by the applicant cannot be achieved by some method feasible

for the applicant to pursue,other than an area,variance. In order to keep the pool located close to the house, it would
have to be in the side yard, which would require variance reliel, Also due to the,contour of the bluff, a small portion
of the pool would have to be within the 100 feet setback. Moving the pool back farther from the bluff would put it
too close to the existing accessory garage located in the conforming front yard.
3. Town Law §267-b S b 3 - The variances granted herein are mathematically Substantial, tile placement of the
pool in the side yard represents a 100% relief from the code.The setback from the bluff represents a.04% relief from
the code for a small portion of the Pool, FlOwever, there is a precedence for pools in the side yard in this
neighborhood, the neighboring property to the east has a pool in the side yard. This pool complies with all the
setbacks, from the property lines, and the bluff setback is for a very :,small portion Of tile 13001.
4. 'rown Law `267-b 3 b 4'. No evidence has been Submitted to Suggest that a variance in this residential
con-ullunitV will have ail adverse irnpact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the '['own's Storm Water Management Code and the conditions of this
board.
5. Town Law �26Z-h 3 t)A"5)_ The diffiICLdt�' has been self-ci-cated. The applicant purchased the parcel after the

limitations on the use of the parcel under the Zoning Code in effect prior to or at the time Of purchase,

applicant to enjoy the beriefit of an accessory swimming pool while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.

York`Town 1-aw 267-B, rnotion was offered by Member Lehnert, seconded by Member Weisman(Chairperson), and
duly carried, to
GRANT the variances as applied for, and shown on a survey prepared by Nathan Taft Corwin, 111, L.S., last
revised March 23, 2023.
SUBJECT TO THE FOLLOWING LONDFUIONS,
1. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be
contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for
accessory structures
2. Drywell for in-ground swimming pool de-watering shall be installed,

not increase the degree of nonconformity.
