(E.D.S.T.), upon application of Alice M. Burden, Orient, hew York, for a variance in accordance with the Zoning Ordinance, Article III, Section 303, and Article K. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEP REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE ZONING BOARD OF APPEALS FORM ZB4 Marjorie McDermott, Secretary Southold Town Board of Appeals ~z~9 After investigation and inspection the Board finds that applicant requests permission to divide propei-ty and create lots with less than 100 ft. frontage and one lot with less than 12,500 sq, ft. of area on property located north aide of private road off west side of Village Lane, Orient, New York. The Board also finds that applicant has contracted to sell (subject to obtaining variance) the southerly 55 feet of premises and requires a variance to divide the premises. The parcel has an area of approximately 11,000 square feet. A private road extends along the waterfront affording access to Village Lane. The portion proposed to be sold will be of the same size as many of the lots in the vicinity. The Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardshipt the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Alice M, Burden, Private road off N/S Village Lane, Orient, New York, be GRANTED permission to divide property and create lots with lose than 100 ft, frontage and one lot with less than 12,500 sq. ft. of area on property located on north side of private road off west aide of Village Lane, Orient, New York, subject to the following conditions: 1. There shall be no further reduction of sideyards as established in this action. 2. There shall be no enlargement or alteration of the outside dimensions of the two dwellings on the southeast lot. 3. No additional outbuildings may be constructed on the southeast lot except that an accessory garage building, (not to exceed 500 sq* ft.), may be constructed in the rear yard area provided that the accessory buildings presently located in the rear yard area of the southeast lot are removed, and provided that a Building Permit for said accessory garage building is secured within two years of the date of this action.
