Wicks, Licensed Land Surveyor, dated November 22, 2022, and determined that the proposed removal of invasive vegetation and the planting of native, non-fertilizer dependant vegetation including trees, shrubs, and herbaceous species is out of the Wetland jurisdiction under Chapter 275'of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result 2 from your project. Such precautions may include maintaining adequate work a"rea between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Please find the$50.00 fee attached to this letter. We have enclosed one set of originals and one set of copies of the Affidavit and Authorization forms. The scope of the proposed work includes removal of invasive vegetation and the planting of native, non- fertilizer dependent vegetation including trees,shrubs, and herbaceous species. All parties would like the work to begin as soon as possible. Enclosed is a list of species from which the landscape ecologist will choose. The choice is subject to species/size availability. You will also find enclosed a copy of the survey as well as a markup of an aerial from Nearmap showing the proposed project area. The aerial clearly shows the extent of Trustees'jurisdiction from the closest point at the top of the bluff. To ensure work does not encroach into Trustees jurisdiction,the project area is set back 5'from Trustees jurisdiction. The markup shows this distance.
