SCTM# 1000-51-1-18 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP ,Z, with the following consideration: 1. Stones and boulders located on the beach shall not be moved or included in the construction of the revetment. 2. Survival parameters of the planted vegetation on the bluff should be required. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable Narrative Addressing Chapter 275, Chapter 111, and Local Waterfront Revitalization Program Policy No. 4 for ALEXANDER PERROS 19215 SOUNDVIEW AVENUE SOUTHOLD, NY SCTM#1000-51-1-18 The subject property is located along a stretch of Long Island Sound shoreline running parallel with Soundview Avenue that has been impacted by shoreline recession and increasing bluff erosion during the increasingly frequent and severe storm events experienced during the last 15 years, including the Christmas 2010 Blizzard, Super Storm Sandy in October 2012, and annual nor'easter events, four of which occurred during March 2018 alone. As a result, properties in this geologic cell have experienced accelerated and severe erosion of the vegetation and soils on their protective bluffs and the landward recession of those bluffs. In response, both the Town of Southold and private property owners have been forced to seek approvals for the construction and reconstruction of shoreline stabilization structures, including the rock revetment installed on the westerly adjacent property in September 2012 (Wetlands and Coastal Erosion Management Permits Nos. 7908/7908C) and the reconstructed bulkhead on the easterly adjacent property in 2011 (Wetlands and Coastal Erosion Management Permits Nos. 7429/7429C). Severe bottom-up erosion of the subject bluff is evidenced by a landward receding bluff toe; a steepening bluff face; and the loss of substantial soil material and vegetation between bluff toe and the approximate mid-point of the bluff face. Therefore, in May 2019, the applicant filed wetlands and coastal erosion management permit applications proposing an erosion control project designed in accordance with the generally accepted bluff stabilization practices recommended by the USDA Natural Resources Conservation Service, which is to stabilize the bluff using a combination of structural or"hard" stabilization at the toe and both hard and"soft" stabilization on the bluff face, i.e., terracing, sand renourishment and revegetation. Specifically, a stone revetment was proposed to stabilize the bluff toe, which would occur first. Then the "washed out"portions of the bluff face would be stabilized with terrace retaining walls, renourished with sand, and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. The project design also included the removal of an unpermitted deck at the top of the bluff and replacement and partial relocation of the existing bluff stairway, which presently encroaches on the neighboring property to the east. And to additionally control potential top-down erosion resulting from stormwater runoff, a 10' wide non-turf buffer was proposed adjacent to the bluff crest. In June 2019, the Board of Trustees approved the project through issuance of Wetlands Permit No. 9476 and Coastal Erosion Management Permit No. 9476C. These permits were amended in November 2019 to propose a connection to the extended stone armor that would be approved at the easterly adjacent property in 2021 (Wetlands and Coastal Erosion Management Permits Nos. 9946/99460). Unfortunately, although the permits were extended twice, it was not possible to commence the work within the life of the permit because it took nearly four years to obtain approval from the New York State Department of Environmental Conservation, who had been Page 1 of 2 requesting an alternate revetment design before finally issuing the permit for the proposed design on May 8, 2023. Therefore,the applicant must now reapply for wetlands and coastal erosion management permits from the Board of Trustees. To that end, the currently proposed revetment design is identical to that approved pursuant to the permit amendments in November 2019, and the proposed bluff stairway is nearly identical, except that the total length of the stairway has been reduced from 71 to 67 feet; the proposed 10' x 10' entry platform at the top of the stairway has been relocated entirely landward of the top of bluff, and the dimensions of all stairway landings have been reduced to 4' x 6' or 4' x 4'. The project thus remains consistent with Chapters 275 and Chapter 111 of the Town code, and it is consistent with all applicable LWRP policies, as described below. Pursuant to principles set forth by Section 275-11(B)(1)(b), the proposed revetment is proposed in an area suffering from extreme erosion, as described above. Consistent with Section 275- 11(B)(1)(b), Sections 111-10 and 111-15, and Policy 4 of the LWRP, the revetment will be installed with a sloped face along the existing bluff toe to prevent encroaching on the beach or measurably increasing erosion at the site. No increase in erosion or other adverse impacts will be caused to adjacent properties or to natural coastal processes and resources because the revetment will be located between an existing rock revetment to the west and an existing bulkhead to the east. Further pursuant to Sections 111-10 and 111-15,the very purpose of the proposed structure and comprehensive erosion remediation plan is to stem the continued denuding and loss of the bluff, the property's natural protective feature. And the design has been engineered in accordance with generally accepted engineering principles, and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand inundation, wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. The proposed construction sequence calls for the stabilization, renourishment, and revegetation of the bluff face after the revetment and new bluff stairway have been constructed, so the potential effects of the proposed construction, i.e., the disturbance of adjacent bluff soils and vegetation, will be mitigated through the stabilization and vegetative restoration of those areas. Further consistent with Policy 4 of the LWRP, the hard structure is being proposed only where 1) non-structural, vegetative means alone will not be sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2)the natural protective feature, i.e.,the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the recent pattern of severe erosion throughout this geologic cell; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4)the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5)vegetative restoration and enhancement is and will remain part of the long-term remediation plan design; and 6)there will be no significant direct or indirect costs incurred by the public as a result of the project. Ultimately,the goal of the project continues to be the stabilization, restoration, and enhancement of the property's natural protective feature for the purpose of minimizing the loss of structures and natural resources from erosion,thus consistent with the relevant permit standards of Chapters 275 and 111 and the goals of Policy 4 of the LWRP.
