TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part,of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Peconic, in the Town of Southold, County of Suffolk and State of New York,
being more particularly bounded and described as follows:
BEGINNING at a point at the southwesterly corner thereof and which point is at the southeasterly
corner of lands heretofore conveyed by Nelson Axien to Robert and Elsie Mcllroy and which point is on
the northerly line of a 33 foot wide private roadway, north 82 degrees 49 minutes east, 100 feet from
the intersection of said line with the easterly line of lands now or formerly of Floyd Vail from said point
of BEGINNING;
RUNNING THENCE in a general northerly direction along lands of said Robert and Elsie Mcllroy, north
31 degrees 20 minutes west, a distance of 291 feet more or less to the mean high water line of the
Long Island Sound;
RUNNING THENCE in a general easterly direction along the mean high water line of the Long Island
Sound, a distance of 80 feet, more or less, to lands heretofore conveyed by Nelson Axien to John
Ranahan;
RUNNING THENCE in a general southerly direction along lands of said John Ranahan, south 31 degrees
20 minutes east, a distance of 295 feet, more or less, to the northerly line of said private Right of Way;
RUNNING THENCE in a general westerly direction along the northerly line of said private Right of Way,
south 82 degrees 49 minutes west, a distance of 80 feet to the point or place of BEGINNING.
TOGETHER with a Right of Way to the North Road, 33 feet in width running along the southerly line of
the premises herein described and the northerly line of said Right of Way running the following courses
and distances:

through other lands of said Nelson Axien and continuing through lands now or formerly of Henry
Smith; and
THENCE CONTINUING one (1) rod in width along the easterly side of lands of George Stepnoski or
continuing in a southerly direction over Henry's Lane, a Town Highway, to CR 27.
SAID PREMISES also being more particularly bounded and described according to Survey made by
Nathan Taft Corwin III, dated July 24, 2012, as follows:
BEGINNING at a point on the southwesterly corner of the premises described herein and the
southeasterly corner of lands now or formerly of Peter A. Mossel and Starr R. Mossel, which said point
is on a course north 82 degrees 49 minutes 00 seconds east, a distance of 100.00 feet from the easterly
side of Lot No. 6, as shown on Subdivision Map of "Blue Horizons", filed in the Office of the County
Clerk of Suffolk County, as Map No. 7974 and which point is on the northerly side of a 33 foot wide
Right of Way;
RUNNING THENCE from said point of beginning, north 31 degrees 20 minutes 00 seconds west, 253.57
feet to the line along apparent high water mark of Long Island Sound, as of July 24, 2012;
THENCE along said high water mark, north 75 degrees 11 minutes 19 seconds east, 76.14 feet;
THENCE south 31 degrees 20 minutes 00 seconds east, 264.65 feet to the northerly side of 33 foot wide
Right of Way;
THENCE along the northerly side of said 33 foot wide Right of Way, south 82 degrees 49 minutes 00
seconds west, 80.00 feet to the point or place of BEGINNING.
