i. Final survey of property with accurate location of all buildings, property lines,
streets, and Unusual natural or topographic features.
2.Final Approval from Health Dept. of water supply and sewerage-disposal(s_9 form).
3.Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code C,~pliance from archiuect or engineer
responsible for the building.
6.Submi~ Planning Board Approval of completed'site plan requirements.

Appeal No. 4007:
Application of JOHN AND JACQUELYN GARRY. Variance to the
Zoning Ordinance, Article IIIA, Section 100-30A.4 for permission
to locate accessory gazebo structure in an area other than the
required rear yard. Location of Property: 1285 Breakwater
Road, Mattituck, NY; County Tax Map Designation
1000-106-08-48.
WHEREAS, a public hearing was held on March 22, 1991, at
which time all those who desired to be heard were heard, and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is a triangular-shaped parcel
of land located along the westerly side of Luthers (Breakwater)
Road, Mattituck, Town of Southold, containing approximately
40,000 sq. ft. in area.
2. The subject premises is improved with a single-family
dwelling structure situated 65 feet from the front property line
along Breakwater Road.

Thank you for your letter dated November 20, 1990
in which you mention that someone brought to your attention that
we have constructed a gazebo on our property.
For your information, we did not construct a gazebo. We
purchased the gazebo about 3 months' ago from Doroski's Nursery
Inc. on the North Road. They delivered it to our home and placed
it on the property. It is not permanently affixed and can be
moved quite readily.
It was our understanding that this movable gazebo did not
fall within the definition of structures for which a building
permit is required. As regards to the gazebo itself, since we
purchased it from a reputable business in Southold we assumed
that all building oodes, where applicable, were complied with
scrupulously.
Although we are unable to complete the "Application for
Building Permit" because we are not aware of the builders license
permit, we would be pleased to cooperate in every way to resolve
this issue. If you wish, we could contact Doroski's and attempt
to obtain the information you require.
Enclosed is a photograph of the gazebo which you will note
is free-standing and movable. If there is another form that
relates to the "purchase" of an item like this, we would be happy
to complete such a form. However, in the event this situation is
more legal oriented than we realize, we would appreciate knowing
if we should retain the services of an attorney.
We apologize for the delay in responding and again pledge
our total cooperation. Under no circumstances do we intend to be
in violation of the law.
