Box 1179 54375 State Route 25 Southold, NY 11971 (cor.Main Rd. &Youngs Ave.) Southold, NY 11971 ® �� Telephone: 631 765-1938 Irou LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: March 13, 2023 Re: LWRP Coastal Consistency Review for SILVER SANDS HOLDINGS I, LLC SCTM# 1000-47-2-14 Michael Kimack on behalf of SILVER SANDS HOLDINGS I, LLC requests a Wetland Permit for the as-built tidal wetland jurisdiction area/ground disturbance: total area: ±10,200sq.ft.; for a buffer, place approximately 92 linear foot sand walk path (±1,100sq.ft.) set back 18' at closest point to tidal wetlands line; existing sand to remain; place approximately 8 linear foot by 6'± (40sq.ft.) sand walk path continuing from Lot 13 landward of buffer to frame building; planting plan in accordance with a portion of Planting Schedule L-4.40/4.50 attributable to Lot 14; for the storm water management system fresh water stone buffer/drain trench, remove approximately 490sq ft of existing freshwater wetland vegetation; construct a 180'x10' (1,800sq.ft.) drainage trench/stone buffer as located on Utility Site Plan to accommodate storm water from four(4) cottages and garage; install approximately 330 linear feet of drain lines from the four(4) cottages and garage to the drainage trench (approximately 75 linear feet of drain lines on Lot 15); for the fresh water wetland planting plan, install approximately 2,400sq.ft. of additional indigenous plantings between stone buffer and fresh water vegetation line to further protect wetland; additional planting area at approximately 5 to 1 greater than area removed; restore area from stone buffer within Trustee jurisdiction in accordance with a portion of Planting Schedule 4.40/4.50 attributable to Lot 14. Located: 1100 Silvermere Road, Greenport. SCTM# 1000-47-2-14 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-builts are INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built clearing and structure was constructed without a Board of Trustee review or permit. The applicant's agent indicated within the LWRP CCR Form that this action will have nonimpact on freshwater wetlands even though there is a proposal to remove approximately 490sq.ft. of existing freshwater wetland vegetation; construct a 180'x10' (1 800sg ft) drainage trench/stone buffer as located on Utility Site Plan to accommodate storm water from four(4) cottages and garage, install approximately 330 linear feet of drain lines from the four(4) cottages and garage to the drainage trench (approximately 75 linear feet of drain lines on Lot 15. The proposal does not protect freshwater wetlands on-site. 1. Influencing the hydroperiod of freshwater wetlands with storm water even when disposed into a French drain could degrade the water quality within the wetland and adversely affect the species within it There is no control over the quality of stormwater being disposed of. The water levels in these systems expand and contract in area with seasons. 2. Removing natural wetland systems with naturalized species affects the function and values the wetland provides to dependent species in its current state. 3. Clarify the benefit of a "stone buffer"to filtering storm water and wetland water quality? 4. These areas contain tree species that occur in freshwater wetlands systems. 5. Storm water should be contained near the source. 6. There is an aquaculture facility near the parcel. The area adiacent to the bulkhead should be planted with additional native salt, and drought-tolerant species and identified as a perpetual buffer. 7. Non-disturbance buffers should be created around all freshwater and tidal wetlands incorporating existing vegetation. A detailed remediation plan (not a landscape plan)for the clearing of wetlands should be required. Survival parameters for all planted species should be set. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
