Michael Kimack on behalf of VERONICA H. NASARY requests a Wetland Permit for the
existing 18'x36' (648sq.ft.) in-ground pool; existing 1,179sq.ft. pool patio surround; as-built
281 linear feet of 4' high pool enclosure fencing with two (2) gates; as-built 4'x8' (32sq.ft.)
landing to a 4'x12' (48sq.ft.) staircase down to an as-built 3'x66.6' section of on-grade
catwalk to a 5'x69.1' long section of fixed catwalk to as-built 3'x16' aluminum ramp to an
as-built 6'x40' floating dock secured by four piles in a "T" configuration; the 3'x33.3'
landward section of on-grade catwalk to remain; reconstruct 33.3' of the seaward section of
the 3'x66.6' on-grade catwalk by removing existing decking and pilings, and on top of a
portion of the remaining 3'x33.3' on-grade catwalk install a new set of±4'x4' steps that lead
up to a new 4'x33.3' section of catwalk elevated a minimum of 4' above grade using five
sets of 4"x4" green heart pilings with 2"x8" pressure treated cross ties; replace as-built
section of 5'x69.1' catwalk and construct a 4'x69.1' fixed elevated catwalk using 3"x8"
blocks bolted to 6"x6" beams with two (2) 2"x6" cross beams with 2"x6"joists at 16" on-
center, 2"x4" short jack to raise the height a minimum of 4' to grade, and seaward portion to
have frame with 2"x6" pressure treated joist supports with two (2) 2"x6" flush beams at 8'
on-center; as-built 3'x16' aluminum ramp, and as-built 6'x40' floating dock situated in a "T"
configuration secured with four (4) pilings to remain; and the as-built seven (7) lights at pool
and along catwalk to floating dock to be converted to Dark Sky compliant fixtures. Located..

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is
my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6
therefore, INCONSISTENT with the LWRP.

6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The as-built dock does not comply with the Wetland Permit 1518 issued in
1982.
The remaining as-built structures are recommended as inconsistent.
1. It is further recommended that stormwater capable of entering the
wetland from runoff is addressed. The property slopes towards the
creek.
2. A pool dewatering well should be required.
3. .A vegetated buffer is recommended landward of the wetland boundary.
An integrated sand sink is also recommended to help control storm
water.
The applicant fails to prove that the action meets the following requirements § 275-11
Construction and operation standards C. 2 (d) of the Southold Tow Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure,
the Trustees shall consider whether the dock will have any of the following harmful effects:
j11 Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities,-
[5]
ctivities,[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zosters marina) and widgeon
grass (Ruppia maritima) or shellfish;
Catwalk is om or close to grade. The past permit required that the catwalk be
elevated 3' above grade. Flow-through decking was not used.
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[10] Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
Dock appears to extend past the pier line and does not meet Chapter 275
standards.
X111 Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design, construction,
and location of the dock will minimize cumulative impacts.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
