HOMAN TRUST, c/o KENNETH JAMES HOMAN SCTM# 1000-111-1-14 1 Costello Marine Contracting Corp. on behalf of ELIZABETH J. HOMAN TRUST, c/o KENNETH JAMES HOMAN requests a Wetland Permit to remove and dispose of existing 101' long bulkhead;construct new 101' long bulkhead in-place using vinyl sheathing; construct a 4' wide walkway along the landward side of the entire bulkhead; install a 3'x10' aluminum ramp leading to a 5'x20'floating dock secured in-place by two (2) 8" diameter anchor piles. Located: 430 Fisherman's Beach Road, Cutchogue. SCTM# 1000-111-1-14 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is CONSISTENT with LWRP Policies and with the LWRP provided the following is known and considered: 1. Turbidity controls are required. 2. Note the dock must be 15' from a side property line unless determined otherwise. All docks, including any vessel tied to the dock, shall have a minimum clearance of 15 feet of the seaward extension of any property line from adjacent parcels so as not to interfere with the neighbor's access to waters, unless the Trustees decide otherwise for navigational or other reasons. Waterside boundaries can be identified using the appropriate method for the shape of the shoreline for Long Island waters specified in 9 NYCRR 274.5. This recommendation was made considering that the dock exists, is not large, and does not unreasonably protrude into public waters. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2.
