Located: 58670 County Road 48, Greenport. SCTM# 1000-44-4-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-builts are INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. What is the natural feature? In 1999 a permit(4968)was issued for a shed, 16'x20' stairs and 3'x7' steps. The shed is to be used as a shed and revegetated. 1. The wood deck does not comply with the permit and should be removed/modified to meet the past permit condition. Require revegetatlon of the area if the deck is removed 2. The stair does not comply with the permit and should be modified to meet conditions. Require revegetation of the area if the stair is removed A large amount of as built ignores the permit and the "in-place in-kind" notation that is the standard for this area due to the many decks on the bulkheads The area is a FEMA velocity hazard and structure should not be expanded especially without permits. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-builts are INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. The as-built clearing is Inconsistent with policy 6.3 the LWRP. Revegetation should be limited to native, deer resistant and drought-tolerant vegetation. Trees should be included in the revegetation plan. The area should not be landscaped. 6.3 Protect and restore tidal and freshwater wetlands. 1. Reduce the area of irrigation and fertilization-dependent landscaping. 2. Preserve existing trees on site=the clearing of trees within 100' of a tidal wetland is not consistent with LWRP policies. 3. Note the buffer restrictions as outlined in a past LWRP CCR. 2. Require that the NYSDEC 40'Non-Disturbance buffer and 25'foot wide buffer seaward from the structure noted on the survey be memorialized in a Covenant and Restriction filed with the Office of the Suffolk County Clerk. NYSDEC Permit ID 1-4738-03928. 3. Note that a 50'wide buffer was required by the Board of Trustees in Wetland Permit 7475 issued in 2011. In 2011 the Board may have reduced the non-disturbance buffer to 25' under permit 7475. Was the NYSDEC non-disturbance buffer width reduced?
