Inter-Science Research Associates, Inc. on behalf of DOMELUCA 11, ILLC requests a Wetland
Permit to construct a sod face revetment with a 2'9" maximum height and 150 linear feet long at
proposed concrete bench, natural turf reinstatement, horticultural soil and upturned natural turf;
construct a concrete bench with an effective height of 1'3" and 15' in length at proposed sod face
revetment with a 2'0" foot rest, and 4'0"smooth surface customized concrete seating; and a
proposed 4' wide gravel path that meanders through the property. Located: 14895 Route 25, East
Marion. SCTM# 1000-23-1-2.10
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department and the records available to me, I recommend that the proposal is
INCONSISTENT with LWRP Policy 6 and with the LWRP.
1. No grading or filling should occur within the 100' wetland and bank setbacks.
2. The proposed Deer fencing at the wetland boundary (Flags) and top of bluff zone
buffer adversely impact the beneficial use of the upland/wetland ecotone by wildlife
who depend on the adjacent habitat for food and cover.
3. Deer fence within a non-disturbance buffer is disturbance and contrary to the
function'and values that the buffer is expected to deliver.
4. It is recommended that the Deer fence be moved to the 100' setback line or denied.
Deer fencing and grading should be added to the description. The grading should be
carefully assessed.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. Tliis
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerialpermits not located within the Coastal Erosion Hazard,4rea.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor ac'tion list� policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or"no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be enlainM in detail, listing both supporting and Ron-
supportinR facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.

website(southoldtown.northfork.net), the Board of Trustees Office,the Planning Department,all
