Dear Mr. Portillo;
We are in receipt of your correspondence dated April 27, 2023 requesting a de minimus approval to construct an
in-ground swimming pool upon the above referenced premises. In your letter, you indicate that the ZBA granted
your client setback relief to place the 14 feet by 35 feet in-ground swimming pool 71.9 feet from the top of the
bluff while the code requires a minimum of 100 feet.
You explain that your client would like to extend the width of the pool by 2 feet with the new pool dimensions of
16 feet by 35 feet, which would consequently reduce the top of the bluff setback by 2 feet or for a total of 69.9
feet.
I have reviewed your letter and your Architectural Plans, and have determined that your request is not de
minimus in nature because you are requesting greater non-conformity to construct a larger pool. However,you
may be able to achieve a greater pool size by reducing the patio or the deck by 2 feet.
If you wish to proceed, you will be required to return to the Building Department to obtain a new Notice of
Disapproval, and then apply to the ZBA with a current survey or site plan and architectural plans.

We are in receipt of your correspondence dated June 9, 2023, requesting a de minimus approval related
to ZBA determination#7732, dated February 16, 2023, in which an area variance was granted
permitting the construction of an in-ground swimming pool to be setback 71.9 feet instead of the minimum
setback of 100 feet from the top of the bluff.
On May 2, 2023, a request to increase the size of the pool width by 2 feet and reduce the top of the bluff
setback to 69.9 feet was denied.
In your most recent correspondence, you explain that the homeowner would like to extend the width of
the pool by 2 feet, extended toward the existing house, while maintaining the 71.9 feet top of bluff
setback.
The Board has reviewed your request and have determined that the change as depicted on your site plan
dated June 9, 2023 (sheet WL-1.1) is de minimus in nature.
Please submit to our office two original signed and sealed site plans depicting this de minimus approval,
and contact our office if you have any further questions or concerns.

SE RA QEFR'MIN' T� `: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COLiNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued
its reply dated October 18, 2022 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated January 23, 2023. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available,
it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is
INCONSISTENT with the LWRP. However,with the conditions imposed herein,the Board now finds the proposed
action to be CONSISTENT.
PROPERTY F.AC'°I"S!'IESCRIPTIOI�6:_The subject property is anon-conforming 29,280 square foot parcel (18,139
total lest area, landward of CEHA)) located in the Residential R-40 Zoning District. The northerly property line
measures 103.66 feet and is adjacent to Long Island Sound, the easterly property line measures 287.71 feet, the
southerly property line measures 100 feet and is adjacent to Soundview Avenue, and the westerly property line
measures 309.42 feet. The parcel is improved with a two-story frame dwelling with an attached rear deck and a small
shed located in the rear side vard on the westerly side of the lot. The property is well screened from the street with a
row of evergreens as shown on the survey map prepared by Donald J. Metzger, LS and dated May 21, 2022.
BASIS OFAPPLICATION: Request for a Variance from Article XXII, Sections 280-116A(1) and the Building
Inspector's September 7, 2022 Notice of Disapproval based on an application for a permit to construct an accessory
in-ground swimming pool with spa at; 1) located less than the code required 100 feet from the top of-the bluff, located
at: 19105 Soundview Avenue (Adj. to Long Island Sound), Southold, NY. SCTM#1000-51-1-17.

RLLIITMFl .,VESTED: The applicant requests a variance to construct an accessory in-ground swimming pool with
spa at 19105 Soundview Avenue(Adj. to Long Island Sound), Southold, NY. SCTM#1000-51-1-17. The proposed
construction,on this non-conforming 29,280 square foot parcel(18,12.9 square foot buildable land) in the Residential
R-40 Zoning District is not permitted pursuant to Article XXII. Section 280-1 l6A(1). Which states: "all buildings or
structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer
than 100 feet from the top of such bluff." The site plan shows the construction at 71.9 feet from the top of the bluff.
ADDITIONAL,ImINFORMJ-"1"'IO mm The Zoning Board has not received any correspondence or heard any testimony
from neighbors with regard to this application. The Site Plan drawings prepared by Anthony M. Portillo, Architect
and dated September 30, 2022, show the proposed in-ground pool located and a proposed 10-foot-wide sand buffer
to be installed along the entire top of the bluff. The drawings include the location of the proposed drywell for pool
dewatering, an enclosure for the proposed pool equipment on the westerly side of the home, and a 300 linear foot
fence parallel to the top of the bluff. A large tree in the rear yard will have to be removed for the installation of the
pool. On February 7, 2023 the Boardreceived an amended site plan from. Anthony Portillo., Architect, changing the
proposed l0-foot-wide sand buffer to a 10 foot wide vegetated buffer along the entire top ofthe bluff
FINDINGS OF FACT/ REASONS FOR BQA&P_A .T[QN.:
'The Zoning Board of Appeals held a public hearing on this application on February!2, 2023,at which time written
and oral evidence were presented.. .Based upon all testimony,documentation, personal inspection of the property
and surrounding neighborhood,, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. "lfown Law_§267-bQB bJLtJ. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. There are other homes within the community that have in-ground
pools that do not rnect the code required minimurn 100 foot bluff setback . Even though this is a waterfront
neighborhood, in-ground pools are not common in an alternative code conforming front yard. The rear yard where
the pool is proposed is screened from other adjacent properties by a 6-foot-high solid wood fence
2. 'Town, Law §267-b 3 b 2 . The benefit sought by the applicantcannot be achieved by some method, feasible
for the applicant to pursue:,other than anarea variance-The proposed rear yard location for the in-ground pool is tlae
only location feasible for this parcel because a well and a large gravel driveway are located in the front yard; the
westerly side yard is too narrow to locate an inground pool and the easterly side yard contains the existing septic
system, Although the applicant could install a narrower lap pool or reduce the size of the existing deck to create a
greater bluff setback, the as built,seaward deck. is located at 90.9 feet from the top of the bluff with a Certificate of
Occupancy (No. ZI05a66 dated Ally 9, 198 1) and the proposed pool width of 14 feet is not excessively wide for
standard pool dimensions
3. Town Law 267-b 3 b' 3 . The variance granted herein is mathematically substantial,representing 28.1%relief
from the code. However, the toe pf the bluff is protected by a rock revetment and the topography of the rear yard
slopes away from the bluff and toward the dwelling which will reduce runoff that could cause erosion of the bluff.
Moreover, the applicant ::rust abidde by any conditions d, sposed by the Southold T^v:'•'n Board of Tr'u'stees to Tlltlgale
the non-conforming bluff setback.
4 Town Law "267-b 3 b 4), No evidence has been submitted to suggest that a variance in this residential
commtraaity will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with.Chapter 236,of the Town's Storm Water Management Code.

5. Town Law 267-b S . The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law X267-6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an in-ground swimming pool with spa while preserving and protecting the character
of the neighborhood and the health, safety and welfare of the community.
I FSOLU l iON OF"1HE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-B,motion was offered by Member Acampora, seconded by Member Lehnert,and duly carried,
to
GRANT the variance as applied for and shown on the Site Plan prepared by Anthony M. Portillo, Architect and
dated February 3, 2023.
SUBJECT TO THE FOLLOWING CONp1T1ONS.
1. The applicant shall obtain Southold Town Board of Trustees approval
2. The applicant shall install a minimum 10-foot-wide buffer planted with drought tolerant native
species along the entire top of bluff or as determined by the Southold Town Board of Trustees as
part of their setback approval
3. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line
or be contained in a shed type enclosure with a lot line set back that is in conformance with the
bulk schedule for accessory structures
4. Drywell for pool de-watering shall be installed.
This approval shall not be deemed effective until the required conditions have been met.At the discretion of
the Board of Appeals,failure to comply with the above conditions may render this decision null and
void
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.
IMPORTANT LIMITS ON THE APPROVALS GRANTED HEREIN

Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding
the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department
of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public
hearing before the Zoning Board of Appeals.
Any deviation from the variances)granted herein as shown on the architectural drawings,site plan and/or survey
cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the reliefgranted
herein, are not authorized under this application when involving nonconformities under the zoning code. This

action does not authorize or condone any current or future use,setback or other feature of the subject property
that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in
this action.
TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town
of Southold any variance granted by the Board of Appeals shall become null and void where a
Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with
the Suffolk County Clerk,within three (3) years from the date such variance was granted. The
Board of Appeals may, upon written request prior to the date of expiration, grant an extension not
to exceed three (3) consecutive one(1) year terms. IT IS THE PROPERTY OWNER'S
RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE. REQUIRED TIME
FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by
the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and
require a new variance application with public hearing before the Board of Appeals

Based on the information you submitted, the New York State Department of
Environmental Conservation has determined that the referenced property, located
landward of the top of the bluff elevation 42ft, as shown on the survey prepared by
Donald J. Metzger, last dated 5/21/2022, is beyond the jurisdiction of the Article 25 Tidal
Wetlands Act. Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661), no permit is required to conduct regulated activities
landward of that jurisdictional boundary.
Please be advised, no construction, sedimentation, or disturbance of any kind may take
place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without
a permit. It is your responsibility to ensure that all precautions are taken to prevent any
sedimentation or disturbance within Article 25 jurisdiction which may result from your
project. Such precautions may include maintaining adequate work area between the
jurisdictional boundary and your project (i.e. a 15' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
This letter shall remain valid unless site conditions change.
Please note that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies or local municipalities.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, August 16, 2023.
RESOLVED that the Southold Town Board of Trustees-APPROVE the Administrative
Amendment to Wetland Permit 910327 to construct a 1 'x35' (560sq.ft.) in-ground swimming
pool with spa with 10" coping in lieu of the previously approved 14'x35' (490sq.ft.); construct a
2.9'x45.6'x16.9'x9.9' (296sq.ft.) stone pool patio in lieu of the previously approved 320sq.ft.;
install 140 linear feet of pool enclosure fencing with gates in lieu of previously approved 300
linear feet; for the vinyl spit rail fence at top of bluff to be removed; to establish and perpetually
maintain a 15' wide vegetated non-turf buffer along the landward edge of the top of the bluff;
and as depicted on the site plan prepared by Anthony M. Portillo, RA, received on August 16,
2023, and stamped approved on August 16, 2023.

Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not an approval from any other agency.
