The south corner of the deck and the north corner of the single family dwelling were determined to be 65' and 72' from the high marsh, respectively. It Therefore, you need to resubmit plans depicting a revised tidal wetland line, with the deck and north corner of the single family dwelling moved 10' and 3' landward, respectively. Also your application remains incomplete pursuant to the Notice of Incomplete 54 Application sent to you on March 5, 1990. I'll ask you once*Wgain to depict the limits of fill on your plans - and as long as you're doing that, please also indicate the limits of clearing and grading. Any fill you propose needs to be a minimum of 50' landward of the NYSDEC tidal wetland line. In the event that you will be seeking a variance from the 75' setback, please keep in mind that you must properly justify the variance in accordance with the Tidal Wetlands Land Use Regulations. From the information submitted it appears that the proposed timber pier assembly is authorized by our General Permit for Non-Commerical Mooring Structures (NYDGP-08) a copy of which is enclosed. Your work should be performed according to the conditions of this General Permit. Additional work that is not within Department of the Army regulatory jurisdiction includes the construction of a dwelling and sanitary system landward of the spring high tide line and existing wetlands. T"1iS additional work does not appear to include dredging or construction activities in or over any navigable waters of the United States, the placement of any dredged or fill material in any waters of the United States (including coastal or inland wetlands) or the accomplishment or any work affecting the course, location, condition or capacity of such areas. Therefore, a Department of the Army permit will not be required for this work. Please display the enclosed Notice of Authorization sign at your work site. A copy is enclosed for your records. You are required to submit to this office the dates of commencement and completion of your work. Enclosed are two postage paid postcards for you to use to submit the required dates. Notice is hereby given that the permittee should recognize that a possibility exists that the structure permitted herein may be subject to wave wash from passing vessels.
