En-Consultants on behalf of WALTER R. MILLER, JR. requests a Wetland Permit to remove existing steps
and wood railing along cleared walking path, and construct a 4' by±64' long timber bluff stairway consisting of
4'x4' entry steps and a 4'x8' entry landing, 4'x16' steps, 4'x4' landing, 4'x18' steps, 4'x4' landing, and 4'x10'
steps; and restore existing pathway and areas of existing vegetation disturbed or lost during construction with
shade-tolerant native vegetation. Located: 2398 Hyatt Road, Southold. SCTM# 1000-54-1-16
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the action is CONSISTENT with LWRP
Policy 6.3 and, therefore, CONSISTENT with the LWRP.
The following is recommended to further 6.3 Protect and restore tidal and freshwater wetlands.
1. Minimize irrigation and fertilization with the creation of wide vegetated buffers.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

To migate potential impacts associated with the disturbance of bluff soils and vegetation during construction of the proposed stairway,
the stairway location was chosen specifically to avoid the removal of any healthy,mature trees.Additionally,the existing cleared
pathway down the bluff and any areas of existing vegetation damaged or lost during construction are to be restored with shade-tolerant
native plantings.And there are no vegetated wetlands located on or adjacent to the bluff,but to maintain and encourage the growth of
vegetation beneath it,the stairway will be elevated a minimum of 3 feet above the bluff face.These various design features are intended
both to minimize the potential for bluff erosion and to protect the quality and function of the ecosystem comprised of the bluff and
adjacent beach,shoreline, and tidal waters of Long Island Sound,thus making the project consistent with both Policies 4 and 6.
