A copy of this permit with supplementary conditions and approved plans must be available at the project site whenever authorized work is in progress. 2. The permit sign enclosed with the permit or a copy of letter of approval must be protected from the weather and posted in a conspicuous location at the work site until completion of authorized work. 3. At least 48 hours prior to commencement of the project, the permittee must complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form must also be completed and returned. 4. If the permittee intends to undertake any project design modifications after permit issuance, the permittee must submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. 5. Discharge of wet or fresh concrete, leachate or wash water from mix trucks, mixers or other devices to tidal wetlands is prohibited. 6. Contamination of tidal wetlands and the waters of New York State by suspended solids, sediments, fuels, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the conduct of the permitted activity is prohibited. Page ~ 2 of ~ SPECIAL CONDITIONS For Article 25 ( Tidal Wetlands .) 7. Contamination of tidal wetlands and the waters of New York State by suspended solids, sediments, fuels, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the conduct of the permitted activity is prohibited. 8. Any debris or excess material from construction of this project must be immediately and completely removed from the adjacent area and disposed of at an approved upland site. Disposal of debris in tidal wetlands is prohibited. 9. Construction equipment and materials must be stored in upland areas more than 75 ft. landward of the most landward edge of the tidal wetland boundary. 10. All areas of soil disturbance resulting from this project must be seeded with an appropriate perennial grass seed and mulched with hay or straw within one week of final grading. Mulch must be maintained until a suitable vegetative cover is established. 11. If seeding is impracticable due to the time of year, a temporary mulch must be applied and final seeding performed at the earliest opportunity when weather conditions favor germination and growth, but not more than six months after project completion. 12. All disturbed areas where soil is temporarily exposed or stockpiled for longer than one month must be stabilized with a temporary hay or s=raw mulch. Mulch must be maintained until a suitable vegetative cover is established. 13. Bales of hay or other means to control erosion are to be placed on the downslope edge of any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to be maintained in good condition until all disturbed land is heavily vegetated. 14. Disturbance to the natural vegetation or topography greater than 25 feet seaward of the approved structure is prohibited. 15. Driveway and parking areas must be constructed of pervious material. 16. Roof runoff must be directed to drywells a minimum of 75 linear feet landward of the tidal wetland boundary. 17. Backwash from pool filter must be discharged to a drywell located a mini- mum of 100 linear feet landward of the tidal wetland boundary. 18. Draining of swimming pool water directly or indirectly into tidal wetlands is prohibited. 19. Road, driveway and/or parking areas must be graded to direct runoff away from tidal wetlands. 20. Construction of any decks, accessory structures or additions that are not specifically authorized by the approved plans that are part of the permit is prohibited.. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 751-1389. Ct If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of th~ completed work and, if required, a survey. For projects involving activities to be undertaken in phases over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to recommencing work in subsequent years. The granting of this permit does not relieve the permittee of the responsibility of obtaining a grant, easement, or other necessary approval from the Division of Land Utilization, office of General Services, Tower Building, Empire State Plaza, Albany, NY 12242 (5~6) 474-2195, which may be required for any encroachment upon State-owned lands underwater.
