APPLICATION FOR CERTIFICATE OF OCCUPANCY
A. This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S--9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.'
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. -Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and'a consent to inspect signed by the applicant.

Re: Use of Proposed 86 ft. by 35 ft. Building at Pindar
Dear Dr. Damianos:
Thank you for conferring with the Board of Appeals at our
Regular Meeting held on Thursday, May 7, 1992 concerning the
proposed use of the 86 ft. by 35 ft. building.
As you know, the conference was the result of reviews
concerning a site plan which was pending under the zoning code
and the environmental procedures, and there were concerns that
our department and other departments or agencies will also have
jurisdiction concerning use of the structure for public
assemblies such as wine festivals, concerts, sales of wine,
etc. You were kind enough to provide us in writing with the
proposed uses, now as a gazebo and in the future for certain
public events.
As explained to you on Thursday evening, public assembly
uses are not permitted as a matter of right under the current
zoning code and do not fall under the accessory provisions of
the code. They are uses found to be independent and not
customarily necessary or incidental to the production of wine.
We advised you that an application to the Town Clerk under
Chapter 27 of the Code of the Town of Southold to determine the
need for permits was necessary for such public assembly uses, as
well as any proposed extension of retail sales of wine, in the
form of an amended Special Exception to be filed with the Board
of Appeals. The Town Board and the Zoning Board each have
original jurisdiction for these permits, and an amended site
plan application with the Planning Board.
In our understanding, after our discussion, that the use of
the building at this time is only for private "gazebo-type"
sittings of individuals or groups who will be entering or

leaving the winery building and not at this time for large
public assembly events, such.as festivals, concerts, and/or
not-for-profit charitable fund-raising events. In any event,
when and if you decide to plan for such public events, you have
agreed to make all agency applications and receive written
approvals prior to conducting these events.
We are furnishing copies of this letter to the Planning
Board Chairman, Members and Staff, and the Building Department
for their permanent recordkeeping and update.

Dear Mr. Goehringer:
I am drafting this letter to your office regarding plans for a proposed
gazebo/pavillion on the property directly behind our existing, Winery.
In this letter we will try to address any questions your office might
have with regards to the present and future uses of the proposed
structure.
The gazebo will only be used on a seasonal basis for picnicing of our
customers and as a staging area for tours. hie would use it for wine
tastings, sittings, wine education groups and small wine industry
lectures. Other future uses of this gazebo will include such things
as poetry readings, harvest festivals and not-for-profit charitable
fund-raisers.
As to the physical characteristics of the building, it is an 86 foot
long by 35 feet wide traditional rustic-looking, open-air building.
Lighting and electrical power are not planned at this time. Hours of
use for this building will parallel those of the winery, 8 a.m. to
6 p.m., and sales will not take place in this gazebo.

SUBJECT: Proposed Pavillion (Gazebo) - Pindar Vineyards
SEQRA Coordination - ZBA Jurisdiction
we are in receipt of your coordination letter under SEQRA
together with site plan layout and construction plan and wish to
confirm for the record that although we have no objection to
your assuming lead agency status, our department will be an
involved agency.
Please note that the proposed accessory (pavillion or gazebo)
building is shown to be at a height from ground level to the top
of the roof at above 18 feet (total height scales to be 30 feet,
and when calculating an average for a pitched roof, the height
is a total of 21+ feet. Accessory buildings are limited to a
height of 18 feet (vertical distance measured from ground to the
mean height between ridge and eave).
It is our position that a variance (height) application should
be filed under the accessory provisions of the code before the
Planning Board considers final approval of its location on this
site since the building is at least three feet above the
limitation. The alternative, of course, would be to submit a
amended construction plan showing compliance with the height
requirements for permanent recordkeeping.
We are providing a copy of this memorandum to the Building
Inspector's office for their records.

This letter is a follow-up to conversations you had with
our office on Friday, April 24, 1992 concerning the above
project.
We have not received the letter requesting a review of the
above project by the Zoning Board members (or application for a
Special Exception) as you had agreed to bring in Friday
afternoon.
We will await your written communications outlining the
uses, activities and other public assembly occupancies proposed
for this new building. A copy of this letter is being forwarded
to the Building Department in order than the building permit
application, if on file, will be held in abeyance until the need
for a Special Exception has been determined by the Board of
Appeals.
It is again suggested that you submit your letter without
delay. Thank you.
