POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to
briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be
given time at the conclusion of the regularly scheduled business agenda to address the Board on any given
topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of
the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are
available 1-2 days after the meeting. A full copy of the minutes, agenda and meeting video can be viewed by
going to the official Town of Southold website:
www.southoldtownny.gov <http://www.southoldtownny.gov> and following either of the following:
(1) Move pointer over "Government" on the Town website home page. You will find the title "Town
Supervisor/Town Board". Under this title you will see "Southold Town Board Meetings and Agendas". or
(2) Go to "How Do I", in the right upper corner of the Town website home page, Choose "Access", then
"Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the resolutions. (Scroll to
bottom of page for KEY to symbols). You can view the live video of the meeting by clicking on the camera
symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor's Executive Orders regarding the COVID-19 pandemic
in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and
streamed live on the Town's website. The meeting can be viewed live by going to the Town's website at
www.southoldtownny.gov <http://www.southtownny.goy> home page. Click on the "Government"tab, once
the drop down menu appears, under "Town Supervisor/Town Board", click on "Southold Town Board Minutes
and Agendas"which takes the user to the Town of Southold Meeting Portal page. Once on the Meeting Portal
page, click on the date of the meeting you wish to view and then click on "Video". A recording of the meeting
will also air on Channel 22 and will be posted on the Town's website
Instructions and link to attend the meeting will be available on the Town's website or by calling the Town
Clerk's office at (631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

Pursuant to the requirements of the Executive Order of the Governor of the State of New York, a transcript will
be prepared of the public hearing, and a copy shall be filed with the Town Clerk and placed upon the Town's
website.

Chamber of Commerce to hold its Annual First Fridays and to close down Love Lane between Pike St.
and Route 25, Mattituck on Friday, October 6th, 2023 from 5:00 PM to 10:00 PM provided they file a
Certificate of Liability Insurance naming the Town of Southold as an additional insured for two million dollars
and comply with all the conditions of the Town's Policy for Special Events on Town Properties. All fees, with

WHEREAS, on June 12, 2023, the Town of Southold acquired a Conservation Easement on a parcel owned by
The Henry L. Ferguson Museum, as Contract Vendee; and
WHEREAS, said property is identified as SCTM 41000-4.-5-5.10 and is located at East Main Road, Firestone
Drive & Top of the World Road, Fishers Island, New York, in the R-120 zoning district; and
WHEREAS, the entire parcel is 15.00 acres as per a survey prepared by Clough Harbor& Associates, LLP, last
dated May 12, 2023; and
WHEREAS, said property is located within the Fishers Island Union Free School District; and
WHEREAS, the Conservation Easement recorded as part of the purchase prohibits the use of the property for
any residential, commercial, or industrial uses and prohibits the use of the property for anything other than
preservation of open space, passive recreation, or wetland protection; and
WHEREAS, as per Section 117-7 (Determination of Credits to be Deposited) of the Town Code, the Land
Preservation Coordinator provided the Town Board with a calculation of the sanitary flow credits available for
transfer from the above-mentioned parcel prior to the Town Board public hearing on the purchase; and
WHEREAS, twenty-five point four(25.4) sanitary flow credits are available to be placed into the Town
Sanitary Flow Credit Bank as a result of the acquisition of this buildable, non-subdividable property;now,
therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby places twenty-five point four (25.4)
sanitary flow credits into the Town SFC Bank from the Town's development rights acquisition of the
property formerly owned by The Henry L. Ferguson Museum, as Contract Vendee that is located at East
Main Road, Firestone Drive & Top of the World Road, Fishers Island, and identified as SCTM#1000-4.-
5-5.10; and, be it further
RESOLVED that the Town Clerk shall enter this transfer of twenty-five point four(25.4) sanitary flow credits
into the Sanitary Flow Credit Log; and, be it further
RESOLVED that the Town Clerk shall forward this resolution to the Tax Assessors Office, the Land
Preservation Department, the Special Projects Coordinator and the Planning Department for inclusion into the

RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local
Law at Southold Town Hall, 53095 Main Road, Southold, New York, on the 26th of September, 2023 at 4:30
pm, at which time all interested person will be heard.
The proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter 245, Taxation"
which reads as follows:

A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 245, Taxation"
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The Purpose of the amendment is to provide tax relief to volunteer fire department or incorporated voluntary
ambulance service members and/or spouses and Senior Citizens
II. Amendment.
The Southold Town Code is hereby amended by removing the struck through words and adding the underlined
words as follows:
Chapter 245 - Taxation
§ 245-1 Partial exemption for senior citizens.
A. Amount of exemption.
(1) Real property owned by one or more persons, each of whom is 65 years of age or
over, or real property owned by husband and wife, one of whom is 65 years of age
or over, shall be exempt from Town taxes to the extent provided, subject to the
following income limitations:

(2) Such exemption shall be computed after all other partial exemptions allowed by
law have been subtracted from the total amount assessed.
B. The real property tax exemption on real property owned by husband and wife, one of whom is 65 years of
age or over, once granted, shall not be rescinded solely because of the death of the older spouse, so long as
the surviving spouse is at least 62 years of age.
C. The above income shall be calculated as described in Real Property Tax Law § 467 and shall include social
security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset
which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year, net
rental income, salary or earnings, distributions from retirement and annuity accounts, including
Individual Retirement and Individual Retirement Annuities and net income from self-employment, but
shall not include a return of capital, gifts, inheritances, payments made to individuals been- se of theif

drug expenses actually paid which were not reimbursed or paid by insurance.
§ 245-11 Exemption granted; amount; qualifications.
A. Qualifying residential real property, under § 466-c of the New York State Real Property Tax Law, owned
by an enrolled member of an incorporated volunteer fire company, fire department or incorporated
voluntary ambulance service, or such enrolled member and spouse residing in Suffolk County, shall be
exempt from taxation to the extent of 10% of the assessed value of such property for city, village, Town,
part Town, special district, county or school district purposes, exclusive of special assessments.
B. Such exemption shall not be granted to an enrolled member of an incorporated volunteer fire company, fire
department or incorporated voluntary ambulance service residing in such county unless:
(1) The applicant resides in the city, Town or village which is served by such
incorporated fire company or fire department or incorporated voluntary
ambulance service;
(2) The property is the primary residence of the applicant;
(3) The property is used exclusively for residential purposes; provided, however, that
in the event any portion of such property is not used exclusively for the
applicant's residence but is used for other purposes, such portion shall be subject
to taxation and the remaining portion only shall be entitled to the exemption
provided by this section;
(4) The applicant has been certified by the authority having jurisdiction for the
incorporated volunteer fire company or fire department for at least€ire two years
or the applicant has been certified by the authority having jurisdiction for the
incorporated voluntary ambulance service as an enrolled member of such
incorporated voluntary ambulance service for at least fire two years. It shall be
the duty and responsibility of the municipality to determine the procedure for
certification.
C. Any enrolled member of an incorporated volunteer fire company, fire department or incorporated
voluntary ambulance service who accrues more than 20 years of active service and is so certified by the
authority having jurisdiction for the incorporated voluntary fire company or fire department or
incorporated voluntary ambulance service, shall be granted the ten-percent-exemption as authorized by this
section for the remainder of his or her life, as long as his or her primary residence is located with the Town
of Southold.
D. Application for such exemption shall be filed with the Assessor or other agency, department or office
designated by the municipality offering such exemption on or before the taxable status date on a form as
prescribed by the State Board.
E. Incorporated volunteer fire companies, fire departments and incorporated volunteer ambulance services
shall file lists of their enrolled members eligible for the exemption provided by this section with the
Assessor or other agency, department or office designated by the municipality offering such exemption on
or before the taxable status date on a form as prescribed by the State Board.
F. No applicant who is a volunteer fire fighter or volunteer ambulance worker who, by reason of such status,
is receiving any benefit under the provisions of this article on the effective date of the section shall suffer
any diminution of such benefit because of the provisions of this section.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

WHEREAS, the Peconic Bay Region Community Housing Act(Act)was signed by the NYS Governor in
October 2021; and
WHEREAS, the Act gave the five East End Towns the authority to establish a Community Housing Fund
(CHF) to expand housing opportunities; and
WHEREAS, the Act required a local referendum creating a 0.5% transfer tax; and
WHEREAS, the Town Board requested the Planning Board draft a Southold Community Housing Plan as a
part of the Southold Town Comprehensive Plan; and
WHEREAS, a Community Housing Fund Advisory Board was appointed in September 2022 to assist in
drafting the Southold Community Housing Plan; and
WHEREAS, the local referendum was passed by Southold voters in November 2022; and
WHEREAS, the Draft Southold Community Housing Plan was completed in April of 2023; and
WHEREAS, the Village of Greenport is a participant of and beneficiary of the Southold Community Housing
Plan; and
WHEREAS, several informational meetings were held town wide on the Plan; and
WHEREAS, a public hearing is now required to allow input of all interested parties and to permit the Town
Board to consider adoption of the proposed Housing Plan; therefore be it

WHEREAS, the Town of Southold has established a Transfer of Development Rights Program whereby
Sanitary Flow Credits can be transferred into a TDR Bank from open space lands purchased by the Town of
Southold; and
WHEREAS the TDR Bank currently has credits on deposit from lands purchased by the Town of Southold that
are located within the Southold School District; and
WHEREAS an application for transfer of Sanitary Flow Credits was filed by Laoudis LLC seeking transfer of
1.61 credits to the property known as SCTM4 1000-61-4-22 located at 54280 Main Road in Southold, in the
Southold School District; and
WHEREAS the applicant seeks to utilize the credits on land designated as Hamlet Business District(HB) to
create one as built professional office, fitness studio and three (3) accessory apartments at the aforementioned
property; and
WHEREAS the applicant seeks to utilize the credits on land within a designated receiving area; and
WHEREAS the Town Board held a public hearing on the action on September 12, 2023, at which time all
persons were given the opportunity to be heard; and
WHEREAS the Town Board conducted a coordinated SEQRA review of the action, and issued a Negative
Declaration on September 26, 2023;
NOW, THEREFORE, BE IT
RESOLVED that the Town Board has evaluated the effects of the proposed transfer and finds that the district
contains adequate resources, environmental quality and public facilities, including adequate transportation,
water supply, waste disposal and fire protection, and further finds that that there will be no significant
environmentally damaging consequences and that such development is compatible with the comprehensive
planning efforts of the Town, and the Town Board incorporates the report of the Planning Board in support of
the application dated June 27, 2023; and it is further
RESOLVED that the Town Board of the Town of Southold hereby transfers one point six one (1.61) sanitary
flow credits from the Town TDR Bank to Laoudis, LLC for its development at 54280 Main Road, Southold,
SCTM4 1000-61-22; and it is further
RESOLVED that upon issuance of the Sanitary Flow Credit Certificate, the Town Clerk shall enter this
deduction of one point six one (1.61) sanitary flow credits from the Sanitary Flow Credit Log; and be it further
RESOLVED that the applicant shall receive a Sanitary Flow Credit Certificate, which shall not be signed by the
Supervisor and released by the Town Clerk to the applicant until the covenants and restrictions required by
Town Code Section 117-11 have been filed and such filing has been approved by the Town Attorney; and be it
