Michael Kimack on behalf of INN THE VINEYARD MATTITUCK, LLC, c/o VERONICA NASARY requests a
Wetland Permit for the as-built 18'x36' (648sq.ft.) in-ground swimming pool, 1,179sq.ft. stone pool patio
surround, and 4' high pool enclosure fencing with two (2) gates (281 linear feet); as-built 8'x4' (32sq.ft.)
landing to a 4'x12' (48sq.ft.)staircase to a 3'x66.83' (200sq.ft.) catwalk; seven (7) as-built electric lights at
pool and along walkway to floating dock to be converted to Dark Sky compliant fixtures; and as-built 6'x40'
(240sq.ft.)floating dock with two (2) pilings to secure it in place, to replace in-kind previously approved
floating dock. Located: 900 Fox Hollow Road, Mattituck. SCTM# 1000-113-6-22
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the as-built are INCONSISTENT with LWRP
and, therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction `
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The as-builts were constructed without a Board of Trustee review or permit.
Further the applicant has not demonstrated to the Board that the proposed action complies with 275-11. C.
(2) Docks outlined below.
275-11. C. (2) Docks
(d) Review and approval of dock applications. Before is wing a permit for a dock structure, the Trustees shall
consider whether the dock will have any of the following harmful effects:
• Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel
congestion;
• Whether the dock will unduly interfere with the public use of waterways for swimming, boating,
fishing, shellfishing, waterskiing and other water-dependant activities;
• Whether the dock will cause degradation of surface water quality and natural resources;
• Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife
habitats;
The dock is poorly designed The height between intertidal vegetation and the bottom of the
dock is insufficient to support the continued survival of species. The dock should be
removed and reconstructed to an appropriate height to allow light penetration.
• Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands,
seagrasses including eelgrass (Zostera marina) and widgeon grass(Ruppia maritima) or shellfish;
In the event the action is approved, it is recommended that the Board consider requiring -grid
decking in place of planks over vegetated wetlands to allow for the re-establishment of the
spartina alterniflora or spartina patens.
• Whether the cumulative impacts of a residential and commercial dock will change the waterway or
the environment and whether alternate design, construction, and location of the dock will minimize
cumulative impacts.
The following is recommended if the action is approved:
1. Require a vegetated buffer landward of the wetland and stormwater sink to handle runoff
from the pitch of the property to the waterbodV.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.
