Date: August 10, 2023 Re: LWRP Coastal Consistency Review for LEE & LILI SIEGELSON SCTM# 1000-10-3-10 The ZBA granted approval of the action (7702) in 2022. Samuel Fitzgerald, Architect on behalf of LEE & LILI SIEGELSON requests a Wetland Permit and a Coastal Erosion Permit for the existing two-story dwelling with a 727sq.ft. footprint and attached 966sq.ft. wrap-around covered porch; construct a 362sq.ft. two-story addition onto landward side of dwelling; construct a 181sq.ft. second story addition within the footprint of the existing dwelling; construct a 297sq.ft. front covered entry porch; expand existing screened porch an additional 79sq.ft. in the existing covered porch; temporarily lift dwelling to construct a new 967sq.ft. foundation; and reconstruct existing steps to ground off of porch. Located: 2046 Peninsula Road, Fishers Island. SCTM# 1000-10-3-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the LWRP policies 4 and 6. A portion of the single-family residence is within the Coastal Erosion Hazard Area (CEHA). The expanded screened porch is located within the CERA. Policy 4 of the LWRP does not support building within the CEHA. The structure is located within FEMA flood zone AE EL 11. The expansion of structure is a structural hazard area is also not supported. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall co ete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consi ney Review Law. This assessment is intended to supplement other information used by a T of Southold agency in making a determination of consistency. *Except minor exempt actio including Building Permits and other ministerial permits not located within the Coast Erosion azard Area. 2. Before answering the questions in Section C, the preparer ft s form should review the exempt minor action list, policies and explanations of each policy cot ned in the Town of Southold Local Waterfront Revitalization Program. A proposed action w be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions.
