HALPIN SUFFOLK COUNTY EXECUTIVE DEPARTMENT OF HEALTH SERVICES DAVID HARRIS, M.D., M.P.H. COMMISSIONER May 17, 1991 Mr. Joseph Spitaliere 9 Noel Place Smithtown, NY 11787 Dear Mr. Spitaliere: RE: Water Sample: 4-10-91 - P.O. Box 1091 Orchard Lane, Southold Analysis of your water supply indicates at the time of sampling the microbiological, chemical, volatile organic and pesticide parameters tested were within recommended drinking water standards with the exception of iron. Iron is not nomially considered harmful to health, but can cause off-tastc, odor or staining problems. A concentration of 1.45 milligrams per liter (mg/1) iron was detected. The drinking water standard for iron is 0.3 mg/l. This department recommends connection to a public water supply wherever possible. If public water is not available, aesthetic problems caused by iron concentrations of less than one milligram per liter may be minimized by installation of a polyphosphate feeder. This treatment device does not remove iron from the water. Iron removal can be accomplished by the filtration processes of oxidation or ion exchange. The sodium concentration in the water will be increased by treatment units which are regenerated with salt. Should you have any questions concerning your drinking water, feel free to contact this office. SAWICKI ACTION OF THE BOARD OF APPEALS James Dinizio, Jr. Upon Application of JOSEPH SPITALIERE for a Variance to the Zoning Ordinance, Article III, Section 100-31, Bulk Schedule, for placement of a new dwelling structure with an insufficient setback from the front property line. Location of Property: Right-of-Way located along the east side of Cedar Beach Drive, Southold (just south of General Wayne Inn) and extending in an easterly and thence southerly direction to this parcel identified on the Suffolk County Tax Maps as District 1000, Section 90, Block 4, Lot 14. WHEREAS, a public hearing was held on October 6, 1988, in the Matter of the Application of JOSEPH SPITALIERE under Appeal No. 3765; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. This is an Application for a Variance under Article III, Section 100-31, Bulk Schedule, for permission to place principal dwelling structure with a reduced setback from the front property line at 30 feet, as shown on the Topographic Map prepared by R.J. Mavrikakis, L.S. lastly revised September 19, 1988 (No. 88-6). The setbacks proposed from the "flagged" wetlands line are shown to be approximately 50+ feet, and from the sides at 10 and 15 feet. 2. The premises in question is identified on the Suffolk County Tax Maps as District 1000, Section 90, Block 4, Lot 14. 3. The premises in question contains a total area of approximately one-half acre and is presently vacant. Page 2 - Appl. No. 3765 Matter of JOSEPH SPITALIERE Decision Rendered October 6, 1988 4. Article III, Section 100-31, Bulk Schedule (Column "A") of the Zoning Code requires a minimum frontyard setback at 35 feet from the front property line. The reduction proposed by this application is from 35 feet to 30 feet. 5. For the record it is noted: (a) that the premises is located near the end of a private right-of-way; (b) that an application is pending with the N.Y.S. Department of Environmental Conservation under #10-88-1029, and their Agency has urged that the distance to wetlands be maximized (see communications dated June 7, 1988 and August 15, 1988); (c) that an application is pending with the office of the Town Trustees under #631 and has been placed temporarily in abeyance; (d) that the premises contains a substantial amount of meadow land and wetlands, which limit the buildable upland portion of the premises. (The setbacks from the meadow and wetland areas are not within this Board's jurisdiction under Chapter 100-Zoning of the Town Code.) 6. It is the position of this Board that in considering this application: (a) the relief requested is not substantial, being a variance of approximately 150 of the requirement (reduction of five feet); (b) the relief requested will not alter the character of the neighborhood; (c) the difficulties are uniquely related to the property and are not personal in nature; (d) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town, or be adverse to neighboring properties; (e) in view of the manner in which the difficulties arose, the interests of justice will be served by granting the Pag,- 3 - Appl. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Doyen, it was RESOLVED, to GRANT a Variance for a reduction from a 35-ft. frontyard setback to a 30-ft. frontyard setback, as applied in the Matter of JOSEPH SPITALIERE under Appeal No. 3765. WHEREAS, a public hearing was held on July 14, 1988 in the Matter of the Application of JOSEPH SPITALIERE under Appl. No. 3745; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. This is an Application for Approval of Access pursuant to New York Town Law, Section 280A, over a private right-of-way extending from the east side of Cedar Beach Drive (just south of General Wayne Inn) and extending in an easterly direction 724.52 feet, thence in a curve (radius 114.57 ft.), and running thence southerly 150 feet, more or less, to the subject lots. 2. The vacant lots to which is access is requested are identified on the Map of "Cedar Beach Park" filed December 20, 1927 Map No. 90, as Lots #42 and #44, and on the Suffolk County Tax Maps as District 1000, Section 90, Block 4, Lots 19 and 14, respectively. 3. This application does not reflect a formal request for access to any other lots in this vicinity, and this determination is made on the basis of two additional (new) dwellings on both the subject lots. 1 t ?age-2 - Appl. No. 3745 Matter of JOSEPH SPITALIERE Decision Rendered August 18, 1988 4. Upon inspection of the right-of-way in question, it has been found that most of the presently traveled portion is at a width of 8-10 feet and the base is in fair condition with some depressions and potholes. The end portion nearest Lot #42 is heavily wooded. (See both topographical maps prepared by R.J. Mavrikakis, Land Surveyor, Hauppauge, NY, lastly revised June 18, 1988, submitted for the record.) 5. It is the opinion of the Board Members that the right-of-way is in need of repair, resurfacing and placement of stone blend, as further noted below. In considering this application, the Board finds: (a) that the relief requested is necessary; (b) the grant of the relief requested will not cause a substantial effect or detriment to adjoining properties; (c) the circumstances of this appeal are unique to the property; (d) the practical difficulties are sufficient; (e) there is no other method feasible for appellant to pursue, other than a variance; (f) in view of the manner in which the difficulties arose and in considering all the above factors, the interests of justice will be served by granting a conditional variance, as noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, to GRANT approval of access to Lots #42 and #44 of the "Map of Cedar Beach Park" filed December 20, 1927, identified on the Suffolk County Tax Maps as District 1000, Section 90, Block 4, Lots 14 and 19, respectively, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That all potholes and depressions be filled and compacted with bankrun, and leveled; 2. That the entire length of the right-of-way be cleared to a minimum width of 12 feet and height of 14 feet; 3. That the entire length of the right-of-way be resurfaced with two-inches (21') of stone blend for a width of 8-10 feet, except that the wooded portion of the right-of-way near the end (close to Lot 442) may be resurfaced to a width of eight feet. page°3 - Appl. No. 3745 Matter of JOSEPH SPITALIERE Decision Rendered August 18, 1988 4. That the right-of-way be continuously maintained in good condition (at all times). 5. Final inspection to be made by this Board (or an authorized representative of this Board. 6. That there be no disturbance to wetlands in the area. 7. That the improvements required herein may be constructed at any time up until and before the issuance of a Certificate of occupancy for either newly proposed dwelling structure. Vote of the Board: Ayes Messrs. Goehringer, Grigonis and Sawicki. (Member Doyen of Fishers Island was.absent.) This resolution was duly adopted. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. ' The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: „ by tt i Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impaq The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. DETERMINATION OF SIGNIFICANCE-Type 1 and Unlisted Actions Identify the Portions of EAF completed for this project: D Part 1 D Part 2 ?Part 3 Upon review of the information recorded on this EAF (Parts 1 and 2 and 3 if appropriate), and any other supporting information, and considering both the magitude and importance of each impact, it is reasonably determined by the ,lead agency that:, ' .D A. The project will not result in any large and important impact(s) and, therefore, is one which will not have a significant impact on the environment, therefore a negative declaration will be prepared. Consulting for Joseph Spitaliere I 14.16-2 (2187)-7c 617.21 SEOR Appendix A State Environmental ouallty Review FULL ENVIRONMENTAL ASSESSMENT FORM Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may be significant. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, they: Part 3 is used to evaluate whether or not the impact is actually important. DETERMINATION OF SIGNIFICANCE-Type 1 and Unlisted Actions Identify the Portions of EAF completed for this project: O Part 1 ? Part 2 ?Part 3 Upon review of the information recorded on this EAF (Parts 1 and 2 and 3 if appropriate), and any other supporting information, and considering both the magitude and importance of each impact, it is reasonably determined by the lead agency that: ? A. The project will not result in any large and important impact(s) and, therefore, is one which will not have a significant impact on the environment, therefore a negative declaration will be prepared. ? B. Although the project could have a significant effect on the environment, there will not be a significant effect for this Unlisted Action because the mitigation measures described in PART 3 have been required, therefore a CONDITIONED negative declaration will be prepared.' n C. The project may result in one or more large and important impacts that may have a significant impact on the environment, therefore a positive declaration will be prepared. F Part 2-PROJECT IMPACTS AND THEIR MAGNITUDE Responsibility of Lead Agency General Information (Read Carefully) • In completing the form the reviewer should be guided by the question: Have my responses and determinations been reasonablef The reviewer is not expected to be an expert environmental analyst. • Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any large impact most be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it be looked at further. • The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. • The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. • The number of examples per question does not indicate the importance of each question. • In identifying impacts, consider long term, short term and cumlative effects. Instructions (Read carefully) a. Answer each of the 19 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box (colu{nn 1 or 2) to indicate the potential size of the impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. e. If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderate impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible. This must be explained in Part 3. 1 2 3 Small to Potential Can Impact Be IMPACT ON LAND Moderate Large Mitigated By Impact Impact Project Change 1.
