Main Rd. &Youngs Ave.) Telephone: 631 765-1938 Southold, NY 11971 � 11 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: November 14, 2023 Re: LWRP Coastal Consistency Review for GWEN HYMAN SCTM# 1000 111.-9 — $ Patricia Moore, Esq. on behalf of GWEN HYMAN requests a Wetland Permit for the existing two- level dwelling consisting of a 2,178sq.ft. upper level and a 2,868sq.ft. lower level that includes utility/storage space; construct a 1,302sq.ft. landward addition including attached garage; construct a 157sq.ft. front entry court with steps to grade; construct an 810sq.ft. on-grade southerly terrace with a 14.2' outdoor kitchen and pizza oven on west side of terrace, away from bluff; install a 37.6' long (inclusive of trash enclosure) privacy fence/screen and trash enclosure along south side of lower terrace and 10' from Carpenter Road; if existing vegetation is removed adjacent to Carpenter Road, vegetation will be re-planted to maintain privacy; new drywells, as needed, on the south side of the property and install drywells away from the top of bluff to contain storm-water runoff; the existing curb along Carpenter Road to remain; reconstruct 4' wide steps from the terrace to 42'8"x15' seaward side deck (to be reconstructed in-place), with a 15'x24'6" pergola over portion of deck; replace existing 576sq.ft. deck; 4'x41' set of steps from grade to deck (each segment measures 13'5", 13' 91/2", & 13' 9Y2") off northerly side of deck; construct a 13'5"x9'11" northerly deck off master bedroom with steps to a 19'9"x30'2" on-grade patio; remove existing landscape ties and handicap walkway on seaward side of property; existing ±255 linear feet of wood walls to remain with 95 linear feet along top of bluff and continuing along both the south (±75 L.F.) and north (±85LF) sides of the property; replace in-place existing 3'x±34' wood walkway to top of bluff; and establish and perpetually maintain a 10' wide vegetated Non-Turf Buffer area along the top of the bluff. SCTM# 1000-111-9-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with LWRP policy 6.3. 1. The survey states that any existing vegetation removed will be replaced with "natural vegetation." Vegetation removed should be approved by the Board, and any species should be native and drought tolerant. 2. What is the size of the deck at the bottom of the bluff? Is it permitted? Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Please advise Trustees in response to their field inspection questions: 1. Clarify intent of trees on the west side of property: My client says " We are not touching any trees and might even add more after construction". 2. Are they asking about the wall height and location(privacy screen)?: I am not aware of any walls, only a "Privacy Screen". The privacy screen is not on the property line only blocking the view of the courtyard area (so not a "fence"): height of the privacy screen is 66" and the location was staked and leaves the vegetation&trees (item 1)undisturbed. Can they clarify for me what walls? The only structure identified as a "wall" is what is existing at the top of the bluff...the retaining wall is existing and not changing. The walls are "retaining walls that are buried into the ground and only exposed a few inches above the ground. Are there any other walls? Let me know if this answers their questions. The architect is sending me a revised site plan labeling the"Top of Bluff'to match the survey. The inspection raised the following issues: 1. OK labeling top of bluff 2. The smaller retaining walls on the waterfront side are"cosmetic"(fake)railroad ties-the existing retaining walls that the survey shows are functional,the functional retaining walls are not being touched,they stay. The smaller railroad ties(not retaining walls)are being removed and the owners do not want any grass-they want natural vegetation or beach stone. We Suggest a permit condition:the seaward side of the house shall remain as"non-turf' 3. The rear yard(seaward side) is either gravel or native natural vegetation. They do not want grass. 4. Hardwood Trees (3)on seaward side of house remain. 5. It could take time to prepare a landscape plan and at this point the seaward side is remaining natural(no turf)...at a minimum, a 10' non-turf buffer will be along the top of the bluff, but most likely,the entire rear yard will remain natural. 6. I have asked the engineer to relocate the drywell away from the top of the bluff. Attached is his revised drainage plan. 7. The surveyor can not stake until October(at best)....however,you may not need the staking because we removed the fireplace and wall closest to the bluff. The owners want to preserve as much natural vegetation as possible, and the proposed privacy screen(fence) is at the edge of the lower terrace(length 28'10")not 40' as previously described,the owners are leaving the natural vegetation along the property line. They plan to add as much natural vegetation as possible to maintain their privacy from Carpenter Road(a pedestrian access). ADDITIONAL INFORMATION: The survey shows the southern Iot line bordering Carpenter Road. Site inspection shows that Carpenter Road is not passable by car. Carpenter Road is a foot path that allows pedestrians to walk with stairs down to the beach. The applicant has the benefit of Southold Town Board of Trustees Permit No. 10274A, dated November 9, 2022 to replace an existing sanitary system with an Innovative Advanced (UA) wastewater system. The applicant also has the benefit of a Board-of Trustees Permit No. 8838, dated June 22, 2016 to install a deck and steps down to the bulkhead and Board of Trustees Permit dated January 14, 1993 to replace 100 feet of bulkhead. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1,2022 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a single-family neighborhood which consists of waterfront homes. The parcel has an existing deck setback of 32 1/4 feet from the top of the bluff and the applicant is proposing to construct a new deck in the in the same location. The proposed non- conforming side yard setback is to accommodate a-proposed garage and outdoor kitchen. The proposed non- conforming setback of 15 feet is along an unopened pedestrian foot path.The proposed non-conforming side yard setback will have no impact side theside property lines are very heavily screened from view by large evergreens and mature landscaping and the decks are not visible from the street. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The non-conforming bluff setback and non- conforming single side yard setback are existing and will not be changed. The subject parcel has un-even topography. Due to the uneven topography the applicant cannot feasibly design a driveway that leads to a garage in a location different than the proposed location. 3. Town Law 5267-b(3)(b)(3). The variances granted herein are mathematically substantial is,representing 68% relief from the code for the non-conforming bluff setback; 28% relief from the code for the non- conforming'single side yard setback and 27%relief from the code for the non-conforming combined side yard setback.However,the non-conforming bluff setback and non-conforming single side yard setback are existing and will remain the same as the existing setbacks. The proposed non-conforming combined side yard setback is for an attached garage and the topographical limitations and proposed placement of the new sanitary system make this the only feasible location to place an attached garage on the property. 4. Town Law 5267-b(3)(6)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
