Located: 5670 West Mill Road, Mattituck. SCTM# 1000-106-6-4.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built structure was constructed without Board of Trustee review or permit. The corner of the garage encroaches into a Town Right of Way (Mill Road). The ZBA relief was for a storage use in the Mil zoning district. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR THE NORTH FORK PROJECT LLC 5670 WEST MILL ROAD, MATTITUCK SCTM#1000-106-6-4.1 LWRP Policies 5 & 6 The applicant seeks a wetlands permit for an as-built, 1-story frame garage, which is a substantial reconstruction of a previously existing, preexisting garage that partially collapsed and was tipped off its foundation during a March 2021 nor'easter. Fearing that the garage might be completely destroyed and cause damage to the adjacent property to the south if it were not repaired prior to a subsequent storm, the applicant quickly restored the garage, in- place,utilizing as much of the previously existing framing as could be salvaged. Maintaining the structure is of critical importance to the applicant because it provides essential storage for, and is thus vital to the operation of, the Old Mill Inn on the adjacent property to the north, where there is no room for accessory storage. Town Building Department records show the previously existing garage in the same location in 1966, and historical photographs demonstrate its presence prior to the removal of the Mill Lane bridge in 1954. The existing structure thus creates no additional encroachment on the historically existing wetlands setback from the bulkhead, and it does not introduce any other environmental stressors on the property in the way of additional lot coverage, potential runoff, or effluent. Rather, addition of a drainage system of leaders, gutters, and drywell would reduce potential runoff, and establishment of a permanent buffer area, including native plantings along the bulkhead, would enhance the property's capacity for runoff absorption and improve the overall environmental condition of the property. Maintenance of the garage on the property will thus be consistent with the goals of Policies 5 and 6 of the LWRP, which are protecting and improving water quality and the quality and function of the adjacent wetlands ecosystem. -SEE ATTACHED ADDENDUM-- Attach additional sheets if necessary Policy 7.
