(631) 765-1809 &OU FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 7, 2023 ZBA Application No.: 7811 SE Applicants/Owners: Thomas and Kathleen Burke Property Location: 780 Deep Hole Drive, Mattituck,NY 11952 SCTM No. 1000-115-12-11 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 17, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 17, 2023. Based upon the,information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available;it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory stricture. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 9,594 square foot waterfront parcel located in an R-40 Zoning District. The parcel runs 47.43 feet of bulkhead frontage along Deep Hole Creek, runs 50 feet along Deep Hole Drive, runs 192.76 feet on the North side and runs 189.90 feet on the South side. The parcel is improved with an existing two-story frame house, an existing garage, a wood dock, and a floating dock. All is shown on a survey prepared by Nathan Taft Corwin III, L.L.S., last revised May 5, 2023 ADDITIONAL INFORMATION: Two neighbors attended the hearing and spoke in opposition to the proposed accessory apartment. One neighbor was concerned about the character of the neighborhood and the other about water runoff, excessive and intrusive exterior lighting on the accessory structure that adversely impacted his dwelling on the adjacent property, and the applicants proposed use of the apartment by their daughter, as he believed the daughter-did not work or live locally. 1 Page 2,August 17,20237811 SE,Burke,Tom and Kathleen SCTM No. 1000-115-2-11 There was a discussion at the public hearing between the applicant and the Board of Appeals about the recent revisions to the Town Code requirements for an accessory apartment in an accessory structure. The Zoning Board informed the applicant that they would consult with the Town Attorney to investigate whether the current or the previous code standards should be applied to the subject application. The Zoning Board was informed that the Town Board had publicly discussed code changes over the last year with much attention in the last eight months. More specifically,the proposed changes involved adding requirements to the Code that accessory structures need to be in existence prior to an apartment conversion, and not being built specifically for rental purpose. Ultimately in the last couple of monthsiafter a required public hearing, Local Law No. 12-2023 was passed on May 23, 2023. The applicants submitted an incomplete application to the Office of the Board of Appeals on May 15, 2023,which was deemed to be complete on June 27,2023 with the submission of a copy of the required rental lease signed by the proposed tenant,the applicants' daughter. After consideration was given as to which Code version to use and how the different versions would each affect different outcomes, it appears that the application was not completed in time to use the old code standards. Consequently, the Board of Appeals shall apply all of the required standards in the current Town Code as amended on 5-23-2023 in making this determination. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 3,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13)to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does NOT comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. If established on the first floor, access to any storage area above shall be by pull-down ladder staircase only. The architectural plans prepared by Charles M. Thomas, Architect, and dated February 24, 2023 propose an accessory studio apartment with one full bathroom entirely on the secondfloor of the accessory garage with a conforming 401 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area"request by the ZBA dated May 31, 2023. 2. The dwelling unit complies with the definition of same in §280-4 of the code 3. The as built accessory structure does NOT comply with the code requirement as defined in Section 280- 13(B)(13)(e) of the Zoning Code which states the accessory structure must have been certified a minimum of three years prior to the establishment of the accessory apartment. The applicants were issued a Certificate of Occupancy No: 43887 for the subject accessory garage with unfinished attic storage as applied for dated 3/4/2023. Consequently, the Board finds that the applicants do not meet the minimum standards for approval. 4. The applicant herein, owns and resides at the property as documented by copies of a driver's license, rental agreement,tax return, star rebate form, oil bill, phone bill, and electric bill=and confirms that one of the dwelling units shall be for their sole, exclusive occupancy, as defined,in chapter 280-4, and that the other dwelling unit shall be leased for year-round occupancy by either a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement in conformance with the code requirements as set forth in Section 280-13(B)(13)(i). The applicants testified that the tenant of the accessory apartment will be Meagan Burke, their daughter, as evidenced by a copy of a certificate of live birth and an undated, signed, un- notarized rental lease that was submitted to the Zoning Board on June 27, 2023. The owners' plans comply with the on-site parking requirements of three spaces,two for the principal dwelling and one for the accessory apartment, and provide for a total of six (6)parking spaces, as shown on the survey prepared by Nathan Taft Corwin L.L.S. dated June 28, last revised May 5, 2023. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 8. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations, determinations and findings required in Chapters 280-142 (General Standards) and 280-143 (Matters to be Considered) specifically finds and determines the following: a. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. b. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. c. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. d. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. e. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. f. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. 9. While the record does establish issues relating to the impact of the proposal to the surrounding residential uses, and the cumulative effect thereof,this Board is constrained to find that the applicant has failed to meet the threshold requirement that the accessory structure in question must have been certificated a minimum of three (3)years prior to the filing of the instant application. [See, §280-13(13)(13)(e)]. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Weisman(Chairperson) seconded by Member Planamento, and duly carried, to DENY the Special Exception Permit as applied for. We have lived at this address for the past 22 years. We are here today to voice our opposition to the establishment of an auxiliary apartment at the Burke property as we believe such an apartment, especially in a separate building from the prime residence, is not in character with the neighborhood.
